Justice PIUS C.KURIAKOSE\n\n Dated :28\/11\/2006\n\n O R D E R\n                        PIUS C.KURIAKOSE, J.\n\n                       ----------------------------------\n\n                    W.P.(C)NO. 30437  of    2006\n\n                       ----------------------------------\n\n            Dated this   28th  day of   November, 2006\n\n\n\n\n                                JUDGMENT\n<\/pre>\n<p>      The   petitioners   are   aggrieved   by   Ext.P3   order   passed   by<\/p>\n<p>the   Secretary   of   the     Pappinissery   Grama   Panchayat   rejecting<\/p>\n<p>their application for construction of  a residential building on the<\/p>\n<p>ground   that   house   construction   is   not   permitted   since   the<\/p>\n<p>property of the  petitioners    falls  within  the    Coastal Regulation<\/p>\n<p>Zone   area.       Smt.   Latha   Prabhakaran,   the   learned   Counsel   for<\/p>\n<p>the   petitioner   would   refer   to   Ext.P4   and     submit   that   the<\/p>\n<p>petitioners are yet to be  served with  a copy of the  letter of the<\/p>\n<p>member   Secretary   of   the   Kerala   Coastal       Zone   Management<\/p>\n<p>Authority     dated  9.5.2005   referred   to  in  Ext.P3.         The   learned<\/p>\n<p>counsel would also submit that she will be able to convince this<\/p>\n<p>court that the petitioners&#8217; property does not fall within the  CRZ<\/p>\n<p>area.\n<\/p>\n<p>      2.     Even though   learned Counsel   was very persuasive in<\/p>\n<p>her submissions,  since I find that the petitioners have remedy by<\/p>\n<p><span class=\"hidden_text\">WPC No. 30437\/2006                       2<\/span><\/p>\n<p>way of an appeal against Ext.P3, I am not inclined to examine the<\/p>\n<p>merits   of   the   matter.     I   therefore,   relegate   the   petitioners   to<\/p>\n<p>remedy   by   way   of   an   appeal   against   Ext.P3.     However,<\/p>\n<p>considering     submission   of   the   petitioners   that   the   petitioners<\/p>\n<p>have   not   even     been   supplied   with   a   copy   of       letter   No.<\/p>\n<p>65\/B1\/05\/C   2002   dated   9.5.2005   of  the   Secretary   of   the   Kerala<\/p>\n<p>Coastal   Zone   Management   Authority   so   far,   there   will   be   a<\/p>\n<p>direction   to   the   first   respondent   Panchayat   to   serve   the<\/p>\n<p>petitioners   with   a  copy  of   that  letter  within   three   weeks  of   the<\/p>\n<p>petitioners making available copy of this judgment.\n<\/p>\n<p>         The     writ   petition   will   stand   disposed   of   with   the   above<\/p>\n<p>direction   relegating   the   petitioners   to   remedy   by   way   of   an<\/p>\n<p>appeal against Ext.P3.\n<\/p>\n<p>                                              PIUS C.KURIAKOSE<\/p>\n<p>                                                           Judge<\/p>\n<p>dpk<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court A.
