Nanavati with learned advocate Mr.<br \/>\nPrabhav Mehta for Nanavati Associates appearing on behalf of<br \/>\npetitioner and learned AGP Ms. Jirga Jhaveri appearing on behalf of<br \/>\nrespondent &#8211; State Authority.\n<\/p>\n<p>\tPage\n<\/p>\n<p>&#8211; 91 is an order passed by District Collector, Junagadh dated<br \/>\n13th<br \/>\nAugust 2007, where, petitioner remained absence in spite of notices<br \/>\nserved by District Collector, Junagadh to petitioner, therefore, in<br \/>\nabsence of petitioner, order has been passed by District Collector,<br \/>\nJunagadh. Against that, revision application was preferred by<br \/>\npetitioner before revisional authority under Section 30 of the Mines<br \/>\nand Minerals Development and Regulation Act, 1957 read with Rule 55<br \/>\nof the Minerals Concession Rules, 1960, wherein also, considering<br \/>\nobservations made<br \/>\nby revisional authority in Para 6 that petitioner remained absent<br \/>\neven after intimation and so the case is being considered on record<br \/>\nand order passed on merit.\n<\/p>\n<p>\tLearned<br \/>\nsenior advocate Mr. Nanavati raised contention before this Court that<br \/>\nDistrict Collector, Junagadh has no jurisdiction to pass such order<br \/>\non 13th<br \/>\nAugust 2007, therefore, order passed by District Collector, Junagadh<br \/>\nis without jurisdiction.\n<\/p>\n<p>\tUnfortunately,<br \/>\npetitioner remained absent in both proceedings before both<br \/>\nauthorities, therefore, in such circumstances, it is open for<br \/>\npetitioner to file application before revisional authority &#8211;<br \/>\nrespondent No.3 with a prayer to set aside ex-parte order which was<br \/>\npassed in absence of petitioner within a period of one month from the<br \/>\ndate of receiving copy of present order.\n<\/p>\n<p>\tAfter<br \/>\nreceiving application from petitioner to set aside ex-parte order by<br \/>\nrevisional authority &#8211; respondent No.3, it is directed<br \/>\nrespondent No.3 to consider such application which has been received<br \/>\nfrom petitioner and examine the grievance which has been raised by<br \/>\npetitioner in his application and thereafter to pass appropriate<br \/>\nreasoned order in accordance with law after giving reasonable<br \/>\nopportunity of hearing to respective parties within a period<br \/>\nof four months from the date of receiving such application from<br \/>\npetitioner and communicate decision to petitioner immediately.\n<\/p>\n<p>\tIt<br \/>\nis hope that meanwhile, respondent authority may not take coercive<br \/>\naction against petitioner as further proceeding is filed by<br \/>\npetitioner before revisional authority.\n<\/p>\n<p>\tIn<br \/>\nview of above observation and direction, present petition is disposed<br \/>\nof by this Court without expressing any opinion on merits.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[H.K.\n<\/p>\n<p>RATHOD, J.]<\/p>\n<p>#Dave<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Raniben vs Collector on 30 August, 2010 Author: H.K.Rathod,&amp;Nbsp;
