Divisional Police<br \/>\nOfficer, Botad addressed to the learned Government Pleader, High<br \/>\nCourt of Gujarat. It is mentioned in the said communication that on<br \/>\ninquiry the contents of the application are found to be reasonable,<br \/>\nbut as the opposite party is residing in the same village, the Police<br \/>\nis of the opinion that there is possibility of breach of peace.\n<\/p>\n<p>1.1\t\tThis<br \/>\napprehension is found to be totally baseless and appears to have been<br \/>\nmade only with a view to shirk the responsibility and to shift the<br \/>\nburden on the Court. In the year 2009, applicant enjoyed 15 days<br \/>\ntemporary bail for study purpose and, twice he has enjoyed furlough.<br \/>\nFirst furlough in May, 2010 and second furlough in January 2011. All<br \/>\nthe three times, he has reported in time and no untoward incident is<br \/>\nreported to have taken place. Hence, the apprehension shown in letter<br \/>\ndated 31\/03\/2011 suffers from non-application of mind.\n<\/p>\n<p>2.\t\tHeard<br \/>\nMs. K D Parmar, learned Advocate for the applicant &#8211; convict.\n<\/p>\n<p>2.1\t\tTaking<br \/>\ninto consideration the contents of the application, certificate of<br \/>\nShri Meghadiya Gram Panchayat and communication dated 31\/03\/2011,<br \/>\napplication is allowed.  Rule.  Mr.Pandya, learned APP waives service<br \/>\nof notice of Rule.\n<\/p>\n<p>3.\t\tThe<br \/>\napplicant is, therefore, ordered to be released on temporary bail for<br \/>\na period of 30 (THIRTY) DAYS from the date of his release on<br \/>\nhis executing a personal bond of Rs.5,000\/- (Rupees Five Thousand<br \/>\nOnly) before the Jail Authorities on certain conditions that he will;\n<\/p>\n<p>\ta)\tnot<br \/>\nleave the State of Gujarat.\n<\/p>\n<p>\tb)\tnot<br \/>\nindulge in any illegal activity.\n<\/p>\n<p>\tc)\tsurrender<br \/>\nbefore the Jail Authorities in \t\ttime.\n<\/p>\n<p>4.\t\tA<br \/>\ncopy of this order be sent to the Director General of Police<br \/>\nalongwith a copy of the Jail Remarks, as well as, communication dated<br \/>\n31\/03\/2011.\n<\/p>\n<p>5.\t\tRule<br \/>\nis made absolute.
