(J)\n\nCITATION:\n 1996 AIR 1616\t\t  1996 SCC  (4) 174\n JT 1996 (4)   208\t  1996 SCALE  (3)495\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t    with<br \/>\n\t     CIVIL APPEAL NOS. 6897-99 OF 1996.\n<\/p>\n<p> (Arising out of SLP (C) Nos.19041\/94, 19043\/94, 19049\/94).\n<\/p>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have heard the counsel on both sides.\n<\/p>\n<p>     Notification under Section 4(1) of the Land Acquisition<br \/>\nAct 1 of 1894 (for short, the &#8216;Act&#8217;) was published on August<br \/>\n2, 1984\t acquiring the\tlands situated\tin village  Sarigam,<br \/>\nDistrict Bulsar\t in Gujarat  State for\tindustrial  purpose.<br \/>\nPossession also\t was taken after dispensing with the enquiry<br \/>\nunder Section  5-A. It\tis not\tnecessary to  dilate on\t the<br \/>\nproceedings  taken   earlier  under   Article  226   of\t the<br \/>\nConstitution.  Suffice\t it  to\t state\tthat  there  was  an<br \/>\nagreement between  the parties\tthat an\t award could be made<br \/>\nunder Section  11(2) of\t the Act  pursuant to which the Land<br \/>\nAcquisition Officer  on June 4, 1991 made the award in terms<br \/>\nof the\tagreement. The\tappellant challenged the correctness<br \/>\nof the award by filing the writ petition which was dismissed<br \/>\nby the\tHigh Court by the impugned order dated September 10,<br \/>\n1993. Thus these appeals by special leave.\n<\/p>\n<p>     This Court\t by order  dated February  28,\t1994  issued<br \/>\nnotice confined\t to the\t question whether the appellants are<br \/>\nentitled to  solatium, interest\t and additional amount under<br \/>\nSections 23(2),\t 28 and 23 [1-A] of the Act. The respondents<br \/>\nhave filed  their counter-affidavit  contending that in view<br \/>\nof the\tagreements entered  by the  appellants on January 2,<br \/>\n1981 and  subsequent agreement\tdated March  8, 1985,  which<br \/>\nhave been  filed as sample agreements before this Court, the<br \/>\nappellants are\tnot entitled  to the  payment  of  interest,<br \/>\nsolatium and additional amounts under the Act.\n<\/p>\n<p>     Shri R.F. Nariman, learned senior counsel appearing for<br \/>\nthe   appellants,  contended that  the award  passed by\t the<br \/>\nCollector is not in conformity with Section 11(2) of the Act<br \/>\nin as  much as\tthe agreements\twere not executed before the<br \/>\nCollector and  they were not in the prescribed form. He drew<br \/>\nour attention  to Form\tNo.14, prescribed  by the  Rules and<br \/>\nsubmitted that\tas desclosed  by the  Form itself,  such  an<br \/>\nagreement has  to be  executed by  the owner  of the land in<br \/>\npresence of  the Land  Acquisition Officer  and\t has  to  be<br \/>\nsigned by the Land Acquisition Officer. In the present case,<br \/>\nthe agreements\texecuted in  1985 were between the owners of<br \/>\nthe land and GIDC for whose benefit the lands were acquired.<br \/>\nThey were  not signed  in presence  of the  Land Acquisition<br \/>\nOfficer\t nor  did  the\tLand  Acquisition  Officer  put\t his<br \/>\nsignature  thereon.  Therefore,\t the  award  passed  by\t the<br \/>\nCollector cannot be said to be an award under Section 11 (2)<br \/>\nof the\tAct and,  therefore, the  appellants are entitled to<br \/>\npayment\t of   solatium,\t interest  and\tadditional  benefits<br \/>\npayable under  the Act. We do not find any substance in this<br \/>\nconnection.\n<\/p>\n<p>     In this  case, the\t agreements were  between the owners<br \/>\nand the GIDC for whose benefit the lands were acquired. Even<br \/>\nbefore the  notification under\tSection 4  was\tissued,\t the<br \/>\nowners and  the GIDC  had entered  into an agreement whereby<br \/>\nthe owners had agreed to part with possession of their lands<br \/>\nso as to enable GIDC to establish Udyog Nagar thereon. Under<br \/>\nthe  said  agreements,\tthe  GIDC  was\tpermitted  to  enjoy<br \/>\ncontinuous possession  of those\t lands till  the process  of<br \/>\nacquisition  under  the\t Land  Acquisition  Act\t was  to  be<br \/>\ncompleted. While  entering into these agreements, the owners<br \/>\nhad agreed  to accept  compensation @  Rs.6,100\/- per  acre.<br \/>\nThereafter, Section  4, notification was published on August<br \/>\n2, 1984.  While the proceedings were pending before the Land<br \/>\nAcquisition Officer,  the owners  and GIDC again in the year<br \/>\n1985  entered\tinto  separate\tagreements,  whereunder\t the<br \/>\nCorporation agreed  to pay  and the  owners agreed to accept<br \/>\ncompensation @ Rs.22,857\/- per hectare inclusive of solatium<br \/>\nand  additional\t  benefits  payable  under  the\t Act.  These<br \/>\nagreements duly\t signed were presented before the Collector.<br \/>\nOn being  satisfied about  the voluntary  nature of the said<br \/>\nagreements, the\t Collector passed an award in terms of those<br \/>\nagreements. Under  these circumstances,\t it cannot  be\tsaid<br \/>\nthat the  essential requirements of sub-section 2 of Section<br \/>\n11, as\tapplicable in the State of Gujarat, was not complied<br \/>\nwith. Moreover,\t Form No.14 as such would not be relevant in<br \/>\na case\twhere  the  agreement  is  between  the\t owners\t and<br \/>\ninterested persons  on the  one hand  and the body for which<br \/>\nthe land  is being  acquired on\t the other  hand. Form No.14<br \/>\nwould apply  to a  case where  the owners  and\tthe  persons<br \/>\ninterested in  the land\t appear\t before\t the  Collector\t and<br \/>\nexpress their  willingness to  accept an  agreed  amount  as<br \/>\ncompensation. In such cases, the agreement is required to be<br \/>\nexecuted in  the  prescribed  Form  No.14.  Therefore,\teven<br \/>\nthough in  the present\tcase the  agreements were not in the<br \/>\nprescribed form,  there being  no prescribed form for a case<br \/>\nlike this, the award cannot be said to be illegal or void.\n<\/p>\n<p>     The owners\t have agreed  in 1985 as<br \/>\n     under:\n<\/p>\n<p>     &#8220;This agreement  is being\tdone  in<br \/>\n     pursuance of  the consent agreement<br \/>\n     that  has\t been  arrived\t at   on<br \/>\n     27.12.1980 between\t Shri Hitendra @<br \/>\n     Gautam  Prem  Shankar  Oza\t of  the<br \/>\n     first   part    and   the\t Gujarat<br \/>\n     Industrial Development  Corporation<br \/>\n     of the  second part since the price<br \/>\n     of the  land that\thas  been  given<br \/>\n     under the\tsaid agreement\thas been<br \/>\n     fixed at Rs.22,857\/- (Rupees twenth<br \/>\n     two  thousand   eight  hundred  and<br \/>\n     fifty  seven   only)  per\t hectare<br \/>\n     inclusive\t  of\t solatium    and<br \/>\n     additional land compensation by way<br \/>\n     of\t  its\t consent   price.   This<br \/>\n     agreement is  thus being  done  for<br \/>\n     that limited  purpose. The\t date of<br \/>\n     possession\t and   other  terms  and<br \/>\n     conditions\t  mentioned    in    the<br \/>\n     agreement done  on\t 27.12.80  shall<br \/>\n     remain the same.&#8221;\n<\/p>\n<p>     It is  true that on determination of compensation under<br \/>\nsub-section (i) for the land acquired, Section 23(2) enjoins<br \/>\nto award,  in addition\tto the market value, 30% solatium in<br \/>\nconsideration of  compulsory nature of acquisition. Equally,<br \/>\nthe Parliament\thaving taken  notice of the inordinate delay<br \/>\nin making the award by the Land Acquisition Officer from the<br \/>\ndate of\t notification  published  under\t Section  4(1)\ttill<br \/>\npassing the  award under  Section 11,  to offset  the  price<br \/>\npeggad\tduring\t the  interregnum,   Section   23(1-A)\t was<br \/>\nintroduced to  award an amount calculated @ 12% per annum on<br \/>\nsuch market  value, in\taddition to  the market value of the<br \/>\nland, for  the period commencing on and from the date of the<br \/>\npublication of\tSection 4(1)  notification to  the  date  of<br \/>\naward of  the Collector\t or date of taking possession of the<br \/>\nland whichever\tis earlier.  Under Section  28, interest was<br \/>\ndirected to  be paid  on the excess compensation at the rate<br \/>\nspecified therein  from the date of taking possession of the<br \/>\nland to\t the date  of deposit  into  court  of\tsuch  excess<br \/>\ncompensation. These  three components are in addition to the<br \/>\ncompensation determined under sub-section (1) of Section 23.<br \/>\nThey intended  to operate in different perspectives. One for<br \/>\ncompulsory acquisition,\t the other for the delay on the part<br \/>\nof the\tLand Acquisition Officer in making the award and the<br \/>\nthird one  for deprivation of the enjoyment of the land from<br \/>\nthe date  of taking  possession till  determination  of\t the<br \/>\ncompensation. The  3  components  are  in  addition  to\t the<br \/>\ndetermination of  market  value\t under\tsub-section  (1)  of<br \/>\nSection 23.  They  are\tnot  integral  to  determination  of<br \/>\ncompensation under  sub-section (1)  of Section\t 23  but  in<br \/>\naddition to,  for the circumstances enumerated hereinbefore.<br \/>\nIn a  private sale  between a  willing vendor  and a willing<br \/>\nvendee, parties would arrive at consensus to pay and receive<br \/>\nconsolidated consideration which would form the market value<br \/>\nof the\tland conveyed  to the  vendee. For  public  purpose,<br \/>\ncompulsory acquisition\tunder the  Act gives  absolute title<br \/>\nunder Section  16 free\tfrom all encumbrances. Determination<br \/>\nof the compensation would be done under Section 23(1) on the<br \/>\nbasis of  market value\tprevailing as  on the  date  of\t the<br \/>\npublication of\tthe  notification  under  Section  4(1).  It<br \/>\nwould, therefore,  be open  to the  parties to\tenter into a<br \/>\ncontract under\tSection\t 11(2),\t without  the  necessity  to<br \/>\ndetermine compansation under Section 23(1) and would receive<br \/>\nmarket value  at the  rates  incorporated  in  the  contract<br \/>\nsigned under  Section 11  (2) in  which event the award need<br \/>\nnot be in Form 14.\n<\/p>\n<p>     This Court\t in <a href=\"\/doc\/1549211\/\">State  of Gujarat  &amp; Ors. v. Daya Shamji<br \/>\nBhai &amp;\tOrs.<\/a> [(1995)  5 SCC  746] had considered the similar<br \/>\ncontentions and held that once the parties have agreed under<br \/>\nSection 11(2)  of the  Act, the Land Acquisition Officer has<br \/>\npower under Section 11(2) to pass the award in terms thereof<br \/>\nand that  the award  need not  contain payment\tof interest,<br \/>\nsolatium and additional amount unless it is also part of the<br \/>\ncontract between  the parties. The same ratio applies to the<br \/>\nfacts in  this case.  In view  of the  above clauses  in the<br \/>\nagreements the appellants are not entitled to the payment of<br \/>\nadditional  amounts   by  way\tof  solatium,  interest\t and<br \/>\nadditional amount under the provisions of the Act.\n<\/p>\n<p>     The appeals  are  accordingly  dismissed,\tbut  in\t the<br \/>\ncircumstances, without costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Ishwarlal Premchand Shah &amp; Ors. &#8230; vs State Of Gujarat &amp; Ors on 15 March, 1996 Equivalent citations: 1996 AIR 1616, 1996 SCC (4) 174 Author: K Ramaswamy Bench: Ramaswamy, K.
