The Medical Officer, Composite Hospital, CRPF,\n                         Jhapaha, Muzaffarpur\n                                                    ...Respondents\n                                              -----------\n<\/pre>\n<p>02.   15.11.2011               Heard learned counsel for the petitioner and learned<\/p>\n<p>                   Assistant Solicitor General for the Respondent-Union of India.<\/p>\n<p>                               Petitioner was an applicant for the post of<\/p>\n<p>                   Constable\/GD in Central Reserve Police Force (for short<\/p>\n<p>                   \u201eCRPF\u201f). It is petitioner\u201fs case that he qualified at physical<\/p>\n<p>                   eligibility test followed by written test whereafter he was<\/p>\n<p>                   subjected to medical fitness test wherein he was declared<\/p>\n<p>                   medically unfit on account of High arch foot. Said document is<\/p>\n<p>                   enclosed as Annexure-2. Petitioner was required to file appeal<\/p>\n<p>                   thereagainst within specified time after obtaining medical fitness<\/p>\n<p>                   certificate. It is the petitioner\u201fs case that he got himself<\/p>\n<p>                   medically examined by an Assistant Professor, Department of<\/p>\n<p>                   Orthopaedics, PMCH, Patna who found the view of the Medical<\/p>\n<p>                   Board of CRPF      as an error of judgment. Petitioner was thus<br \/>\n<span class=\"hidden_text\">                        2<\/span><\/p>\n<p>found and held medically fit for the said post. Armed with<\/p>\n<p>aforesaid fitness certificate, he preferred appeal together with<\/p>\n<p>required fee whereafter the authorities of the CRPF by<\/p>\n<p>communication dated 25.7.2011 (Annexure-5) summoned him to<\/p>\n<p>appear for medical examination\/test at Composite Hospital,<\/p>\n<p>CRPF, Jhapaha, Muzaffarpur on 19.8.2011.            Petitioner has<\/p>\n<p>asserted as under in paragraph 12 of the writ petition:-<\/p>\n<blockquote><p>                  &#8220;That, after filing the appeal, the office of<br \/>\n               the D.I.G. (Personnel) Group Centre, C.R.P.F.,<br \/>\n               Mokamaghat, Patna send a letter to the<br \/>\n               petitioner to appear for remedical examination<br \/>\n               at Composite Hospital C.R.P.F., Jhapaha,<br \/>\n               Muzaffarpur on 19.8.2011 at 8.00 hours and<br \/>\n               accordingly the petitioner had appeared before<br \/>\n               the Board and again he was illegally and<br \/>\n               arbitrarily medically unfit and hence the<br \/>\n               petitioner has been kept deprived of getting the<br \/>\n               job.&#8221;<\/p><\/blockquote>\n<p>              Learned counsel for the petitioner submits that he is<\/p>\n<p>ready and willing to be again subjected to Review Medical<\/p>\n<p>Board consisting of doctors of CRPF and of any recognized<\/p>\n<p>medical college and hospital for ascertainment of his fitness for<\/p>\n<p>the post in question at his own cost. Learned counsel submits<\/p>\n<p>that petitioner would be satisfied if a liberty is granted to<\/p>\n<p>approach the Deputy Inspector General (Personnel) Group<\/p>\n<p>Centre (respondent no.3) in this regard who, in turn, may be<\/p>\n<p>directed to consider and dispose of the representation within a<\/p>\n<p>time-frame.\n<\/p>\n<p><span class=\"hidden_text\">                            3<\/span><\/p>\n<p>                 Learned counsel for the respondents, on the other<\/p>\n<p>     hand, submits that medical fitness is essentially a question of<\/p>\n<p>     fact. This Court in exercise of its writ jurisdiction should not<\/p>\n<p>     delve with that aspect of the matter. However, considering the<\/p>\n<p>     said stand taken by the petitioner, it is contended that the<\/p>\n<p>     aforesaid liberty be granted to the petitioner.<\/p>\n<p>                 Having heard the parties and on perusal of materials<\/p>\n<p>     on record, I am satisfied that present application        may be<\/p>\n<p>     disposed of by the following order:-\n<\/p>\n<blockquote><p>                   Let the petitioner approach the Deputy Inspector<br \/>\n             General (Personnel) Group Centre (respondent no.3) by<br \/>\n             filing a representation together with a copy of the<br \/>\n             present order within four weeks from today whereafter<br \/>\n             the said respondent shall consider and dispose of the<br \/>\n             same by a reasoned order under intimation to the<br \/>\n             petitioner. In case, the authority concerned is satisfied<br \/>\n             that he may direct constitution of a fresh Review<br \/>\n             Medical Board, in that case the same should consist of<br \/>\n             doctors of CRPF as well as of any recognized medical<br \/>\n             college and hospital. However, realization of cost for<br \/>\n             constitution of Medical Board is left to the discretion of<br \/>\n             the authority concerned.<\/p><\/blockquote>\n<p>                               ( Kishore K.
