The petitioner is the registered owner of a mini lorry bearing<\/p>\n<p>registration No.KL-07-H-6645. The said vehicle was seized by the third<\/p>\n<p>respondent on 11.9.2009, on the allegation that it was used to transport<\/p>\n<p>river sand without a valid pass and produced before the second<\/p>\n<p>respondent.    The petitioner submits that seeking interim custody of the<\/p>\n<p>vehicle he had submitted Ext.P1 representation dated 22.9.2009 before<\/p>\n<p>the District Collector, Malappuram.         The grievance voiced by the<\/p>\n<p>petitioner in this writ petition is that till date, orders have not been<\/p>\n<p>passed on the request made by him in Ext.P1. In this writ petition, the<\/p>\n<p>petitioner inter alia seeks a writ in the nature of mandamus commanding<\/p>\n<p>the respondents to release the vehicle to him.<\/p>\n<p>       3.    A learned Single Judge of this Court has in <a href=\"\/doc\/63167\/\">Subramanian V.<\/p>\n<p>State of Kerala<\/a> (2009(1) KLT 77) while upholding the constitutional<\/p>\n<p>validity of the Kerala Protection of River Banks and Regulation of Removal<\/p>\n<p>of Sand Act, 2001 held that the District Collector has the power to direct<\/p>\n<p>release of any vehicle which is seized and produced before him, by way<\/p>\n<p>of interim custody. In such circumstances, I am of the opinion that the<\/p>\n<p>District Collector should consider the request made by the petitioner for<\/p>\n<p>interim custody of the vehicle bearing registration No.KL-07-H-6645 and<\/p>\n<p>pass orders thereon. I accordingly dispose of this writ petition with the<\/p>\n<p>following directions:\n<\/p>\n<p>      i)     The District Collector shall within seven days from the date<\/p>\n<p>on which the petitioner produces a certified copy of this judgment pass<\/p>\n<p>orders granting interim custody of the vehicle to him on such terms and<\/p>\n<p>conditions as he may deem fit to impose.\n<\/p>\n<p>      ii)    The District Collector shall pass final orders in the<\/p>\n<p>proceedings initiated by him under the Kerala Protection of River Banks<\/p>\n<p>and Regulation of Removal of Sand Act, 2001 and the rules framed<\/p>\n<p>thereunder within three months from such date after affording the<\/p>\n<p>petitioner a reasonable opportunity of being heard. The District Collector<\/p>\n<p>shall pass an order giving reasons in support of his conclusions and shall<\/p>\n<p>communicate a copy thereof to the petitioner expeditiously.
