Justice V.GIRI\n\n Dated :07\/08\/2009\n\n O R D E R\n                           V.GIRI, J\n                  -----------------------------------\n                    W.P.(C).22556\/2009\n                  -----------------------------------\n        Dated this the 7th day of August, 2009\n\n                        JUDGMENT\n<\/pre>\n<p>         The vehicle belonging to the petitioner<\/p>\n<p>bearing registration No.KL-08-U-337, was seized on<\/p>\n<p>26.7.2009. Thereafter, proceedings were initiated<\/p>\n<p>under Section 17 of the Kerala Anti Social Activities<\/p>\n<p>(Prevention) Act, 2007, alleging that the vehicle was<\/p>\n<p>used for illicit transportation of river sand. Petitioner&#8217;s<\/p>\n<p>explanation was not accepted. Ext.P2 seizure mahazar<\/p>\n<p>has been challenged in this writ petition. Petitioner<\/p>\n<p>has mounted a challenge against the validity of Section<\/p>\n<p>17 of the Kerala Anti Social Activities (Prevention) Act,<\/p>\n<p>2007.\n<\/p>\n<p>         2.    A Division Bench of this Court in Writ<\/p>\n<p>Petition No.9925\/2009 and connected cases, has<\/p>\n<p>declared that the vehicles cannot be seized for<\/p>\n<p>transportation of river sand relying on the vague<\/p>\n<p>provisions of Section 17 of the Act. In such cases, they<\/p>\n<p>have to be dealt with under Section 23 of the Kerala<\/p>\n<p>Protection of River Banks and Regulation of Removal of<\/p>\n<p>W.P.(C)No.22556\/09<br \/>\n                          :: 2 ::\n<\/p>\n<p>\nSand Act, 2001. The Division Bench has issued the<\/p>\n<p>following directions.\n<\/p>\n<blockquote><p>              &#8220;The confiscation order, if any,<\/p>\n<p>        passed in any of the cases will stand<\/p>\n<p>        quashed. In all cases, irrespective of<\/p>\n<p>        whether there was a confiscation order<\/p>\n<p>        or not, the District Collector shall<\/p>\n<p>        decide whether proceedings under the<\/p>\n<p>        Kerala Protection of River Banks and<\/p>\n<p>        Regulation of Removal of Sand Act and<\/p>\n<p>        the Rules       thereunder should be<\/p>\n<p>        initiated against the vehicle concerned,<\/p>\n<p>        within one month from the date of<\/p>\n<p>        receipt\/production of a copy of this<\/p>\n<p>        judgment. If proceedings are initiated,<\/p>\n<p>        the same shall be finalised within one<\/p>\n<p>        month.      If the petitioners desire<\/p>\n<p>        release of their vehicles, which are not<\/p>\n<p>        so far released, pending final decision,<\/p>\n<p>        the same shall be released to them<\/p>\n<p>        forthwith by the District Collector,<\/p>\n<p>        subject to the conditions imposed by<\/p>\n<p>        this Court for releasing the vehicle in<\/p>\n<p>        W.P.(C).9925 of 2009.<\/p><\/blockquote>\n<p>         3.     Accordingly,     the   writ   petition is<\/p>\n<p>disposed of in the following terms:<\/p>\n<blockquote><p>        (i).   Petitioner shall deposit an amount of<\/p>\n<p>               Rs.25,000\/-,    with    the   District<\/p>\n<p>               Collector and there upon, the vehicle<\/p>\n<p>               in   question   bearing   registration<\/p>\n<p>W.P.(C)No.22556\/09<br \/>\n                          :: 3 ::\n<\/p><\/blockquote>\n<blockquote><p>\n               No.KL-08-U-337 shall be forthwith<\/p>\n<p>               released to the petitioner.<\/p>\n<\/blockquote>\n<blockquote><p>        (ii).  But such release of the vehicle shall<\/p>\n<p>               not prevent the District Collector or<\/p>\n<p>               the    Revenue       Officials    taking<\/p>\n<p>               proceedings     against    the   vehicle<\/p>\n<p>               under the provisions of Section 23 of<\/p>\n<p>               the Kerala Protection of River Banks<\/p>\n<p>               and Regulation of Removal of Sand<\/p>\n<p>               Act, 2001. District Collector      shall,<\/p>\n<p>               within one month from the date of<\/p>\n<p>               receipt of a copy of this judgment,<\/p>\n<p>               take a decision whether proceedings<\/p>\n<p>               will have to be initiated, in the<\/p>\n<p>               instant case, in relation to the vehicle<\/p>\n<p>               bearing registration No.KL-08-U-337,<\/p>\n<p>               under Section 23 of the Act.\n<\/p><\/blockquote>\n<blockquote><p>        (iii). Such proceedings, if initiated, shall<\/p>\n<p>               be done within one month from the<\/p>\n<p>               date on which the vehicle is released<\/p>\n<p>               and if it is not so initiated within one<\/p>\n<p>               month, then, it will not be open to<\/p>\n<p>               the respondents to thereafter initiate<\/p>\n<p>               proceedings     under     the   Act,  in<\/p>\n<p>               relation to the seizure effected on<\/p>\n<p>               26.7.2009.<\/p><\/blockquote>\n<p>        (iv).  Vehicle,    if  released    on   interim<\/p>\n<p>               custody,    shall  not   be   used   for<\/p>\n<p>               transportation of sand for a period of<\/p>\n<p>               one     month.      If     within    the<\/p>\n<p>               aforementioned period of one month<\/p>\n<p>               from the date on which the vehicle is<\/p>\n<p>               released, proceedings under the Act<\/p>\n<p>W.P.(C)No.22556\/09<br \/>\n                         :: 4 ::\n<\/p>\n<p>\n               are not initiated as permitted herein<\/p>\n<p>               above, then it will be open to the<\/p>\n<p>               petitioner to use it in accordance<\/p>\n<p>               with law.\n<\/p>\n<p>        (v).   If such proceedings are not initiated,<\/p>\n<p>               Rs.25,000\/-    deposited    by    the<\/p>\n<p>               petitioner shall be refunded to him.<\/p>\n<p>               Initiation of proceedings under the<\/p>\n<p>               Act, shall be done by the issuance of<\/p>\n<p>               a   notice from the office of     the<\/p>\n<p>               District Collector.\n<\/p>\n<p>        (vi).
