Justice V.GIRI\n\n Dated :04\/02\/2009\n\n O R D E R\n             J.B.KOSHY,Ag.C.J. &amp; V.GIRI, J\n                   --------------------------------\n                        W.A.372\/2008\n                   --------------------------------\n            Dated this 4th day of February, 2009\n\n                         JUDGMENT\n<\/pre>\n<p>Koshy (Ag.C.J.)<\/p>\n<p>           The appellant is the proprietor of a saw mill by<\/p>\n<p>Name Pullikkunnu Wood Industries, situated within the<\/p>\n<p>area of the first respondent Panchayat. He applied for a<\/p>\n<p>licence to run a saw mill. As per the directions of the<\/p>\n<p>Panchayat, appellant submitted an application before the<\/p>\n<p>DFO, the second respondent, for issuance of an NOC for<\/p>\n<p>establishment of the saw mill, and DFO, as per Ext.P1<\/p>\n<p>order dated 7.11.1996 issued NOC to the appellant. DFO<\/p>\n<p>conducted an inspection of the site and found that the<\/p>\n<p>proposed site is within 5 Kms from the nearest forest<\/p>\n<p>area. The District Medical Officer approved the site plan<\/p>\n<p>for installation of 65 HP electric motor with certain<\/p>\n<p>conditions. On the basis of the above, Ext.P3 licence was<\/p>\n<p>issued. Thereafter year to year, licence was renewed till<\/p>\n<p>31.3.2006. On 17.7.2006, petitioner applied for renewal<\/p>\n<p>of licence and that was rejected by the Panchayat stating<\/p>\n<p>that the petitioner was given permission               for the<\/p>\n<p>installation of a 25 HP motor and not 65 HP motor, as<\/p>\n<p>W.A.372\/2008<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>evidenced by Ext.P4. But according to the petitioner,<\/p>\n<p>Ext.P2 itself is in respect of 65 HP motor.        Ext.P6<\/p>\n<p>communication was thereafter, issued to the petitioner<\/p>\n<p>asking him to produce a fresh NOC in order to renew the<\/p>\n<p>licence, followed by Ext.P7.\n<\/p>\n<\/p>\n<p>2.    Panchayat has taken a contention that since the<\/p>\n<p>licnece was not renewed in time, it cane be taken only as<\/p>\n<p>a fresh licence and for issuing fresh licence, NOC is<\/p>\n<p>required.\n<\/p>\n<\/p>\n<p>3.    Learned Government Pleader submits that as per<\/p>\n<p>the directions dated 23.5.2008,   DFO has no power to<\/p>\n<p>issue such an NOC, but that itself shows that such an<\/p>\n<p>NOC is not necessary for the licence issued prior to<\/p>\n<p>30.10.2002. The licence of the petitioner was admittedly<\/p>\n<p>issued prior to 30.12.2002. The learned single Judge<\/p>\n<p>came to the conclusion that the application for renewal<\/p>\n<p>of licence was submitted after the prescribed period and<\/p>\n<p>so that it could be considered as a fresh application and<\/p>\n<p>in that view of the matter, petitioner has to obtain a<\/p>\n<p>fresh NOC from the Central Empowered Committee and<\/p>\n<p>W.A.372\/2008<br \/>\n<span class=\"hidden_text\">                              3<\/span><\/p>\n<p>that as per the     decision of the Supreme Court in<\/p>\n<p><a href=\"\/doc\/32632\/\">T.N.Godavarman Thirumulpad v. Union of India<\/p>\n<p>&amp; Others (AIR<\/a> 1997 SC, 1228), belated applications<\/p>\n<p>cannot be renewed. The Forest officials also took the<\/p>\n<p>stand that since the application was not filed within time,<\/p>\n<p>it can be treated as a fresh licence as if there is no<\/p>\n<p>provision in the Panchayat Raj Act or Rules for belated<\/p>\n<p>applications. Rule 19 of the &#8220;The Kerala Panchayat Raj<\/p>\n<p>(Issue of Licence to Dangerous and Offensive Trades<\/p>\n<p>and Factories) Rules, 1996, reads as follows:-<\/p>\n<p>      Additional   Fee    &#8211;  The  maximum      fee<\/p>\n<p>      specified in Schedule III appended to these<\/p>\n<p>      rules shall be applicable only for the<\/p>\n<p>      application submitted in due time. In the<\/p>\n<p>      case of belated applications, an additional<\/p>\n<p>      fee of 25 per cent of the fee for licence<\/p>\n<p>      payable under the schedule may be<\/p>\n<p>      charged.\n<\/p>\n<\/p>\n<p>4.   In the case of belated application, petitioner shall<\/p>\n<p>pay an additional fee of 25% of the fee for licence and<\/p>\n<p>that is payable under the schedule. Here the mill was<\/p>\n<p>running before 30.10.2002 as can be seen from Ext.P3<\/p>\n<p>W.A.372\/2008<br \/>\n<span class=\"hidden_text\">                               4<\/span><\/p>\n<p>series of licences. It was running upto 2002, without<\/p>\n<p>any complaint. There is no forest offences against the<\/p>\n<p>petitioner during this period. Department also has not<\/p>\n<p>insisted for renewal of licences for the industries which<\/p>\n<p>was established before 30.10.2002. petitioner was also<\/p>\n<p>not asked to produce fresh NOC.           Fresh NOC was<\/p>\n<p>necessary only if it is for a fresh licence.
