REGISTRAR, MAGADH UNIVERSITY, BODH GAYA\n<\/p>\n<p>                                        &#8212;&#8212;&#8212;&#8211;\n<\/p>\n<p>04.   17.3.2011                   The issue relates to re-designation on the post of<\/p>\n<p>                  Laboratory Incharge, Laboratory Assistant, Lab Technician etc. It<\/p>\n<p>                  takes them out to the ambit to their       prejudice   vis-\u00e0-vis a<\/p>\n<p>                  demonstrator.\n<\/p>\n<p>                                  The issue and the submissions made by the learned<\/p>\n<p>                  counsel for the petitioners at the bar is fully answered or covered<br \/>\n<span class=\"hidden_text\">                              5<\/span><\/p>\n<p>      by a batch of writ applications which came to be decided by the<\/p>\n<p>      learned single Judge on 21.9.2010, which was the case of<\/p>\n<p>      Laliteshwar Mishra &#8220;Lalitesh&#8221; and other analogous cases<\/p>\n<p>      namely, CWJC No. 1377 of 2010 etc.<\/p>\n<p>                    After going into various ambits of the dispute the<\/p>\n<p>      Court had very clearly recorded in the following terms:\n<\/p>\n<p>                    &#8220;Before parting, I would like to clarify that this<\/p>\n<p>      Court, having settled the law in this regard, it would apply to<\/p>\n<p>      all Universities governed by Bihar State Universities Act, 1976<\/p>\n<p>      without any individual discrimination.&#8221;\n<\/p>\n<p>                    If that is even recorded by the learned single Judge<\/p>\n<p>      in adjudicating the dispute, there is no reason why the petitioners<\/p>\n<p>      have been discriminated or not given the benefit which they are<\/p>\n<p>      looking for as such.\n<\/p>\n<p>                    All the writ applications are allowed in terms of the<\/p>\n<p>      decision rendered in the case of Laliteshwar Mishra &#8220;Lalitesh&#8221;\n<\/p>\n<p>      (supra).
