Justice M.SASIDHARAN NAMBIAR\n\n Dated :08\/09\/2010\n\n O R D E R\n               M.Sasidharan Nambiar, J.\n              --------------------------\n               W.P.(C)No.3356 of 2007 Y\n              --------------------------\n\n                       JUDGMENT\n<\/pre>\n<p>    Petitioner    is  the   accused   in   Crime   No.<\/p>\n<p>243\/CR\/KLM\/06, investigated by CBCID, Kollam. The case<\/p>\n<p>was  originally  registered  as  Crime  No.22\/2006   of<\/p>\n<p>Karunagappally Police Station for the offences under<\/p>\n<p>Sections 302, 377 and 201 of Indian Penal Code. This<\/p>\n<p>petition is filed under Article 226 of Constitution of<\/p>\n<p>India for a writ of mandamus directing first respondent<\/p>\n<p>to withdraw the investigation from CBCID and to entrust<\/p>\n<p>it to the sixth respondent.\n<\/p>\n<p>    2.  Though  the  writ  petition  was  admitted  on<\/p>\n<p>31.1.2007, investigation was not stayed and in fact,<\/p>\n<p>investigation  was  allowed  to  be  continued with  a<\/p>\n<p>direction that final report shall not be submitted till<\/p>\n<p>the next posting date. The interim order was extended<\/p>\n<p>thereafter. Meanwhile, investigation was completed and<\/p>\n<p>it was represented on 17.7.2007 that final report was<\/p>\n<p>ready. Investigating Officer was directed to produce<\/p>\n<p>copy of the final report which is said to be ready for<\/p>\n<p>filing. Copy of the report was submitted in 2007<\/p>\n<p><span class=\"hidden_text\">WPC 3356\/07                2<\/span><\/p>\n<p>itself. Still, petition is pending here. Investigating<\/p>\n<p>Officer could not file the final report in view of the<\/p>\n<p>interim order.\n<\/p>\n<p>     3. Learned counsel appearing for the petitioner<\/p>\n<p>and learned Government Pleader were heard.<\/p>\n<p>     4. Argument of the learned counsel appearing for<\/p>\n<p>the   petitioner  is  that   there  was  no   effective<\/p>\n<p>investigation and petitioner has been implicated only<\/p>\n<p>for the reason that father of the victim had filed a<\/p>\n<p>petition    for  CBI   investigation  and   no   proper<\/p>\n<p>investigation   was  conducted  by  the   Investigating<\/p>\n<p>Officer.\n<\/p>\n<p>     5. I have gone through the copy of the final<\/p>\n<p>report submitted by the Investigating Officer. I do not<\/p>\n<p>find any reason to interfere with due process of law.<\/p>\n<p>Investigating Officer is permitted to submit the final<\/p>\n<p>report before the Magistrate.
