VARIAVA, J.\n<\/p>\n<p>L&#8230;I&#8230;T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T&#8230;&#8230;.T..J<\/p>\n<p>    This  Appeal  is against an Order dated  24th  December,<br \/>\n1998  passed by the Monopolies &amp; Restrictive Trade Practices<br \/>\nCommission  (hereinafter  referred  to as  the\tCommission).<br \/>\nBriefly stated the facts are as follows:\n<\/p>\n<p>    Sometime  in  September\/October 1994 the 2nd  Respondent<br \/>\nissued\t an   Advertisement   inviting\t applications\tfrom<br \/>\nprospective  entrepreneurs for allotment of industrial plots<br \/>\nof  1,\t1\/2,  1\/4 acre at Rs.  750 per Sq.   meters  in\t the<br \/>\nElectronic  Hardware  Technology Part, Sector  34,  Gurgaon.<br \/>\nThe  1st  Respondent  applied  on   a  prescribed  form\t for<br \/>\nallotment of a 1\/2 acre plot.  Along with his Application he<br \/>\npaid a sum of Rs.  1,57,500\/-.\n<\/p>\n<p>    On\t8th  November,\t1994 the  Plot\tAllotment  Committee<br \/>\ncalled\tthe  1st  Respondent  for  personal  discussion\t and<br \/>\nevaluation  of\this  project  report.\tThe  1st  Respondent<br \/>\nattended the personal discussion and discussed the viability<br \/>\nof  his project with the concerned authorities.\t  Thereafter<br \/>\nthe  Appellants\t asked\tthe  1st Respondent  to\t submit\t his<br \/>\nproject\t report\t to them.  The 1st Respondent did so.  By  a<br \/>\nLetter dated 29th June, 1995 the Appellants informed the 1st<br \/>\nRespondent  that it was decided that he would be offered  an<br \/>\nindustrial  plot  measuring 500 Sq.  meters at\tUdyog  Vihar<br \/>\nPhase &#8211; 6, Gurgaon or 1\/8 acre industrial plot at Industrial<br \/>\nState, Bahadurgarh and that he should give his acceptance to<br \/>\none  of the two plots.\tThe 1st Respondent by a letter dated<br \/>\n10th  July, 1995 conveyed his acceptance of the plot of\t 500<br \/>\nSq.  meters at Udyog Vihar, Phase-6, Gurgaon.\n<\/p>\n<p>    The\t 1st  Respondent was then informed that he had\tbeen<br \/>\nallotted  Plot\tNo.  74 measuring 500 Sq.  meters  at  Udyog<br \/>\nVihar, Gurgaon.\t He was also told by the 2nd Respondent that<br \/>\nhe  should  give  his consent to have  his  Application\t and<br \/>\nearnest\t money\ttransferred  to\t the  Appellants.   The\t 1st<br \/>\nRespondent  gave his consent on 19th February, 1996 and\t the<br \/>\nearnest\t money\tof  Rs.\t 1,57,500\/- was transferred  to\t the<br \/>\nAppellants.  Thus the offer of 500 Sq.\tmeters plot at Udyog<br \/>\nVihar,\tGurgaon\t was  accepted\tand  in\t pursuance  of\tsuch<br \/>\nconcluded  contract  an\t allotment was made.   In  spite  of<br \/>\nallotment  of  a specific plot the Appellants  did  nothing.<br \/>\nThe  Government\t of Haryana issued directions on 15th  July,<br \/>\n1996.  By these it was directed that plots in High Potential<br \/>\nZone,  which included Gurgaon, could only be sold by an open<br \/>\nauction\t and  where  the process of allotment had  not\tbeen<br \/>\ncompleted  the application money should be returned and such<br \/>\nplot  should  be put to auction in terms of the new  Policy.<br \/>\nAs a result of this the 1st Respondent was informed that his<br \/>\nallotment  stood cancelled.  The earnest money deposited  by<br \/>\nhim,  which had been kept by the 2nd Respondent and then  by<br \/>\nthe  Appellants from 1994 onwards, was returned without\t any<br \/>\ninterest.   The\t 1st Respondent refused to encash  the\tbank<br \/>\ndraft  sent to him.  He represented that he had already been<br \/>\nallotted a plot and the same should be given to him.  As his<br \/>\nrepresentation was not considered the 1st Respondent filed a<br \/>\nComplaint  under Section 12(B) read with Section 36A of\t the<br \/>\nMonopolies  &amp;  Restrictive Trade Practices Act, 1969  before<br \/>\nthe  Commission.   In  the  course  of\thearing\t before\t the<br \/>\nCommission  it\twas discovered that Plot no.  74, which\t had<br \/>\nbeen  allotted to the 1st Respondent was 456 sq.  mts.\t and<br \/>\nnot 500 sq.  mts.\n<\/p>\n<p>    The\t Commission after hearing the parties has passed the<br \/>\nimpugned  Order\t dated 24th December, 1998.  The  Commission<br \/>\nhas inter alia directed as follows:\n<\/p>\n<p>    &#8220;It\t is  also directed that the  applicant\/complaint  be<br \/>\ngiven a plot measuring not less than 500 sq.  mts.  in Udyog<br \/>\nVihar  Phase  VI for his project @ Rs.\t750\/- per sq.\tmts.<br \/>\nWe also direct that the respondents compensate the complaint<br \/>\nby  paying interest @ 18% per annum on the amount of earnest<br \/>\nmoney  in  excess  of 10% of the value of the plot  500\t sq.<br \/>\nmts.  The value of the plot shall be calculated @ Rs.  750\/-<br \/>\nper sq.\t mts.  which was the prevailing rate at the relevant<br \/>\ntime.&#8221;\n<\/p>\n<p>    Mr.\t  Mahabir  Singh submitted that the Appellants\twere<br \/>\nbound to comply with the directions of the Government issued<br \/>\non  15th  July,\t 1996.\t He  submitted\tthat  as  per  these<br \/>\ndirections the plot could only by sold in a open auction and<br \/>\nas  the process of allotment had not been completed inasmuch<br \/>\nas  the\t Deed  had not been executed in favour\tof  the\t 1st<br \/>\nRespondent   the  Appellants  were   bound  to\trefund\t the<br \/>\napplication  money  and\t put up the plot  for  auction.\t  He<br \/>\nrelied upon the case of M.  P.\tRation Vikreta Sangh Society<br \/>\nv.   State of M.  P.  reported in (1981) 4 SCC 535, for\t the<br \/>\npreposition  that  the\tframe  of a scheme is  a  matter  of<br \/>\nGovernment policy in which Court&#8217;s interference could not be<br \/>\ncalled\tfor.   He  also relied upon the case  of  <a href=\"\/doc\/106763\/\">Principal,<br \/>\nMadhav\tInstitute of Technology &amp; Science v.  Rajendra Singh<br \/>\nYadav<\/a>\treported  in  (2000)  6\t  SCC  608,  for  the\tsame<br \/>\npreposition.  He submitted that therefore the impugned Order<br \/>\ncould\tnot   be  sustained  and   should  be\tset   aside.<br \/>\nAlternatively,\the submitted that if an allotment had to  be<br \/>\nmade  to the 1st Respondent, then it should be at the  rates<br \/>\nnow  prevailing.  He submitted that even if the Court is not<br \/>\nwilling\t to  direct the 1st Respondent to pay the rates\t now<br \/>\nprevailing,  the Court should direct payment of some  higher<br \/>\nrate.  In support of this submission he relied upon the case<br \/>\nof  HUDA v.  Sunit Rekhi reported in 1989 Supp (2) SCC\t169.<br \/>\nIn  this case there has been a sale of large number of plots<br \/>\nby  the Development Authority.\tSubsequently, the allotments<br \/>\nwere  sought to be set aside and the plots were proposed  to<br \/>\nbe  sold  by fresh auction.  Majority of the  old  allottees<br \/>\npurchased  the plots in the fresh auction at a higher  rate.<br \/>\nSome  of  the old allottees did not accept this and filed  a<br \/>\nWrit  Petition.\t  This\tCourt ultimately held  that  as\t the<br \/>\nmajority  had paid a higher rate it would be unfair to allow<br \/>\nthe  minority  to  get the plots at old rates  and  directed<br \/>\npayment\t of  50% more than the old rate.   Those  directions<br \/>\nwere  given on the peculiar facts of that case and not as  a<br \/>\nmatter\t of  principle.\t  Such\ta  direction  can  have\t  no<br \/>\napplication to the facts of the present case.\n<\/p>\n<p>    In\tour  view,  the\t impugned   Order  suffers  from  no<br \/>\ninfirmity.   The Appellants could not have, on the basis  of<br \/>\nthe  changed Policy of 15th July, 1996, refused to  complete<br \/>\nthe  formalities so far as the 1st Respondent is  concerned.<br \/>\nIn  the\t case  of 1st Respondent there had already  been  an<br \/>\nallotment.    Thus  the\t process  of  allotment\t  had\tbeen<br \/>\ncompleted.   In\t this view of the matter the Commission\t was<br \/>\nright  in  issuing  the\t directions that  it  did.   As\t the<br \/>\nallotment  was\tcompleted  the 1st Respondent could  not  be<br \/>\nasked  to  pay any rate higher than the one on which he\t had<br \/>\nbeen allotted the plot.\t We see no reason to interfere.\n<\/p>\n<p>    The\t Appeal stands dismissed.
