Justice K.HEMA\n\n Dated :15\/01\/2009\n\n O R D E R\n                            K.HEMA, J.\n               ------------------------------------------\n               B.A. Nos.7628 &amp; 7692 OF 2008\n               ------------------------------------------\n            Dated this the 15th day of January, 2009\n\n\n                             O R D E R\n<\/pre>\n<p>      These petitions are for anticipatory bail.<\/p>\n<p>      2. The alleged offences are under Sections 143, 147, 148,<\/p>\n<p>332, 201, 294(b), 307 read with 149 of IPC, Section 3 and 5 of<\/p>\n<p>Explosive Substances Act and Section 4 of Prevention of<\/p>\n<p>Damage to Public Property Act. According to prosecution, on<\/p>\n<p>04.09.2008, accused formed into an unlawful assembly and<\/p>\n<p>assaulted the Dy.S.P. and other police officials. They also<\/p>\n<p>pelted stones at the police jeep and the officials and jeep was<\/p>\n<p>damaged and the officials were seriously injured. Country<\/p>\n<p>bombs were also thrown at them. Altogether there are 50<\/p>\n<p>persons and petitioners are accused nos. 6 and 10.<\/p>\n<p>      3. Learned counsel for petitioners submitted that<\/p>\n<p>petitioners are absolutely innocent of the allegations made.<\/p>\n<p>The names of petitioners were not mentioned in the F.I.<\/p>\n<p>Statement or the F.I.R. and they are brought into the array of<\/p>\n<p>accused, without any basis. Some names of persons are<\/p>\n<p>supplied by the political group and those are simply<\/p>\n<p>B.A.Nos.7628 &amp; 7692 of 2008<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>incorporated in the reports and petitioners apprehend arrest.<\/p>\n<p>Petitioners are youngsters. Tenth accused is a student and if<\/p>\n<p>he is to be detained in prison, it will adversely affect his future.<\/p>\n<p>Petitioners are B.J.P. activists and they have not committed<\/p>\n<p>any offence. It is also submitted that some of the co-accused<\/p>\n<p>are granted bail by the Sessions Court.\n<\/p>\n<p>       4. Learned counsel for tenth accused submitted that as<\/p>\n<p>per the document produced, petitioner was regularly attending<\/p>\n<p>the institute. It is unlikely that petitioner would have been<\/p>\n<p>present in the premises at the time of occurrence. Learned<\/p>\n<p>counsel for sixth accused submitted that if an identification<\/p>\n<p>parade is conducted, petitioner cannot be identified, since he<\/p>\n<p>has not involved in the crime. On the basis of this allegation, if<\/p>\n<p>these 2 persons are detained in prison it will result in great<\/p>\n<p>injustice and irreparable injury, it is submitted.<\/p>\n<p>       5. This petition is strongly opposed. Learned Public<\/p>\n<p>Prosecutor submitted that the allegations made are serious in<\/p>\n<p>nature. The attack is made on the police party which included<\/p>\n<p>even high ranking officer like Dy.S.P. The police jeep was<\/p>\n<p>destroyed almost completely. Petitioners involvement is<\/p>\n<p>B.A.Nos.7628 &amp; 7692 of 2008<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>revealed by the statement of the witnesses, who have<\/p>\n<p>witnessed the scene and only because there is omission in the<\/p>\n<p>F.I. Statement to mention the name it may not be said that<\/p>\n<p>petitioners are not involved.\n<\/p>\n<p>       On hearing both sides, I am satisfied that the allegations<\/p>\n<p>made against against petitioners are serious in nature. It may<\/p>\n<p>not be proper in a case of this nature to grant anticipatory bail,<\/p>\n<p>unless some strong circumstances are pointed out to show that<\/p>\n<p>petitioners are actually not involved. A bare assertion that they<\/p>\n<p>are implicated due to political intervention by itself may not be<\/p>\n<p>a ground to come to a conclusion in favour of petitioners at<\/p>\n<p>this early stage of investigation. The court can act only on the<\/p>\n<p>basis of the materials in the case diary at this stage and no<\/p>\n<p>such circumstances is pointed out to grant anticipatory bail.<\/p>\n<p>          i) Petitioners are directed to surrender before<\/p>\n<p>              the   Magistrate   court  concerned   or  the<\/p>\n<p>              Investigating Officer and bound to co-operate<\/p>\n<p>              with the investigation.\n<\/p>\n<p>          ii) If petitioners surrender before the Magistrate<\/p>\n<p>              court and file application for bail, all the<\/p>\n<p>B.A.Nos.7628 &amp; 7692 of 2008<br \/>\n<span class=\"hidden_text\">                                  4<\/span><\/p>\n<p>             contentions raised before this court can be<\/p>\n<p>             raised before that court also and learned<\/p>\n<p>             Magistrate shall look into those contentions<\/p>\n<p>             and dispose of the same on merit.\n<\/p>\n<p>        iii) It is made clear that rejection of anticipatory<\/p>\n<p>             bail cannot be by itself be a ground to reject<\/p>\n<p>             the application under Section 437 Cr.P.C.<\/p>\n<p>             Consideration for granting or rejection of<\/p>\n<p>             anticipatory bail are different from those to be<\/p>\n<p>             considered under Section 437 Cr.P.C.
