Addl.Sessions Judge, Court No.15, Ahmedabad<br \/>\n\tCity, by which the respondents came to be acquitted for the offences<br \/>\n\tpunishable under Sections 498A, 306, 114 IPC and Sections 3 and 7 of<br \/>\n\tthe Dowry Prohibition Act.\n<\/p>\n<p>The<br \/>\n\treasons as to why the appeal could not be filed in time are detailed<br \/>\n\tin paragraph 4 of the application. The averments made in the<br \/>\n\tapplication are supported by affidavit sworn by Mr.G.P.Rathod, Under<br \/>\n\tSecretary, Legal Department, Sachivalaya, Gandhinagar, wherein it is<br \/>\n\tinter-alia stated that the delay has been caused because  of<br \/>\n\tinter-department and intra-department proceedings. It is, therefore,<br \/>\n\tprayed to condone the delay.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced by Mr.L.B. Dabhi, learned APP,<br \/>\n\tfor the applicant &#8211; State of Gujarat and Mr.Shirish Patel,<br \/>\n\tlearned advocate for the respondents &#8211; accused, and on perusal<br \/>\n\tof the averments made in the application, which have remained<br \/>\n\tuncontroverted and considering the celebrated principles governing<br \/>\n\tthe discretionary exercise of power conferred under Section 5 of the<br \/>\n\tAct so also the reported decisions of the Hon&#8217;ble Supreme Court<br \/>\n\tconstruing Section 5 of the Act liberally, we are of the considered<br \/>\n\topinion that there was sufficient cause which prevented the<br \/>\n\tApplicant from filing the Appeal in time. The record does not<br \/>\n\tindicate that there was any inaction or negligence on the part of<br \/>\n\tthe applicant in prosecuting the appeal. The applicant has never<br \/>\n\tabandoned the lis. The explanation offered by the Applicant for<br \/>\n\tcondonation of delay is not only plausible, but acceptable.\n<\/p>\n<p>Seen<br \/>\n\tin the above context, since there was sufficient cause which<br \/>\n\tprevented the applicant from filing the appeal in time, this<br \/>\n\tapplication deserves to be allowed by condoning the delay as prayed<br \/>\n\tfor.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed.   Delay of 26 days caused in filing the above numbered<br \/>\n\tCriminal  Appeal is condoned.
