{"id":113356,"date":"2010-04-13T00:00:00","date_gmt":"2010-04-12T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/shubkari-vs-dakshin-on-13-april-2010"},"modified":"2017-06-05T19:26:37","modified_gmt":"2017-06-05T13:56:37","slug":"shubkari-vs-dakshin-on-13-april-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/shubkari-vs-dakshin-on-13-april-2010","title":{"rendered":"Shubkari vs Dakshin on 13 April, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Gujarat High Court<\/div>\n<div class=\"doc_title\">Shubkari vs Dakshin on 13 April, 2010<\/div>\n<div class=\"doc_author\">Author: K.A.Puj,&amp;Nbsp;<\/div>\n<pre>   Gujarat High Court Case Information System \n\n  \n  \n    \n\n \n \n    \t      \n         \n\t    \n\t\t   Print\n\t\t\t\t          \n\n  \n\n\n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t \n\t\n\n\n \n\n\n\t \n\nSCA\/2147\/2010\t 5\/ 8\tORDER \n \n \n\n\t\n\n \n\nIN\nTHE HIGH COURT OF GUJARAT AT AHMEDABAD\n \n\n \n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 2147 of 2010\n \n\nWITH\n\n\n \n\nSPECIAL\nCIVIL APPLICATION No. 2153 of 2010\n \n\n \n===================================\n \n\nSHUBKARI\nTEXTILES THRO.BHAVNABEN D JIVANI - Petitioner\n \n\nVersus\n \n\nDAKSHIN\nGUJARAT VIJ CO LTD &amp; 1 - Respondents\n \n\n=================================== \nAppearance\n: \nMR\nRUTVIJ S OZA for Petitioner. \nMS LILU K BHAYA for Respondent No.1.\n \nMS MANISHA NARSINGHANI, AGP for Respondent No. 2.\n \n===================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.A.PUJ\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 13\/04\/2010 \nCOMMON ORAL ORDER<\/pre>\n<p>Since<br \/>\n\tcommon issue is involved in both these petitions, the same are being<br \/>\n\tdisposed of by this common order.\n<\/p>\n<p>Special<br \/>\n\tCivil Application No.2417 is filed by the petitioner under Article<br \/>\n\t226 of the Constitution of India challenging the order passed by the<br \/>\n\tElectrical Inspector and the Appellate Authority, Surat on<br \/>\n\t29.07.2009 in Appeal No.3\/2009-10 whereby the supplementary bill of<br \/>\n\tRs.1,07,972.37\/- raised by the respondent Electricity Company was<br \/>\n\treduced to Rs.20,164.65 and the respondent Company was directed to<br \/>\n\tissue revised supplementary bill which shall be directed to be paid<br \/>\n\tby the petitioner within 30 days from the date of receipt of the<br \/>\n\tsaid bill.\n<\/p>\n<p>Similarly,<br \/>\n\tin Special Civil Application No.2153 of 2010, the petitioner has<br \/>\n\tchallenged the order passed by the Electrical Inspector and the<br \/>\n\tAppellate Authority, Surat on 29.07.2009 in Appeal No.2\/2009-10<br \/>\n\twhereby the supplementary bill of Rs.1,54,866.33\/- raised by the<br \/>\n\trespondent Electricity Company was reduced to Rs.26,866.07 and the<br \/>\n\trespondent Company was directed to issue revised supplementary bill<br \/>\n\twhich shall be directed to be paid by the petitioner within 30 days<br \/>\n\tfrom the date of receipt of the said bill.\n<\/p>\n<p>In<br \/>\n\tboth the petitions, notice was issued by this Court on 25.02.2010.\n<\/p>\n<p>The<br \/>\n\tpetitioners case in both these petitions was that the Electrical<br \/>\n\tinstallation of the petitioners was checked by the Officers of the<br \/>\n\trespondent No.1 and the provisional bill was issued against the<br \/>\n\tpetitioners, inter alia,<br \/>\n\tasking that the petitioners were utilising the electricity for<br \/>\n\tlighting purpose illegally.  Accordingly, provisional bill was<br \/>\n\tissued for the aforesaid amount in case of both the petitioners.<br \/>\n\tThe petitioners filed objections against the said provisional bills<br \/>\n\tand thereafter final supplementary bills were issued.  The<br \/>\n\tpetitioners being aggrieved by the said final supplementary bills,<br \/>\n\tpreferred appeals before the Electrical Inspector.  At the time of<br \/>\n\tfiling of the appeals, the petitioners have deposited 50% of the<br \/>\n\tsupplementary bills with the respondents.  Thereafter, the appeals<br \/>\n\tcame to be decided by the Electrical Inspector and substantial<br \/>\n\trelief was granted.  Pursuant to the order of the Electrical<br \/>\n\tInspector, the petitioners are entitled to the refund and hence, in<br \/>\n\tthe present petitions, the petitioners have not only challenged the<br \/>\n\tretention of the amount by the Electrical Inspector but have also<br \/>\n\tasked for the refund to which the petitioners are entitled as a<br \/>\n\tresult of the order of the Electrical Inspector.\n<\/p>\n<p>\tMr. Rutvij S. Oza, learned advocate appearing for the<br \/>\n\tpetitioners in both the matters has submitted that the electrical<br \/>\n\tInspector has not dealt with each and every contention raised by the<br \/>\n\tpetitioners.  The Appellate Authority has not considered the fact<br \/>\n\tthat the petitioners have already paid as per the industrial rate,<br \/>\n\tbut the distribution licensees i.e. respondent No.1 is not following<br \/>\n\tthe Electricity Supply Code, more particularly, Clause 3.5 which<br \/>\n\tprovides for re-classification of consumer.  For the purpose of<br \/>\n\tsupply as mentioned in the distribution service agreement has<br \/>\n\tchanged, then distribution licensee to follow the procedure as per<br \/>\n\tthe Supply Code.  The Electrical Inspector to the extent of the<br \/>\n\trelief granted has rightly considered the relevant provisions and<br \/>\n\thence, apart from deletion of the amounts retained by him, relief<br \/>\n\tgranted by him should be given effect to and the petitioners should<br \/>\n\thave been granted refund as directed by the Electrical Inspector.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tLilu K. Bhaya, learned advocate appearing for the respondent<br \/>\n\tCompany, on the other hand, has submitted that this very issue has<br \/>\n\tcome up before this Court in Special Civil Application No.5076 of<br \/>\n\t2009 and other cognate matters wherein this Court has observed that<br \/>\n\tthe Appellate Authority, taking a generous view in the<br \/>\n\tmatter, passed an order to the effect that even for the lighting<br \/>\n\tload, respondent No.1 has already paid at the industrial rate and<br \/>\n\ttherefore, only the difference between the industrial rate and the<br \/>\n\tcommercial rate be charged. This<br \/>\n\tis nothing but giving premium to a dishonest person, who is<br \/>\n\tadmittedly unauthorisedly using power meant for industrial purpose<br \/>\n\tfor lighting purpose, which can be said to be &#8216;unauthorised usage&#8217;<br \/>\n\twhich is not permitted under the law. Once guilt is established,<br \/>\n\tthere was no reason to interfere with the quantum of punishment\/<br \/>\n\tbill.  This Court has also considered the provisions contained in<br \/>\n\tClause 7.2.3 in the Supply Code which deals with unauthorized use of<br \/>\n\telectricity and it was observed that as the power meant for<br \/>\n\tindustrial purpose is used for lighting purpose, the tariff rate<br \/>\n\tapplicable to the use of electricity for the lighting purpose will<br \/>\n\tbe applicable.   On the basis of the above judgments, Ms. Bhaya has<br \/>\n\tsubmitted that the Electrical Inspector has wrongly granted the<br \/>\n\trelief to the petitioners. Even otherwise, the said orders of the<br \/>\n\tElectrical Inspector was challenged by the Electricity Company in<br \/>\n\tSpecial Civil Application Nos.3369 and 3370 of 2010 which have<br \/>\n\talready been admitted by this Court and rule is made returnable on<br \/>\n\t16.06.2010.  In this view of the matter, she has submitted that no<br \/>\n\tdirection be issued to the respondent Company for grant of refund of<br \/>\n\tthe excess amount paid by the petitioners at the time of filing of<br \/>\n\tthe appeal.\n<\/p>\n<p>Having<br \/>\n\theard learned advocates appearing for the parties and having<br \/>\n\tconsidered the rival submissions, the Court is of the view that the<br \/>\n\tissue raised by the petitioners is squarely covered against the<br \/>\n\tpetitioners by the decision of this Court and the facts being<br \/>\n\tidentical, there is no question of taking any different view in the<br \/>\n\tmatter.  In this view of the matter, there is no question of<br \/>\n\tquashing and setting aside the order passed by the Electrical<br \/>\n\tInspector qua the amount of supplementary bills retained by the<br \/>\n\tElectrical Inspector.  As far as the relief granted by the<br \/>\n\tElectrical Inspector is concerned, as a result of which the<br \/>\n\tpetitioners are entitled to refund is concerned, since the<br \/>\n\tElectricity Company has filed petitions before this Court and are<br \/>\n\tadmitted and fixed for final hearing on 16.06.2010, there is no<br \/>\n\tquestion of granting any relief at this stage.  Even otherwise,<br \/>\n\tthose two petitions are actually taken up for final hearing today<br \/>\n\tafter preponing the same and to avoid any further complication in<br \/>\n\tthe matter, the Court has stayed the order of the Electrical<br \/>\n\tInspector to the extent of granting relief to the petitioners in the<br \/>\n\tsupplementary bills raised by the respondent Electricity Company.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, there is no question of granting any<br \/>\n\trelief at this stage.  It is always open for the petitioners to<br \/>\n\tstake their claim at the time when the petitions filed by the<br \/>\n\trespondent Company are dismissed by this Court.\n<\/p>\n<p>Both<br \/>\n\tthese petitions are accordingly dismissed.
