In the facts and circumstances of the<br \/>\ncase and by consent of both the sides, this matter is taken up for<br \/>\nhearing today.\n<\/p>\n<p>2.\tThis<br \/>\nis an application for anticipatory bail under Section 438 of the Code<br \/>\nof Criminal Procedure in connection with the FIR bearing CR No. I 198<br \/>\nof 2008 registered with Mahemdavad Police Station for the offences<br \/>\npunishable under Sections 306 and 114 of the IPC.\n<\/p>\n<p>3.\tMr<br \/>\nVM Pancholi, learned advocate for the petitioner submitted that the<br \/>\npetitioner has been falsely implicated in the commission of offence<br \/>\nand as such, no case is made out against the petitioner and<br \/>\ntherefore, prayer as set out in the petition for enlarging the<br \/>\npetitioner on anticipatory bail may be granted.\n<\/p>\n<p>4.\tMr<br \/>\nHL Jani, learned Additional Public Prosecutor representing the State,<br \/>\nwhile opposing the petition, submitted that on perusal of the FIR and<br \/>\nthe role attributed to the petitioner and the manner in which he is<br \/>\ninvolved in the commission of offence punishable under Sections 306<br \/>\nand 114 of the IPC,  the application deserves to be rejected.\n<\/p>\n<p>5.\tI<br \/>\nhave heard Mr VM Pancholi, learned advocate for the petitioner and Mr<br \/>\nHL Jani, learned Additional Public Prosecutor for the State in great<br \/>\ndetail.  I have perused the averments made in the petition and the<br \/>\nFIR at Annexure-A to the petition.  I have also considered the role<br \/>\nattributed to the petitioner and the manner in which the alleged<br \/>\noffence is committed by the petitioner.  I have also considered the<br \/>\norder passed by the learned District and Sessions Judge, Kheda in<br \/>\nCriminal Misc. Application No. 321 of 2008 and the reasons assigned<br \/>\nby the learned Judge while rejecting the application.  However,<br \/>\nconsidering the rival submissions and in the facts and circumstances<br \/>\nof the case, I am inclined to exercise the discretion in favour of<br \/>\nthe petitioner.\n<\/p>\n<p>6.\tIn<br \/>\nthe event of arrest of the petitioner in connection with CR No. I 198<br \/>\nof 2008 registered with Mahemdavad Police Station for the offences<br \/>\npunishable under Sections 306 and 114 of the IPC,  he shall be<br \/>\nreleased on bail on executing a bond of Rs.10,000\/- [Rupees ten<br \/>\nthousand only] with one surety of the like amount on the following<br \/>\nconditions that he shall:\n<\/p>\n<p>[a]\tco-operate<br \/>\nwith the investigation and make himself available for interrogation<br \/>\nwhenever and wherever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at the concerned Police Station on 11th<br \/>\nAugust 2008 between 9.00 AM to 3.00 PM.\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any person<br \/>\nacquainted with the facts of the case so as to dissuade them from<br \/>\ndisclosing such facts to the Court or to any police officer;\n<\/p>\n<p>[d]\tat<br \/>\nthe time of execution of bond, furnish his residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot<br \/>\nleave India without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot<br \/>\nobstruct or hamper the police investigation and not play mischief<br \/>\nwith the evidence collected or yet to be collected by the police;\n<\/p>\n<p>7.\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand if he considers it proper and just; and the competent Court<br \/>\nwould decide it on merits.\n<\/p>\n<p>8.\tThis<br \/>\norder will hold good, if the petitioner is arrested at any time<br \/>\nwithin 90 days from today.  The order for release on bail will remain<br \/>\noperative only for a period of ten days from the date of his arrest.<br \/>\nThereafter, it will be open to the petitioner to make a fresh<br \/>\napplication for being enlarged on bail in usual course, which, when<br \/>\nit comes up before the competent Court, will be decided in accordance<br \/>\nwith law, having regard to all the attending circumstances and the<br \/>\nmaterials available at the relevant time, without being influenced by<br \/>\nthe fact that anticipatory bail was granted.\n<\/p>\n<p>9.\tWith<br \/>\nthese directions, this petition is allowed.\n<\/p>\n<p>\tRule<br \/>\nis made absolute.
