However, in<br \/>\nreality, the name of the petitioner&#8217;s<br \/>\nson is &#8216;Kurang&#8217;, which is being mentioned in all the<br \/>\nrecords.\n<\/p>\n<p>2.2.\t\tIn<br \/>\npursuance of the same, the petitioner<br \/>\nmade a representation dated 05.10.2009 to the respondent<br \/>\nNo.2-Corporation, which ultimately came to be rejected vide order\/<br \/>\ncommunication dated 16.11.2009. Hence, this petition.\n<\/p>\n<p>3.\t\tMr.\n<\/p>\n<p>Baxi, learned<br \/>\ncounsel appearing for the petitioner,<br \/>\nhas submitted that the impugned order passed by the<br \/>\nrespondent-authority is an unjust and improper. The order passed by<br \/>\nthe respondent-authority is a non-speaking order. It is submitted<br \/>\nthat though the respondent-authority has statutory powers to correct<br \/>\nthe name of the petitioner&#8217;s<br \/>\nson as &#8216;Kurang&#8217; in his Birth Certificate, till date the grievance of<br \/>\nthe petitioner<br \/>\nhas not been redressed.\n<\/p>\n<p>3.1.\t\tThe<br \/>\nlearned counsel appearing for the petitioner<br \/>\nhas strongly relied upon the ratio of the decision rendered in the<br \/>\ncase of Nitaben Nareshbhai Patel v. State of Gujarat and<br \/>\nothers, reported in 2008(1) GLR 884, whereby<br \/>\nthis Court has held that the competent authority has powers to<br \/>\ncorrect or cancel an entry in the register of Births and Deaths.\n<\/p>\n<p>4.\t\tMr.C.B.\n<\/p>\n<p>Upadhyay, learned Assistant Government Pleader, has submitted that<br \/>\nthe order passed by the respondent-authority is just, proper and<br \/>\ncorrect. It is submitted that the petitioner filled in the form which<br \/>\nis signed by the petitioner himself. It is submitted that there is no<br \/>\ninfirmity in the order passed by the respondent-authority. In support<br \/>\nof his submissions, he has relied upon the decision of the Division<br \/>\nBench of this Court rendered in the case of Regional<br \/>\nPassport Officer v. Kokilaben, w\/o. Jaswantlal Panchal and others,<br \/>\nreported in 2009 (2) GLH 1246<br \/>\nand has submitted that the order impugned in this petition is just<br \/>\nand proper and the petitioner is not entitled to<br \/>\nany relief as prayed for in the petition and the same is required to<br \/>\nbe dismissed.\n<\/p>\n<p>5.\t\tHaving<br \/>\nconsidered the facts and circumstances of the case and<br \/>\nthe documents produced on record, it transpires that the name of the<br \/>\npetitioner&#8217;s<br \/>\nson is reflected as &#8216;Vrundar&#8217; in the Birth Certificate instead of<br \/>\n&#8216;Kurang&#8217;. The petitioner<br \/>\nhad also made a representation dated 05.10.2009 to the<br \/>\nrespondent-authority for correction of the name of his son stating<br \/>\nall the facts, including the fact that the petitioner&#8217;s<br \/>\nson was named as &#8216;Kurang&#8217; and till date it is continued. However, the<br \/>\nrespondent-authority has not appreciated the said aspect and has<br \/>\nfailed to exercise his powers conferred upon him under the provisions<br \/>\nof the Births and Deaths Registration Act, 1969. At this stage, it<br \/>\nwould be beneficial to reproduce the relevant paragraph Nos.15, 16<br \/>\nand 17 of the decision in the case of Nitaben Nareshbhai Patel<br \/>\n(supra) as under :\n<\/p>\n<p>\t 15.<br \/>\n\tIn<br \/>\nview of the above, it is clear that Section 29 of the Act of 1969<br \/>\nprotects provisions of earlier Act of 1886 and unambiguous language<br \/>\nof this section that nothing in the new Act is to be construed in<br \/>\nderogation of Act 6 of 1886 and Section 31 again makes it clear that<br \/>\nsubject to provisions of Section 29, the earlier Act shall stand<br \/>\nrepealed.  Thus, in the new Act earlier provisions with regard to<br \/>\ncorrection or cancellation of entry are very much in existence and<br \/>\nremain unaffected to the extent provided as above.\n<\/p>\n<p>\t16.\t\tTherefore,<br \/>\nSection 28 of the Births, Deaths and Marriages Registration Act,<br \/>\n1886, Section 15 of the Registration of Births and Deaths Act, 1969,<br \/>\nRule 12 of the erstwhile Registration of Birth and Deaths<br \/>\nRegistration Rules, 1973 as framed by the State Government on the<br \/>\nbasis of model Rules and Rule 11 of the Gujarat Registration of<br \/>\nBirths and Deaths Rules, 2004 now in force, along with the guidelines<br \/>\nof the Central Government and the State Government issued by the<br \/>\nRegistrar General of India and Registry of Births and Deaths, it is<br \/>\nclear that none of the above sections and rules and guidelines<br \/>\nrestrict the authority to correct any erroneous entry in form or<br \/>\nsubstance made in the register of births and deaths.  That, Act of<br \/>\n1969 clearly envisages that an Act is enacted to provide regulations<br \/>\nof births and deaths and for matters connected there with, while the<br \/>\nBirths, Deaths and Marriages Register Act, 1886 (now repealed) was<br \/>\nenacted to provide the voluntary registration of certain Births,<br \/>\nDeaths and Marriages.  Now in view of the decision of the Apex Court<br \/>\nfor compulsory registration of Births, Deaths and Marriages in the<br \/>\ncountry and  when there is clear jurisdiction vested with the<br \/>\nauthority concerned as envisaged under Section 15 coupled with Rule<br \/>\n11 of the State Rules and procedure explained<br \/>\nin the guidelines, there is no room for doubt that authority has<br \/>\npower to correct or cancel the entries in the register of Births and<br \/>\nDeaths.\n<\/p>\n<p>\t17.<br \/>\n\t\tWhen concerned authority fails to exercise the power conferred by<br \/>\nthe statute and the person has legal right under the statute, on<br \/>\ndemand denied by the authority illegally, for removing such<br \/>\nillegality, writ of mandamus can certainly be issued to such<br \/>\nauthority to act in accordance with the provisions of the statute.<br \/>\nSection 15 of the Act of 1969, read with Rule 11 of Rules of 2004<br \/>\nprovide for the detailed procedure as held by the two Division Bench<br \/>\nof this High Court, where proof to the satisfaction of the Registrar<br \/>\nthat any entry of birth and death in any register kept by him under<br \/>\nthis Act is erroneous in form or substance or has been fraudulently<br \/>\nor improperly made, he may, subject to such rules as may be made by<br \/>\nthe State Government with respect to the conditions on which and the<br \/>\ncircumstances on which such entries may be corrected or cancelled<br \/>\ncorrect the error or cancel the entry by suitable entry in the<br \/>\nmargin, without any alteration of the original entry and shall sign<br \/>\nthe marginal entry and add thereto the date of the correction or<br \/>\ncancellation.  The above procedure envisages that competent authority<br \/>\nnamely Registrar or designated authority can hold reasonable inquiry<br \/>\nto ascertain the correctness or otherwise of the entry sought for and<br \/>\nif it is proved to his satisfaction about entry being erroneous in<br \/>\nform or substance or has been fraudulently or improperly made subject<br \/>\nto the provisions of rules and regulations the powers can be<br \/>\nexercised.\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above facts and circumstances of the case as well as in<br \/>\nlight of the aforesaid decision of this Court in the case of Nitaben<br \/>\nNareshbhai Patel (supra), the decision of the Division Bench<br \/>\nin the case of Regional Passport Officer (supra) cited<br \/>\nby the learned Assistant Government Pleader, the decision of the<br \/>\nDivision Bench in the case of Regional Passport Officer<br \/>\n(supra) cited by the learned Assistant Government Pleader,<br \/>\nwill not be applicable to the facts of the present case since in the<br \/>\npresent case the petitioner had  earlier approached the competent<br \/>\nauthority vide his representation dated 05.10.2009. Therefore, I am<br \/>\nof the opinion that when the petitioner had already approached the<br \/>\nrespondent-authority by way of filing application\/ representation<br \/>\ndated 05.10.2009,  the respondent-authority ought to have exercised<br \/>\nits powers conferred upon it. However, the respondent-authority has<br \/>\nnot exercised the powers vested in it and therefore, the order<br \/>\nimpugned in the present petition is required to be quashed and set<br \/>\naside and the respondent-authority is required to be directed to<br \/>\ncorrect the name of the petitioner&#8217;s son as &#8216;Kurang&#8217; instead of<br \/>\n&#8216;Vrundar&#8217;.\n<\/p>\n<p>7.\t\tFor<br \/>\nthe foregoing reasons, the present petition succeeds and is,<br \/>\naccordingly, allowed. The impugned order\/ communication dated<br \/>\n16.11.2009 passed by the respondent No.2 is hereby quashed and set<br \/>\naside. The respondent-authority is directed to carry out amendment in<br \/>\nthe register of Births and Deaths maintained by the<br \/>\nrespondent-authority by correcting the name of the petitioner&#8217;s son<br \/>\nas &#8216;Kurang&#8217; instead of &#8216;Vrundar&#8217; within a period of four weeks from<br \/>\nthe date of receipt of writ of this Court and the petitioner&#8217;s son be<br \/>\nprovided with the amended Birth Certificate as aforesaid on his<br \/>\nmaking application in the prescribed form and on his payment of<br \/>\nnecessary fees, if any.
