The Appellant had<br \/>\nalso inquired about the jurisdiction of Home Ministry of Delhi Government to bring<br \/>\nsuch law and right to amend the existing act issued by Indian Government. The<br \/>\nAppellant wants to know about the steps taken by the government to bring the<br \/>\nculprits to face the law. Who are the authorized people to keep these license? What<br \/>\nis the total no of such armed license between the period of 1 January, 2008 to 30<br \/>\nSeptember, 2008 whose validity has been recommended by the DCP (Licensing) but<br \/>\non which the Deptt. Of Home(Delhi) is yet to decide? The Appellant has also<br \/>\nenquired whether Delhi Government has received any letter from the Home<br \/>\nMinistry to stop the illegal guidelines.\n<\/p>\n<p>The PIO replied:-\n<\/p>\n<pre> S.N Information Sought                             PIO's Reply\n o.\n 1.   Has the law been issued by the          Delhi Govt. has adopted the law because\n      Ministry of Home Affairs, Govt. of      it thought that the letter no. v-11026\/8\/89-\n      India, to validate armed license in     Arms dt. 04\/07\/1989 sent by the Ministry\n      throughout the country. What is the     of Home Affairs to enact the law of Arms\n      no of the letter sent to Delhi Govt.    License throughout the country is suitable.\n      by Ministry of Home Affairs?\n      Please provide the copy of the said\n      letter.\n 2.   Can Delhi Govt. bring any law to        Delhi Govt. is fully authorized to validate\n      extend the validity of armed            the Arms License throughout the country\n      license? If yes then please provide     because a letter no. v-11026\/8\/106\/94-\n      the copy of the said law. Can Delhi Govt. amend anything in No.<br \/>\n     the Arms Act 1962 issued by<br \/>\n     Ministry of Home Affairs, Govt. of<br \/>\n     India?\n<\/p>\n<p>4.   By which law or guidelines has the Delhi Govt. has adopted some of the<br \/>\n     Delhi Govt. been validating Armed instructions from the law issued by<br \/>\n     License from 4 July 1989 to so far    Ministry of Home Affairs, Indian Govt.<br \/>\n     throughout the country?               that gives the right to validate the Arms<br \/>\n                                           License throughout the country and<br \/>\n                                           recommends the same instruction.\n<\/p>\n<p>                                              Here it is suitable to tell that provided<br \/>\n                                           the rights by Indian Govt., the Delhi Govt.<br \/>\n                                           is free to take measures to settle these<br \/>\n                                           kind of cases.\n<\/p>\n<p>5.   The guidelines sent to the States by Yes, Delhi Govt. has apparently adopted<br \/>\n     Ministry of Home Affairs, Indian the same law ever since Indian Govt. has<br \/>\n     Govt., vide letter no v-11026\/8\/89 provided the rights to validate the arms<br \/>\n     dt. 04-07-1989 that includes license in whole country for mentioned<br \/>\n     following ranks:                      ranks vide letter dt. 04.07.1989 to the\n<\/p>\n<p>         a) Ministers of Indian Govt. states.\n<\/p>\n<p>             and        Members         of<br \/>\n             Parliaments.\n<\/p>\n<p>         b) Security Force of Indian<br \/>\n             Govt.,     Police    Service,<br \/>\n             Officer of Para Military<br \/>\n             Organizations            and<br \/>\n             Government Officers who<br \/>\n             is responsible for giving<br \/>\n             their duty in whole country.\n<\/p>\n<p>         c) Officers of Grade\/group-A<br \/>\n             and       authorized       or<br \/>\n             commissioned officers of<br \/>\n             Armed Forces.\n<\/p>\n<p>         d) Authorized Club and Rifle<br \/>\n             association for welfare of<br \/>\n             Sports.\n<\/p>\n<p>     Does Delhi Government issue the<br \/>\n     validity for armed license only for<br \/>\n     abovesaid ranks\/designation? If yes<br \/>\n     then from when has it been doing<br \/>\n     so?\n<\/p>\n<p> 6.    According to the Para 4 of letter       Yes it is true that the State Governments<br \/>\n      no.       v-11026\/8\/89-Arms       dt.   does not have the right to extend the<br \/>\n      04.07.1989, state governments do        validity of Armed License vide letter dt.<br \/>\n      not have the right to extend the        04.07.1989 by Ministry of Home Affairs,<br \/>\n      validity of Arms License. But           Indian Govt., but because of Indian Govt.<br \/>\n      under which law has Delhi Govt.         used to inspect the case under the same<br \/>\n      did so considering the guidelines of    law earlier, so after Indian Govt. provided<br \/>\n      letter no. v-11026\/8\/89-Arms dt.        the rights to the State Governments, Delhi<br \/>\n      04.07.1989. Why Delhi Govt. did not                 This is not true.
