DIRECTOR (MEDICAL EDUCATION)\n                  DEPARTMENT OF HEALTH, GOVERNMENT OF BIHAR,\n                  NEW SECRETARIAT, PATNA.     ...............RESPONDENTS.\n                                -----------\n<\/pre>\n<p>3   14.09.2010             From      the    counter       affidavit,        it<\/p>\n<p>                 appears that the claim of the petitioner has<\/p>\n<p>                 been partly allowed by the Department and now<\/p>\n<p>                 the petitioner has been promoted in the cadre<\/p>\n<p>                 of      Associate     Professor.         However,          the<\/p>\n<p>                 grievance of the petitioner now is that she<\/p>\n<p>                 should    rank    senior     to    Dr.Asha     Jha    in   the<\/p>\n<p>                 cadre     of     Associate        Professor     as,    while<\/p>\n<p>                 promoting Assistant Professor to the post of<\/p>\n<p>                 Associate        Professor        altogether     different<\/p>\n<p>                 criteria is to be adopted as is prescribed<\/p>\n<p>                 under Rule 8(ii)(Ka) of the 1997 Rules, which<br \/>\n<span class=\"hidden_text\">                     2<\/span><\/p>\n<p>lays down that at the time of promotion of<\/p>\n<p>Assistant Professor to the rank of Associate<\/p>\n<p>Professor, besides their seniority, research<\/p>\n<p>work etc. has also to be taken into account.<\/p>\n<p>          Learned       counsel      for    the    petitioner<\/p>\n<p>submits that if that would have been taken<\/p>\n<p>into account by the Department she would have<\/p>\n<p>been     promoted       to   the     rank     of   Associate<\/p>\n<p>Professor earlier by treating her senior to<\/p>\n<p>said      Dr.Asha        Jha.        He      submits        that<\/p>\n<p>specifically for this relief a representation<\/p>\n<p>has already been filed by the petitioner, a<\/p>\n<p>copy whereof is annexed as Annexure-7 to the<\/p>\n<p>writ application.\n<\/p>\n<p>          Now    that     all   the       concerned    doctors<\/p>\n<p>have been promoted to the rank of Associate<\/p>\n<p>Professor the only dispute is with regard to<\/p>\n<p>their    inter-se       seniority     upon    consideration<\/p>\n<p>their cases in terms of the said provisions<\/p>\n<p>of the Rules.\n<\/p>\n<p>          This Court is of the view that the<\/p>\n<p>Department       should      consider        the   same      and<\/p>\n<p>decide     the      inter-se         seniority        of     the<\/p>\n<p>Associate    Professors         in    the    light     of   the<\/p>\n<p>criteria for promotion laid down in the above<\/p>\n<p>provisions of the Rules.\n<\/p>\n<p><span class=\"hidden_text\">                                3<\/span><\/p>\n<p>                     There         is     nothing     in     the       counter<\/p>\n<p>          affidavit to show that this has been done by<\/p>\n<p>          the respondents so far.\n<\/p>\n<p>                     Therefore,           this    writ     application        is<\/p>\n<p>          disposed of with a direction to respondent<\/p>\n<p>          no.2,   the     Secretary,           Department        of    Health,<\/p>\n<p>          (Medical      Education,               Family     Welfare          and<\/p>\n<p>          Indigenous      Medicines)             Government      of     Bihar,<\/p>\n<p>          Patna to look into the matter and decide the<\/p>\n<p>          inter se seniority of Associate Professors in<\/p>\n<p>          accordance with law and particularly in the<\/p>\n<p>          light    of      the          said     provision        of        Rules<\/p>\n<p>          preferably within a period of three months<\/p>\n<p>          from the date of receipt\/production of a copy<\/p>\n<p>          of this order. If necessary, the respondent<\/p>\n<p>          no.2    shall    given          personal       hearing       to    the<\/p>\n<p>          concerned parties to enable them to produce<\/p>\n<p>          materials       to       show    that     on     the     basis      of<\/p>\n<p>          research work etc. they have better claim for<\/p>\n<p>          seniority than the other rival parties.<\/p>\n<pre>Arvind\/                             ( J.
