 The”competent authority had passed an order dated<\/p>\n
  i?i3.QQ.”1997 directing the petitioners to delete the word<\/p>\n
‘Society’ and in its place, to insert the word ‘Bank’ as apart<\/p>\n
of their name. However, the competent authorityJj_agaiia.pVV” 3<\/p>\n
passed order under Sub\u00ab~section {5} of Section    S<\/p>\n
directing the petitioners to delete in   <\/p>\n
insert in its place the word ‘Society’ avszalpart of <\/p>\n
In some of the cases, the competent au-*:.1.1Vo’rit’_v “also
\npassed an order under Subsection’  ._Section”  of the
\nAct amending their by-laws  }?ee1i_ng aggrieved,<\/p>\n

3. On the other hand, learned  appea\ufb01rig for the  A<\/p>\n
respondents submits that after insertionfof :98\u00a7W’eA–Qf’i’i1.i_’<\/p>\n
the Act, the petitioners were “dir–ected”‘by thei’V:’cc.111petent %<\/p>\n
authority to amend their by–laws utehns of  9vf8–W of
\nthe Act. Since, the petitioners’havey’faii~ed._toiobey the orders
\npassed under Sub–.sectior;.\u00bb{\u00a7.}._of the Act, the<\/p>\n
competent authdrityiigehas ..4t’he”‘hy4’1’aws in exercise of<\/p>\n
the power   urider Suhlisection [6] of Section 12<\/p>\n
of the Act.z7She prays of the Writ petitions.<\/p>\n
 Section 12″of—the Act provides for amendment of the<\/p>\n
of”va:_SCo’-operative society. Sub–section [5] of Section<\/p>\n
12 of the ‘states that if it appears to the Registrar that<\/p>\n
 any amendment of the bye–Iaws of a Co–operative Society is<\/p>\n
 _ nfecestsary or desirable in the interest of such society or to<\/p>\n
  effect to the provisions of the Act 01’ Rules made<\/p>\n

thereunder, the Registrar may, by order, can upon the co–<\/p>\n
operative society, to make the amendment proposed<\/p>\n
in such manner as may be prescribed and within_s11ch”  .<\/p>\n

copy thereof   e.\u00a2.Lg;ie1\u00a5\u00e91t1y\u00e9:._  along with a<\/p>\n
certificatedsignegifby   shdadiibe conclusive evidence<\/p>\n
that the argendrrientdhiasybeen\u00bb.d.uiy registered.<\/p>\n
 it is ~e.vider1t’ from the above the provisions that the<\/p>\n
‘Registrar -to..propose the amendment of the by–1aw under<\/p>\n
Sub4sectior}..'{vVE\u00a7}_ of Section 12 of the Act. in case, the Co–<\/p>\n
hi’-.,_’operative _’Scciety fails to obey the order passed under Sub-<\/p>\n
   [5) of Section 12 of the Act, the Registrar is<\/p>\n
 ’empowered to amend the by–iaw after giving the Co–operative<\/p>\n
it<\/p>\n

Society an opportunity of being heard and forward a copy<\/p>\n
thereof to the co-operative society along with a certific:’at_e~-_<\/p>\n

amendment has been duly registered.   _<\/p>\n
6. Perusal of the mate1’ia1s–~.V.on record w’ouid’v.c1earlyvb<\/p>\n
indicate that the competent authority has .riotf_:passed the
\nimpugned orders by foliou\/ing–.gti:ievV. ‘procedure prescribed
\nunder Sub–sections<(5} and 'i\ufb01lfofv Section  the Act. He<\/p>\n
has not proposed t;b;e._._am'endment as provided under Sub-<\/p>\n
section  u_At':VtVVnor has he heard the
\nrepresentatix}e– of ,–~petitioners before amending<\/p>\n
