However, learned Asst. Government Pleader appearing<br \/>\n\tin the respective petition stated that the matter may be remanded to<br \/>\n\tthe Deputy Collector as if the appeal is allowed, and Deputy<br \/>\n\tCollector shall decide the matter afresh. He only submitted that the<br \/>\n\tpetitioner may appear before the Deputy Collector within two weeks<br \/>\n\tfrom today.\n<\/p>\n<p>In<br \/>\n\tview of the above declaration made on behalf of the State<br \/>\n\tGovernment, the impugned order passed by the Deputy Collector for<br \/>\n\tassessment of the stamp duty as well as the order of Appellate<br \/>\n\tAuthority for rejection of the appeal on the ground of limitation<br \/>\n\tare quashed and set aside with the direction that the matter shall<br \/>\n\tstand restored to the Deputy Collector.\n<\/p>\n<p>The<br \/>\n\tpetitioner shall appear before the Deputy Collector within two weeks<br \/>\n\tfrom today. The Deputy Collector shall decide the matter in<br \/>\n\taccordance with law after giving opportunity of hearing to the<br \/>\n\tpetitioner and shall pass the order.\n<\/p>\n<p>It<br \/>\n\tis hardly required to be stated that until a fresh order is passed<br \/>\n\tby the Deputy Collector, there shall be no further recovery. The<br \/>\n\tamount deposited, if any, by the petitioner pending the appeal,<br \/>\n\tshall remain as the deposit and shall be subject to the final order<br \/>\n\twhich may be passed by the Deputy Collector inasmuch as if there is<br \/>\n\tno assessment of the additional stamp duty, the amount shall be<br \/>\n\trefunded to the petitioner and if there is assessment, the amount<br \/>\n\tmay be adjusted in accordance with law, without prejudice to the<br \/>\n\trights and contentions of the concerned petitioners to prefer an<br \/>\n\tappeal, as may be permissible in law.\n<\/p>\n<p>The<br \/>\n\tpetition is allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
