Justice S.SIRI JAGAN\n\n Dated :21\/08\/2008\n\n O R D E R\n                        S.SIRI JAGAN, J\n                 ==================\n                  W.P(C)No.28872 of 2004\n                 ==================\n          Dated this the 21st day of August, 2008.\n\n                        J U D G M E N T\n<\/pre>\n<p>      Certain properties belonging to the petitioner was acquired<\/p>\n<p>for the Periyar Valley Irrigation Project in the year 1950 along<\/p>\n<p>with other properties. All the properties so acquired were not<\/p>\n<p>required for the project and part of which is kept unused now. It<\/p>\n<p>so happens that the land acquired from the petitioner is part of<\/p>\n<p>those unused properties. The petitioner now seeks a direction to<\/p>\n<p>the respondents to assign that the land to the petitioner.<\/p>\n<p>      2. A counter affidavit has been filed by the state in which it<\/p>\n<p>is inter alia contended that although the land is now remaining<\/p>\n<p>unused, the same may be needed for future expansion. It is<\/p>\n<p>further contended that in any event acquired properties cannot<\/p>\n<p>be returned to the original owner, even if the same is remaining<\/p>\n<p>unused. Going by the Supreme Court decision on the subject,<\/p>\n<p>such unutilized acquired land can only be sold in public auction<\/p>\n<p>is the contention.\n<\/p>\n<p>      3. I have considered the rival contentions in detail.<\/p>\n<p>      4. There is no law which enables the petitioner to get back<\/p>\n<p><span class=\"hidden_text\">W.P(C)No.28872 of 2004          &#8211; 2 &#8211;<\/span><\/p>\n<p>the properties acquired from him even if the same is remaining<\/p>\n<p>unutilized. It is not necessary that every inch of the acquired<\/p>\n<p>land should be utilized by the Government for the purpose for<\/p>\n<p>which it is acquired. Acquisition is based only on the estimated<\/p>\n<p>requirements.    Even if there is unutilized land the same cannot<\/p>\n<p>be returned to the original owner.
