05.   31.03.2011           Respondent no.3 is the workman. He suffered an<\/p>\n
                   accident in employment of the petitioner on 1.8.1991. On<\/p>\n
                   that date the petitioner was not registered with the<\/p>\n
                   Employees    State    Insurance   Corporation    (hereinafter<\/p>\n
                   referred to as the E.S.I.C). Subsequently the petitioner has<\/p>\n
                   been registered with the E.S.I.C in 1992 with effect from<\/p>\n
                   1.1.1991 and is stated to have deposited its contributions<\/p>\n
                   for employees which is contended to include respondent<\/p>\n
                   no.3 from 1.4.1991 i.e. from a date prior to the accident<\/p>\n
                   along with penalty.\n<\/p>\n
                             The workman had moved in Case No. 26 of 2000<\/p>\n
                   under the Workmens Compensation Act. He was awarded<\/p>\n
                   compensation of Rs. 53,040\/- on 30.10.2001. It was<\/p>\n
                   questioned by the petitioner in C.W.J.C. No. 13071 of 2002<\/p>\n
                   that respondent was an “insured person” under the<\/p>\n
                   E.S.I.C. Act. The petitioner did not intend to deny benefits<\/p>\n
                   to respondent no.3, but only urged that the latter stood<\/p>\n
                   covered by the payments made by the petitioner with<\/p>\n
                   retrospective effect along with penalty etc. The proceedings<\/p>\n
                   under the Workmens Compensation Act were barred under<\/p>\n
                   Section 53 of the Employees State Insurance Act, 1948.<\/p>\n
                   This Court in the writ petition directed both the authorities
\n                   2<\/span><\/p>\n
under the Wormkens Compensation Act and the E.S.I.C<\/p>\n
Act to consider the claims of the petitioner accordingly that<\/p>\n
the stand of the petitioner that he was willing to render<\/p>\n
necessary co-operation.\n<\/p>\n
          Fresh orders have been passed on 19.10.2009 by<\/p>\n
the authorities under the Workmens Compensation Act<\/p>\n
which appears to a reiteration of their earlier stand. This<\/p>\n
order is presently assailed.\n<\/p>\n
          The petitioner then filed this writ petition on<\/p>\n
19.2.2010 after serving two copies of the writ application<\/p>\n
on the counsel for the E.S.I.C on 15.2.2010 as also the<\/p>\n
State. On 30.4.2010 this Court issued notice to respondent<\/p>\n
no.3, and the State respondents as also the E.S.I.C were<\/p>\n
directed to take instructions and file a comprehensive<\/p>\n
counter affidavit within three weeks so that the matter may<\/p>\n
be disposed at the stage of admission itself. On 3.3.2010<\/p>\n
respondent no.3, the concerned workman, alone filed a<\/p>\n
counter affidavit. The Court then directed that if separate<\/p>\n
counter affidavits were not filed on the next date on behalf<\/p>\n
of the State of Bihar and the E.S.I.C., the Court may not<\/p>\n
grant further adjournment keeping in mind the welfare of<\/p>\n
respondent no.3. It was further observed that the Court at<\/p>\n
this stage was prima facie concerned for the welfare of<\/p>\n
respondent no.3 and not whether he was entitled to relief<\/p>\n
under the Workmens Compensation Act or the Employees
\n                    3<\/span><\/p>\n
State Insurance Act as the case may be.\n<\/p>\n
          Today a counter affidavit has been filed on behalf<\/p>\n
of the State during the course of the proceedings.<\/p>\n
          Learned counsel for the E.S.I.C prays for further<\/p>\n
adjournment to file counter affidavit.\n<\/p>\n
          No justification or reason has been placed on<\/p>\n
behalf of the E.S.I.C. why despite the service of the writ<\/p>\n
application as far back as 15.2.2010, the orders of this<\/p>\n
Court dated 30.4.2010 and 3.3.2011, no counter affidavit<\/p>\n
has been filed by it. There is a right in the respondent to<\/p>\n
file a counter affidavit. The right is not absolute to the<\/p>\n
extent of the concerned respondent controlling the Court<\/p>\n
proceedings itself and stalling it. The Court is satisfied that<\/p>\n
the E.S.I.C. has by its conduct stalled the proceedings in<\/p>\n
the present writ petition denying timely justice insofar as<\/p>\n
the   respondent       no.3   is   concerned.   The   delay   in<\/p>\n
consideration of his claims for justice stands attributable<\/p>\n
exclusively to the E.S.I.C. If a counter affidavit had been<\/p>\n
filed by it today, perhaps the Court may have possibly<\/p>\n
disposed off the writ application today itself appropriately<\/p>\n
as the pleadings are otherwise complete with the sole<\/p>\n
exception of the one respondent.\n<\/p>\n
          More than one year has not been considered<\/p>\n
sufficient by the E.S.I.C. to file a counter affidavit. Learned<\/p>\n
counsel for the E.S.I.C. today submits that he shall try his
\n                          4<\/span><\/p>\n
      best endeavour that it is filed in the next one week. That is<\/p>\n
      not the concern of the Court. Further adjournment is<\/p>\n
      granted to the E.S.I.C. for filing of a counter affidavit<\/p>\n
      subject to the payment of costs of Rs.10,000\/- to<\/p>\n
      respondent no.3 as he has been the immediate victim of<\/p>\n
      the delay in filing of the counter affidavit.<\/p>\n
                In 2010 (12) SCC 70 (Satyapal Singh Versus<\/p>\n
      Union of India) the Supreme Court has observed at<\/p>\n
      paragraph-10 on the issue of costs as follows:-<\/p>\n
                          “10. ….. Once the other side is
\n                represented, the costs levied by reason of
\n                any attempt by a party to delay the
\n                proceedings, should normally be for the
\n                benefit of the other party who has suffered
\n                due to such conduct……”<\/p><\/blockquote>\n
                The     counter   affidavit   of   the   E.S.I.C.   must<\/p>\n
      specifically state that the costs have been paid to the<\/p>\n
      respondent no.3 enclosing proof of payment. The counter<\/p>\n
      affidavit must further explain the justification for stalling<\/p>\n
      the proceedings before the Court, refusing to assist the<\/p>\n
      court in dispensation of justice, denying timely justice to<\/p>\n
      respondent      no.3.   The    counter       affidavit   must   fix<\/p>\n
      responsibility on the official concerned of the Corporation<\/p>\n
      when it shall be at liberty to recover the costs from his<\/p>\n
      salary.\n<\/p>\n
                As prayed, list this matter at the same position<\/p>\n
      after one week.\n<\/p>\n
