Justice V.RAMKUMAR\n\n Dated :19\/08\/2010\n\n O R D E R\n                     V.RAMKUMAR, J.\n             ----------------------------------------\n                Crl.M.C.No.3477 of 2010\n             ----------------------------------------\n       Dated this the 19th day of August, 2010\n\n                            ORDER\n<\/pre>\n<p>     Petitioners are accused Nos.1 to 3 in Crime<\/p>\n<p>No.186\/2010 of Chelakkara Police Station, Thrissur for<\/p>\n<p>offences punishable under Sections 323, 324, 417 &amp; 498A<\/p>\n<p>I.P.C.\n<\/p>\n<p>     2.   In the light of the subsequent settlement of the<\/p>\n<p>dispute between the marital parties, the petitioners have<\/p>\n<p>approached this Court by invoking the powers under<\/p>\n<p>Section 482 Cr.P.C. Having regard to the resolution of<\/p>\n<p>the disputes between the marital parties, continuance of<\/p>\n<p>the criminal prosecution against the petitioners is an<\/p>\n<p>avoidable irritant.\n<\/p>\n<p>     3.   Eventhough the offence under Sections 323,<\/p>\n<p>324, 417 &amp; 498 A I.P.C. is not compoundable, in the light<\/p>\n<p>of the decision of the Apex Court in B.S. Joshi v. State<\/p>\n<p>of Haryana (AIR 2003 SC 1386), the powers under<\/p>\n<p>Crl.M.C.No.3477\/2010<br \/>\n<span class=\"hidden_text\">                           : 2 :<\/span><\/p>\n<p>Section 482 Cr.P.C. can be invoked by this Court to bring<\/p>\n<p>about premature termination of the prosecution.<\/p>\n<p>      Accordingly, this Criminal Miscellaneous Case is<\/p>\n<p>allowed.
