NANAVATI<\/p>\n<p>      In  this special leave petition the judgment and order<br \/>\npassed by the High Court in Spedal Civil Application No.6707<br \/>\nor  1995 is challenged.\t The petitioner had filedi the\twrit<br \/>\npetition   chllenging  the   government\t notification  dated<br \/>\n9.8.1995  and  the resolution dated 27.7.1995 passed by\t the<br \/>\nState  Legislature  reducing  the area of  &#8220;Narayan  Sarovar<br \/>\nChinKara  Sanctuary&#8221;  from 765.79 Sq.  K.M.  to 444.2.3\t Sq.<br \/>\nK.M.  The High Court dismissea that petition.\n<\/p>\n<p>      On  14.4.1981 the Government of Gujarat in exercise of<br \/>\nthe  powers  conferred\tby Section 18(1) of  the  Wild\tLife<br \/>\nProtection  Act, 1972, declared a part of the forest area in<br \/>\nLakhphat  Taluka  of  Kutch.   District\t  as  a\t &#8220;Wild\tlife<br \/>\nSanctuary&#8221;.   The total area of the sanctuary was 765.79 Sq.<br \/>\nK.M.  On<\/p>\n<p>      27.7.1993\t it  cancelled that notification and  issued<br \/>\nanother\t whereby  only a part of the said  reserved  forest:<br \/>\nwas  deciared  as the &#8220;Chinkara Wild Life  Sanctuary&#8217;,\tThe<br \/>\narea   so  declared  was  94.87\t  Sq.K.M.   The\t  said\t two<br \/>\nnotifications  were  chalirnged by the petitioner by  filing<br \/>\nwrit  petition?\t  in the Gujarat High court The\t High  Court<br \/>\nquashed\t both those notifications The result was.  that\t the<br \/>\nearlier\t  notification\t dated\t  14.4.1981   was   revived.<br \/>\nThereafter  the\t State Government made certain inquires\t and<br \/>\ndecided\t to  delimit  the area of that sanctuary as  it\t was<br \/>\nfound  to  be  more than required and the  delimitation\t was<br \/>\nlikeiy\tto be helpful in systematically developing that area<br \/>\neconomically  by making use of its mineral wealth.  It\tthen<br \/>\nmoved  the  State  Legislature for  passing  an\t appropriate<br \/>\nresolution   in\t that  behalf.\t  The\tState\tLegislature,<br \/>\nthereafter  on 27.7.1995, passed a resolution to reduce\t the<br \/>\nsanctuary  limit  to  444.23 Sq.K.M.  and make the  area  of<br \/>\n321,56\tSq.K.M.\t rich with minerals like limestone, lignite,<br \/>\nbauxite,  and  bentonite.  available for the development  of<br \/>\nthe  said backward area of Kutchh District.  The  resolution<br \/>\nwas  passed  in exercise of the powers conferred by  Section<br \/>\n26A(3)\tof  the\t Wild Life Protection Act.  Pursue  to\tthat<br \/>\nresolution  the\t Government  issued a notification  Lo\tthat<br \/>\neffect en<\/p>\n<p>      9.8.1995.\t  The  petitioner   again  chalienged  those<br \/>\nnotification by filing the writ a petition.\n<\/p>\n<p>      The  High Court, after scrutinising the resolution was<br \/>\nof  the\t view  that &#8220;the State Legislature was\tquite  aware<br \/>\nabout  the  wild  life as without in any  way  diluting\t the<br \/>\ncommitment to protect wild Life and to Improve the -habitat.<br \/>\npositive  steps are taken so neither wiidUfe is affected nor<br \/>\nthe  improvement is affected.&#8221; The High Court heid that\t for<br \/>\nabout  12QO Chinkaras the area of 444.23 Sq.K.M.  was  quite<br \/>\nsurfidsnt.   It further has that econom&#8217;c development of the<br \/>\naraa  was likely to banefit the people of Kutchh District at<br \/>\nlarge  and help in protection, preservation and\t development<br \/>\nof  flora and fauna of that area.  As regards permission  to<br \/>\nset  up the cement pisnt near that arsa and to do mining  In<br \/>\nthe  de-notified area.\tit heid that proper conditions\thave<br \/>\nbeen  imposed  for  preventing pollution and to\t meet  other<br \/>\nenvironmental  requirements.  Taking this vs^v it  dismissed<br \/>\nthe writ petition.\n<\/p>\n<p>      Initially\t an  attempt  was  made to se\u00abe\t if  st\t was<br \/>\npossible  to pass an agreed order.
