PATTANAIK (J)\n\nCITATION:\n 1996 SCALE  (6)101\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Notification   under   Section   4(1)   of\t  the\tLand<br \/>\nAcquisition, 1894  (for Short,\tthe &#8216;Act&#8217;)  was published in<br \/>\nrespect of  different parcels  of lands on February 23, 1964<br \/>\nand March  1, 1964  acquiring an extent of 6.67 acres in the<br \/>\nfirst notification and 2.75 acres in the second notification<br \/>\nfor the\t purpose of  setting up spinning mill. The lands are<br \/>\nsituated near  Nagpur Municipal\t Corporation practically now<br \/>\nwithin urban  agglomeration. The Land Acquisition Officer in<br \/>\nhis award dated October 6, 1966, determined the compensation<br \/>\n@  Rs.5,000\/-\tper  acre  in  respect\tof  some  lands\t and<br \/>\nRs.3,000\/- per\tacre in\t respect of other lands in the first<br \/>\nnotification and  Rs.2,000\/- per  acre for  the lands in the<br \/>\nsecond notification  and solatium and interest under Section<br \/>\n23(2) and Section 34 of the Act.\n<\/p>\n<p>     On reference  the civil Court by decree and award dated<br \/>\nNovember 18,  1968 enhanced  the compensation to Rs.0.40 per<br \/>\nsq.ft. On  appeal by  the State\t and cross-objection  by the<br \/>\nclaimants, the\tHigh Court  reversed the decree and award of<br \/>\nthe  reference\t Court\tand   confirmed\t the  award  of\t the<br \/>\nCollector. Thus, these appeals by special leave.<br \/>\nThough learned\tcounsel for  the appellants  stated that the<br \/>\nHigh Court  was in  error in  not relying upon the sale deed<br \/>\n(Exts. 39 and 40) to an extent of Rs.5,000\/- per sq. ft. and<br \/>\nRs. 4,000\/-  per sq.ft.\t respectively, the  High  Court\t was<br \/>\nwholly right  in its  conclusion for the reason that neither<br \/>\nthe  sale  deeds  not  the  certified  copies  thereof\twere<br \/>\nexhibited  in\tthe  Court.   In  these\t circumstances,\t the<br \/>\ndocuments are  inadmissible, though  the witnesses, AW 9 and<br \/>\n10 have been examined to speak on these transactions. In the<br \/>\nabsence of  the sale deeds, no oral evidence could be relied<br \/>\nupon. The  reference Court  had committed  manifest error of<br \/>\nlaw in relying on that evidence. But the fact that the lands<br \/>\nare very near to the city and possessed of a potential value<br \/>\nis not\tin dispute. Under these circumstances, we think that<br \/>\nthe appropriate course would be that the market value of the<br \/>\nlands in  respect of  which Rs.5,000\/-\twas awarded  by\t the<br \/>\nCollector shall be determined @ Rs. 8,000\/- per acre and the<br \/>\nlands for  which Rs.3,000\/-  was awarded,  would be valued @<br \/>\nRs. 6,000\/-  per acre.\tSimilarly, in  the  case  of  second<br \/>\nnotification,  the   market  value  would  be  determined  @<br \/>\nRs.4,000\/- per acre.\n<\/p>\n<p>     The award and decree of the reference Court is modified<br \/>\nto the\tabove extent. The claimants are entitled to solatium<br \/>\nand interest  under Section  23(2) @  15%  on  the  enhanced<br \/>\ncompensation and  interest under  Section 28  @ 6% per annum<br \/>\nfrom the  date of  taking possession till date of deposit of<br \/>\nenhanced compensation.\n<\/p>\n<p>     The appeals are accordingly allowed.
