It is submitted<br \/>\n\tthat the petitioner is original accused No.1 in the FIR. It is<br \/>\n\tfurther submitted that the country-made weapon has already been<br \/>\n\trecovered by the police. That the petitioner has no adverse<br \/>\n\tantecedent and considering the nature of the offence and the<br \/>\n\taccusation of the offence, the same is triable by the Court of<br \/>\n\tlearned Judicial Magistrate First Class. It is further submitted<br \/>\n\tthat the co-accused Mer Ram Nathabhai is released on regular bail by<br \/>\n\tthis Court. Therefore, it is submitted that this application may be<br \/>\n\tallowed.\n<\/p>\n<p>\tPer<br \/>\n\tcontra, Mr.R.C.Kodekar, learned APP representing the respondent &#8211;<br \/>\n\tState of Gujarat opposed this application and submitted that<br \/>\n\tconsidering the nature of offence, so also the nature of the firearm<br \/>\n\tseized from the petitioner himself, the petitioner is not entitled<br \/>\n\tto regular bail and, therefore, this application may be dismissed.\n<\/p>\n<p>Having<br \/>\n\tconsidered the submissions advanced on behalf of both the sides, so<br \/>\n\talso considering the nature of weapon seized from the petitioner,<br \/>\n\tand considering the fact that one of the co-accused<br \/>\n\thas already been released on bail by this Court, and considering the<br \/>\n\tfacts and circumstances of the case, the instant bail application<br \/>\n\tdeserves to be allowed.\n<\/p>\n<p>The<br \/>\n\tapplication is allowed. petitioner is ordered to be released on bail<br \/>\n\tin connection with Udhyognagar police station, Porbandar C.R.No.II &#8211;<br \/>\n\t32 of 2010 for the offences alleged against him in this application<br \/>\n\ton his executing bond of Rs.5,000\/- (Rupees  Five Thousand only)<br \/>\n\twith one surety each of the like amount to the satisfaction of the<br \/>\n\tlower Court and subject to the  conditions that he shall,<\/p>\n<p>\ta)\tnot  take  undue   advantage  of  his\tliberty or abuse his liberty;\n<\/p>\n<p>\tb) \tnot  try  to tamper  or  pressurize the\tprosecution witnesses  or  complainant  in  any  \tmanner;\n<\/p>\n<p>\tc) \tmaintain law and order and should co-operate  \tthe investigating officers;\n<\/p>\n<p>\td) \tnot  act in a manner injurious to the\tinterest of  the prosecution;\n<\/p>\n<p>\te) \tnot leave the local limits of  State  of\tGujarat without  the  prior  permission  of the\tconcerned trial Judge.\n<\/p>\n<p>\tf)\tmark presence before the concerned police\tstation once in every English calender month\tbetween 1st day to 7th day of the month, at any\ttime between 11 a.m. to 5 p.m. till the\tcommencement of trial.\n<\/p>\n<p>\tg) \tfurnish  the address of his residence  to\tthe \tI.O and also to the Court at the time of\texecution of  the bond  and  shall  not  change  \tthe  residence without prior permission of this\tCourt;\n<\/p>\n<p>\th) \tsurrender  his  Passport, if any, to the\tlower court within a week;\n<\/p>\n<p>If<br \/>\n\t  breach  of  any  of  the  above conditions is  committed, the<br \/>\n\tconcerned trial \tJudge will be\tfree  to issue warrant or  take<br \/>\n\tappropriate action in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court  having jurisdiction to try the  case.  It<br \/>\n\twould be open to the trial court concerned  to give time to furnish<br \/>\n\tthe solvency  certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute.
