The petitioners, elected members<br \/>\n\tof the Junagadh Agriculture Produce Market Committee in the<br \/>\n\tagricultural constituency have filed this petition for seeking<br \/>\n\tappropriate direction to the respondent No.2 for holding meeting as<br \/>\n\tto No Confidence Motion against the Chairman and Vice Chairman. The<br \/>\n\tapplication for the same has been given to respondent No.2 on<br \/>\n\t03.02.2011 and as no action was taken, one identical request was<br \/>\n\talso sent on 11.02.2011. As there was inaction, this petition was<br \/>\n\tpreferred. These petitioners were compelled to move the application<br \/>\n\tto call the meeting for No Confidence Motion and for getting<br \/>\n\telection held. The petitioners apprehended that the authorities were<br \/>\n\tfor reasons best known to them not inclined to hold meeting.\n<\/p>\n<p>In<br \/>\n\tlight of this facts and circumstances of the case and applications<br \/>\n\tdated 03.02.2011 and 11.02.2011 were also filed, after filing of<br \/>\n\tthis petition, the petitioners have filed individual affidavit that<br \/>\n\tthey have come to know only when the petition was being taken-up for<br \/>\n\thearing on 24.02.2011  that the attempt to settle No Confidence<br \/>\n\tMotion is made in a very dubious<br \/>\n\tmanner as somebody has made forged signature of these members and<br \/>\n\tsubmitted their resignations as if they have resigned. These facts<br \/>\n\twere therefore required to be placed on the record by support of<br \/>\n\taffidavits containing specific averments. Accordingly, these<br \/>\n\taffidavits were placed on record. The matter is listed today.\n<\/p>\n<p>Today,<br \/>\n\tlearned AGP Ms.Manisha Narsinghani on instruction of Mr.Yasui<br \/>\n\tBaloch, Deputy Director, Agricultural Marketing and Rural Finance<br \/>\n\tsubmitted that alleged resignations have been submitted on<br \/>\n\t02.02.2011 and application for No Confidence Motion is dated<br \/>\n\t03.02.2011. The file was placed for perusal of this Court.\n<\/p>\n<p>In<br \/>\n\tview of the peculiar facts and circumstances of the case, this Court<br \/>\n\tis of the opinion that respondent No.2 is required to be directed to<br \/>\n\texamine the grievances of the present petitioners, if they approach<br \/>\n\thim, by way of appropriate representation in respect of No<br \/>\n\tConfidence Motion as well as their alleged resignations. As till<br \/>\n\tdate, resignations have not been accepted, the learned AGP has<br \/>\n\tsubmitted under the instructions that the entire issue is open and<br \/>\n\trespondent No.2 has not accepted the resignations till date.\n<\/p>\n<p>In<br \/>\n\tview of this, following directions are issued, while disposing of<br \/>\n\tthe petition.\n<\/p>\n<p>(1)\tThe<br \/>\n\tpetitioners may, if they so adviced, approach respondent No.2 with<br \/>\n\tappropriate representation, praying for bringing to the notice,<br \/>\n\tentire facts and circumstances of the case by way of making<br \/>\n\tappropriate request in accordance with law.\n<\/p>\n<p>(2)\tIf<br \/>\n\tthe petitioners, so approach respondent No.2 &#8211; the Director,<br \/>\n\the shall decide and examine the prayers made in the representation<br \/>\n\tand give his decision by way of speaking order within one week<br \/>\n\tthereafter. In case if, it is held that the resignations are on<br \/>\n\tforged signatures or they are withdrawn in time, in such a<br \/>\n\tsituation, Director shall without undue delay call the meeting for<br \/>\n\tthe voting of No Confidence Motion as if the resignations are held<br \/>\n\tto be no resignation within one week thereafter. In case if,<br \/>\n\tdirector finds resignations are genuine, then also he would require<br \/>\n\tto give reasons as to why withdrawal prayer thereof may not be<br \/>\n\tconsidered.\n<\/p>\n<p>Hence,<br \/>\n\tpresent petition stands disposed of. Rule is made absolute to the<br \/>\n\taforesaid extent.
