The Applicant filed an RTI application dt.17.4.09 with the PIO, Western Railway,<br \/>\n      Mumbai seeking certified copies of justification of Tender No.DRM\/191 dt.14.11.08<br \/>\n      from Marine Lines to Virat, of improvement to staff quarters and Railway colony. In<br \/>\n      this context, he   sought information against 3 points. The PIO replied on 7.5.09<br \/>\n      furnishing point wise information. Not satisfied with the information, the    Applicant<br \/>\n      filed an appeal dt.1.6.09 with the Appellate Authority. Shri A.K.Jha, Appellate<br \/>\n      Authority replied on 11.6.09 once again enclosing the copy of the reply sent by<br \/>\n      SDE(HQ) vide letter dt.10.6.09. Being aggrieved with the reply, the Applicant filed a<br \/>\n      second appeal dt.19.6.09 before CIC.\n<\/p>\n<p>2.    The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing<br \/>\n      on February 19, 2010 through video conferencing.\n<\/p>\n<p>3.    Shri Shansingh, PIO, Shri A.K.Jha, Appellate Authority, Shri J.K.Sharma, Dy. Chief<br \/>\n      Engineer and Shri Devesh Sharma, Asst. Engineer representing the Public Authority<br \/>\n      as also the Appellant were present at NIC Studio, Mumbai for the hearinging<\/p>\n<p>Decision<\/p>\n<p>4.    The Appellant submitted that all he wants is a copy of the work order given to the<br \/>\n      contractor for carrying out the work. The Respondent submitted that when they had<br \/>\n      tried to hand over the information to the Appellant on 17.2.10 he had refused to<br \/>\n      accept it. The Appellant complained that only after receipt of the hearing notice by the<br \/>\n      PA from the Commission     on 7.2.10 did the Public Authority bother    to   call him to<br \/>\n      provide him the information and that he had refused to accept it by hand.\n<\/p>\n<p>6.    The Commission after hearing the submissions made directs the PIO to provide the<br \/>\n      information to the Appellant . Also, while holding that complete information has been<br \/>\n      provided the Commission directs the PIO to explain to the Commission why there was<br \/>\n      a delay in furnishing the work order when it was available with them and why it should<br \/>\n        not be construed that information was deliberately denied with malafide intentions..<br \/>\n       The response should reach the Commission by 20.3.10.\n<\/p>\n<p>8.
