Jai Prakash &amp; P.Chatterjee\n                                       ----\n             Date of CAV 18.3.2009       Date of pronouncement: 20.3.2009\n                                       ----\n8- 20.3.2009        This appeal by the appellant-Insurance Company is directed\n\n<\/pre>\n<p>             against the judgment and award dated 29th September, 2007<\/p>\n<p>             passed by Motor Accident Claims Tribunal, Dhanbad in Title (M.V)<\/p>\n<p>             Suit No.169\/2004, whereby he has awarded compensation of<\/p>\n<p>             Rs.2,49,500\/- and directed the appellant-Insurance Company to<\/p>\n<p>             pay the said amount.\n<\/p>\n<p>             2.     The claimants-respondents filed the aforementioned case for<\/p>\n<p>             grant of compensation on account of death of Ramnath Mahto in a<\/p>\n<p>             motor vehicle accident. According to the claimants on the relevant<\/p>\n<p>             date of accident the deceased was feeling pain in abdomen and he<\/p>\n<p>             was going for his treatment along with his brother and other<\/p>\n<p>             villagers at Bokaro Hospital by a Ambassador Car No.JH 10D 2510.<\/p>\n<p>             The said ambassador car on the way dashed against a tree<\/p>\n<p>             because of rash and negligent driving by the driver of the car, as a<\/p>\n<p>             result of which the deceased Ramnath Mahto died on the spot<\/p>\n<p>             inside the car.\n<\/p>\n<p>             3.     The defendant-respondent, who is the owner of he vehicle,<\/p>\n<p>             fled written statement stating that the car was insured with the<\/p>\n<p>             appellant-United India Insurance Company and, therefore, the<br \/>\n<span class=\"hidden_text\">                            2<\/span><\/p>\n<p>owner has no liability to pay the compensation amount rather the<\/p>\n<p>insurance company is liable to pay compensation, if awarded by the<\/p>\n<p>tribunal.\n<\/p>\n<p>4.     On the other hand, the appellant-Insurance Company<\/p>\n<p>contested the case by filing written statement stating inter alia that<\/p>\n<p>at the relevant time the ambassador car was insured as a private<\/p>\n<p>vehicle but the same was used as a commercial vehicle inasmuch<\/p>\n<p>as the deceased was traveiling in the said ambassador car on<\/p>\n<p>payment of hire. The insurance company is, therefore, not liable to<\/p>\n<p>pay compensation.\n<\/p>\n<p>5.     The Tribunal, on the basis of pleadings of the parties,<\/p>\n<p>framed the following issues:\n<\/p>\n<blockquote><p>             &#8220;1)     Is the suit, as framed, maintainable?\n<\/p><\/blockquote>\n<blockquote><p>             2)      Whether the deceased Ram Nath Mahato died<br \/>\n             due to rash and negligent driving of the vehicle in<br \/>\n             question having registration No.JH-10D-2510 on P.O.<br \/>\n             at the time of the occurrence?\n<\/p><\/blockquote>\n<blockquote><p>             3)      Whether the claimants are entitled to the<br \/>\n             compensation amount as claimed?\n<\/p><\/blockquote>\n<p>6.     The Tribunal held that the deceased died due to rash and<\/p>\n<p>negligent driving of he vehicle in question at the relevant time and<\/p>\n<p>the driver had valid and effective licence and, therefore, the<\/p>\n<p>insurance company is liable to pay compensation.<\/p>\n<p>7.     Mr. Alok Lal, learned counsel appearing for the appellant,<\/p>\n<p>assailed the impugned judgment and award as being illegal and<\/p>\n<p>wholly without jurisdiction. Learned counsel submitted that<\/p>\n<p>admitted case of the claimants was that the vehicle was taken on<\/p>\n<p>hire on payment of Rs.1000\/- from the owner of the car and the<\/p>\n<p>same has been substantiated by evidence. In spite of that the<\/p>\n<p>tribunal neither framed any issue nor recorded any finding with<\/p>\n<p>regard to liability of the insurance company . The tribunal simply<\/p>\n<p>held that since the vehicle was insured, the insurance company is<br \/>\n<span class=\"hidden_text\">                            3<\/span><\/p>\n<p>liable to pay compensation. We find force in the submission of the<\/p>\n<p>learned counsel.\n<\/p>\n<p>8.     The claimants filed documentary evidence including the FIR,<\/p>\n<p>Ext.1, which was lodged by the brother of the deceased. In the FIR<\/p>\n<p>it was very specifically mentioned that ambassador car was taken<\/p>\n<p>on hire for going to Bokaro hospital. In evidence PW 1 , widow of<\/p>\n<p>the deceased, deposed that the ambassador car was taken on hire<\/p>\n<p>on payment of Rs.1000\/-. The insurance company in para 11 of he<\/p>\n<p>written statement took a specific defence that at the relevant time<\/p>\n<p>the vehicle was used as a commercial vehicle although it was<\/p>\n<p>insured as a private car and, therefore, the insurance company has<\/p>\n<p>no liability. Surprisingly, the owner of the vehicle in his written<\/p>\n<p>statement has not denied the assertion made by the claimants as<\/p>\n<p>also the insurance company that the vehicle ws taken on hire by<\/p>\n<p>the claimants. In spite of that the tribunal has neither framed any<\/p>\n<p>issue nor recorded any finding with regard to liability of the<\/p>\n<p>insurance company. Simply the tribunal held that the deceased died<\/p>\n<p>due to rash and negligent driving of the vehicle in question and the<\/p>\n<p>driver has a valid and effective licence. So the insurance company<\/p>\n<p>is liable to   pay compensation. In our considered opinion, the<\/p>\n<p>finding arrived at by the Tribunal is absolutely erroneous in law.<\/p>\n<p>9.     As noticed above, the vehicle was taken on hire by the<\/p>\n<p>claimants for going to Bokaro hospital and on the way the vehicle<\/p>\n<p>met with an accident. Admittedly, the vehicle was insured as a<\/p>\n<p>private car and not as a commercial vehicle. Hence the insurance<\/p>\n<p>company has no liability for payment of compensation.<\/p>\n<p>10.    Hence, this appeal is allowed and the finding of the tribunal<\/p>\n<p>holding the insurance company liable to pay compensation is set<\/p>\n<p>aside. It is held that the respondent-owner of the vehicle is liable to<\/p>\n<p>pay the compensation amount assessed by the Tribunal.<br \/>\n<span class=\"hidden_text\">                                         4<\/span><\/p>\n<p>             11.   In the result, this appeal is allowed with the aforesaid<\/p>\n<p>             observation and direction and the cross objection filed by the<\/p>\n<p>             owner of the vehicle is disallowed.<\/p>\n<pre>\n\n\n\n                                                        (M.Y.
