SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/03\/2009 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>By<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioner has prayed for an appropriate writ, direction and<br \/>\n\torder quashing and setting aside the order passed by the respondent<br \/>\n\tCollector, Sabarkantha at Himatnagar dated 3.3.1993 in quashing and<br \/>\n\tsetting aside the Resolution No. 72\/1\/2 dated 17.10.1992 of Modasa<br \/>\n\tNagarpalika in regularizing the services of the petitioner and<br \/>\n\tothers, who were serving as daily wagers.\n<\/p>\n<p>Ms.\n<\/p>\n<p>\tArchna M. Patel, learned advocate for Shri Hardik Raval, learned<br \/>\n\tadvocate appearing on behalf of the petitioner has submitted that<br \/>\n\tbefore passing the impugned order by the Collector, Sabarkantha<br \/>\n\tunder Section 258 of the Gujarat Municipalities Act and canceling<br \/>\n\tthe resolution, the petitioner has not been given an opportunity of<br \/>\n\tbeing heard. Therefore, it is submitted that the impugned order<br \/>\n\tpassed by the Collector, Sabarkantha is in breach of principles of<br \/>\n\tnatural justice. Ms. Archna Patel, learned advocate for the<br \/>\n\tpetitioner has heavily relied upon the decisions of this Court in<br \/>\n\tthe case of R.C. Gajjar an Another Vs. State of Gujarat &amp;<br \/>\n\tOthers reported in 1996(1) GLH 276<br \/>\n\tand in the case of Vasantilal Ramanlal Kansara reported<br \/>\n\tin 1995(2) GLH 436.\n<\/p>\n<p>\tMs. Archna Patel, learned advocate appearing for the petitioner has<br \/>\n\talso tried to submit the case on merits, however in view of the<br \/>\n\tabove this Court proposes to remand the matter to the Collector<br \/>\n\tSabarkantha for passing impugned order after giving an opportunity<br \/>\n\tto the petitioner, this Court is not further considering the case on<br \/>\n\tmerits.\n<\/p>\n<p>\tMs.\n<\/p>\n<p>\tKrina Calla, learned AGP for the respondent No.1 is not in a<br \/>\n\tposition to dispute that before passing the impugned order<br \/>\n\tpetitioner was not heard.\n<\/p>\n<p>\tIn<br \/>\n\tview of the aforesaid factual scenario and decisions of this Court<br \/>\n\tin the case of R.C. Gajjar an Another (supra) and Vasantilal<br \/>\n\tRamanlal Kansara (supra), the impugned order passed by the<br \/>\n\tCollector, Sabarkantha in so far as petitioner only deserves to be<br \/>\n\tquashed and set aside and the matter is required to be remanded to<br \/>\n\tthe Collector, Sabarkantha for taking afresh decision in accordance<br \/>\n\twith law and on merits and after giving an opportunity to the<br \/>\n\tpetitioner.\n<\/p>\n<p>\tFor<br \/>\n\tthe reasons stated above, petition succeeds in part. The impugned<br \/>\n\torder passed by the Collector, Sabarkantha dated 3.3.1993 in<br \/>\n\tquashing and setting aside the Resolution No. 72\/1-2 dated<br \/>\n\t17.10.1992 qua the petitioner only is hereby quashed and set aside<br \/>\n\tand the matter is remanded to the Collector, Sabarkantha for taking<br \/>\n\tan appropriate decision in accordance with law and on merits after<br \/>\n\tgiving an opportunity to the petitioner. Such an exercise shall be<br \/>\n\tcompleted by the Collector, Sabarkantha within a period of three<br \/>\n\tmonths from today. Petitioner and Nagarpalika are directed to<br \/>\n\tcooperate the Collector, Sabarkantha in disposal of the Appeal on<br \/>\n\tremand within stipulated time stated herein above. It is to be noted<br \/>\n\tthat this Court has not expressed in opinion on merits and the<br \/>\n\timpugned order is satisfied only on the ground that same is in<br \/>\n\tbreach of principles of natural justice and it will be for the<br \/>\n\tCollector, Sabarkantha to pass an impugned order in accordance with<br \/>\n\tlaw and on merits. Rule is made absolute accordingly. There shall be<br \/>\n\tno order as to costs.
