CHINNAPPA (J)\nMADON, D.P.\n\nCITATION:\n 1984 AIR 1578\t\t  1985 SCR  (1) 205\n 1984 SCC  (4) 236\t  1984 SCALE  (2)61\n\n\nACT:\n     Petition for  Special Leave  and Petition for Review-If\nthe petition filed without giving the grounds of appeal they\nwill be\t dismissed as  frivolous and an abuse of the process\nof law-Order  XVI and XL of Supreme Court Rules 1966-Duty of\nadvocate to court in filing petitions.\n\n\n\nHEADNOTE:\n     An\t application   for  review   against  the  order  of\ndismissal of  the Special  Leave Petition  dated 9.12.83 was\nfilled without\tdisclosing any\tground for  review.  It\t was\naverred that the petition was being filed so as to be within\nthe limitation\tprescribed under  Order XL  of\tthe  Supreme\nCourt Rules  and that  further grounds\twould  be  filed  if\nadvised. However,  nothing was\tdone though  more  than\t six\nmonths had elapsed by the date of hearing.\n     Dismissing\t  the\t petition,   expressing\t  its\tdeep\ndissatisfaction and  anguish with  the indiscriminate manner\nin which  petitions for\t Special  Leave\t and  petitions\t for\nReview were being filed in the Supreme Court, [206A]\n^\n     HELD: The\tapplication for\t review was nothing short of\nan abuse of the process of the court, a waste of the time of\nthe Court and was entirely frivolous.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE  JURISDICTION: Review  Petition No. 249<br \/>\nof 1984.\n<\/p>\n<p>\t\t\t     In<br \/>\n     Special Leave Petition (C) No. 13618 of 1983<br \/>\n     CHAMBER MATTER-By Circulation<br \/>\n     The order of the Court was delivered by<br \/>\n     CHINNAPPA REDDY,  J. This\tapplication  for  Review  is<br \/>\nnothing<br \/>\n<span class=\"hidden_text\">206<\/span><br \/>\nshort of  an abuse of the process of the Court and  waste of<br \/>\nthe time  of this  Court, time\twhich has now become so dear<br \/>\nand precious  because of  the  daily  mounting\tarrears.  No<br \/>\nground for  seeking a  review is mentioned or even hinted at<br \/>\nin the\tpetition. In  the first paragraph of the petition it<br \/>\nis stated  &#8220;This is  an application  for Review of the order<br \/>\ndated 9.12.83,\twhereby this  Hon&#8217;ble Court  was pleased  to<br \/>\ndismiss the  above Special Leave to Appeal (Civil). The said<br \/>\norder discloses\t an error apparent on the face of the record<br \/>\nas will\t be clear  from perusal\t of the\t various grounds and<br \/>\nfacts mentioned in the petition for Special Leave to Appeal.<br \/>\nIt is  submitted that  since the  order is  unsustainable in<br \/>\nview of\t the facts  and\t circumstances\tof  the\t case,\tthis<br \/>\nHon&#8217;ble Court  may be  pleased to  review the order&#8221;. In the<br \/>\nsecond paragraph  we are  told that no detailed grounds have<br \/>\nbeen taken  (though in\tpoint of fact not a single ground is<br \/>\neven mentioned)\t as limitation is about to expire and &#8220;If so<br \/>\nadvised, further  set of  grounds would be submitted for the<br \/>\nconsideration of  the Hon&#8217;ble  Court&#8221; The petition was filed<br \/>\non 9.1.1984  and nothing  has been done though more than six<br \/>\nmonths have  passed since  then. The  offer to file detailed<br \/>\ngrounds remains\t an  unredeemed\t promise.  Possibly  he\t was<br \/>\nadvised to  file no  further grounds as there was none to be<br \/>\nsubmitted. Good\t words were not to be thrown away after bad.<br \/>\nTo that\t extent, we  may consider  ourselves spared. We must<br \/>\nhowever express\t our deep  dissatisfaction and\tanguish with<br \/>\nthe indiscriminate  manner in  which petitions\tfor  special<br \/>\nleave and  petitions for review are being filed. The present<br \/>\napplication  is\t  entirely  frivolous\tand  is\t accordingly<br \/>\ndismissed.\n<\/p>\n<pre>S.
