However, on the basis of the Medical Certificate<br \/>\nissued to the petitioner, he was declared to be unfit for the post of<br \/>\nConductor and thereafter, vide order dated 22.05.1995, his services<br \/>\ncame to be terminated. Against the said order, the petitioner raised<br \/>\na dispute, which, ultimately, culminated into a reference before the<br \/>\nLabour Court, Kalol. The Court below, after considering the evidence<br \/>\non record, partly allowed the reference by directing the respondent<br \/>\nto reinstate the petitioner on any alternative post, like Helper,<br \/>\nwith continuity of service but, without any back wages, by way of the<br \/>\nimpugned award. In this petition, the petitioner has challenged that<br \/>\npart of the award, whereby, he was not granted any back wages.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned counsel for the respective parties and perused the documents<br \/>\non record. It is established from the evidence of the petitioner<br \/>\nhimself that he was gainfully employed during the interregnum period<br \/>\nand was earning approximately Rs.1,500\/- per month. It has been<br \/>\nadmitted by the petitioner himself in his cross-examination that he<br \/>\nhad worked for the interregnum period for the survival of his family.<br \/>\nLooking to the evidence on record, I am of opinion that the Court<br \/>\nbelow was completely justified in not granting any back wages to the<br \/>\npetitioner.\n<\/p>\n<p>4.\tIt<br \/>\nwould be relevant to refer to a decision of the Apex Court in<br \/>\nthe case of Ram Ashrey Singh<br \/>\nv. Ram Bux Singh, (2003)<br \/>\nII L.L.J. Pg.176, wherein,<br \/>\nit has been held that a workman has no automatic entitlement to back<br \/>\nwages since it is discretionary and has to be dealt with in<br \/>\naccordance with the facts and circumstances of each case. Similar<br \/>\nprinciple has been laid down by the Apex Court in the case of General<br \/>\nManager, Haryana Roadways v. Rudhan Singh,<br \/>\nJ.T. 2005 (6) S.C.,pg. 137,<br \/>\n[2005 \/(5) S.C.C.,pg.591],<br \/>\nwherein, it has been held that an order for payment of back wages<br \/>\nshould not be passed in a mechanical manner but, a host of factors<br \/>\nare to be taken into consideration before passing any such order.\n<\/p>\n<p>5.<br \/>\nIn another case of A.P. State Road Transport &amp; Ors., v.<br \/>\nAbdul Kareem, (2005) 6 S.C.C. pg.36, the Apex Court has held<br \/>\nthat a workman is not entitled to any consequential relief on<br \/>\nreinstatement as a matter of course unless specifically directed by<br \/>\nforum granting reinstatement.\n<\/p>\n<p>6.\tLooking<br \/>\nto the facts of the case and the principle laid down by the Apex<br \/>\nCourt in the above decisions, I am of the opinion that the<br \/>\npetitioner-workman cannot be said to be entitled for any back wages.<br \/>\nHence, the Court below was justified in not awarding any back wages<br \/>\nto the petitioner and I do not find any reasons to interfere with the<br \/>\nimpugned award.\n<\/p>\n<p>7.\tFor<br \/>\nthe foregoing reasons, the petition is dismissed. It is, however,<br \/>\nclarified that the petitioner shall be given effect of the impugned<br \/>\naward from the date of publication of the same till the date of<br \/>\nactual reinstatement in service, within a period of six months from<br \/>\ntoday. It is observed that if the petitioner does not resume the<br \/>\nduties, in spite of the orders of the respondent-Corporation, the<br \/>\nrespondent-Corporation shall be at liberty to pass appropriate orders<br \/>\nin accordance with law. With the above observation, the petition<br \/>\nstands disposed of. Rule is discharged.\n<\/p>\n<p>[K.\n<\/p>\n<p>S.
