{"id":114052,"date":"2010-08-12T00:00:00","date_gmt":"2010-08-11T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/deepak-kumar-vs-abhaychand-jain-on-12-august-2010"},"modified":"2018-01-19T23:14:30","modified_gmt":"2018-01-19T17:44:30","slug":"deepak-kumar-vs-abhaychand-jain-on-12-august-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/deepak-kumar-vs-abhaychand-jain-on-12-august-2010","title":{"rendered":"Deepak Kumar vs Abhaychand Jain on 12 August, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Madhya Pradesh High Court<\/div>\n<div class=\"doc_title\">Deepak Kumar vs Abhaychand Jain on 12 August, 2010<\/div>\n<pre>                      W.P.No.7512\/2010\n\n  Deepak Kumar &amp; another                 Abhaychand Jain &amp; others\n\n\n\n\n12.8.2010\n      Shri O.P.Dwivedi, counsel for petitioners.\n      Shri Anil Dwivedi, counsel for respondent no.1.<\/pre>\n<p>      This petition is directed against an order dated 15.4.2010 by<br \/>\nthe Civil Judge Class-I Beohari, District Shahdol in civil suit no.20-<br \/>\nA\/2009, by which an application filed by the petitioners to summon<br \/>\ntwo witnesses namely Jaikumar Jain and Ram Prasad Tiwari was<br \/>\ndeclined.\n<\/p>\n<p>      Learned counsel for petitioners submitted that petitioners want<br \/>\nto examine his predecessor in title Jaikumar Jain and one Ram Prasad<br \/>\nTiwari, who has purchased the suit property from respondent no.1.<br \/>\nThese witnesses refused to accompany the defendants to appear in<br \/>\nthe Court, but stated that in case of receipt of summons from the<br \/>\nCourt they shall appear before the Court for their evidence. Stating<br \/>\naforesaid it was submitted by the petitioners that except for issuance<br \/>\nof summons the petitioners were having no other alternative, but the<br \/>\ntrial Court rejected the application only on the ground that no list of<br \/>\nwitnesses was filed by the petitioners, so summon cannot be issued.<br \/>\nLearned counsel for petitioners submitted that the aforesaid two<br \/>\nwitnesses are necessary to be examined for the just decision of the<br \/>\ncase. Shri Anil Dwivedi, learned counsel for respondent no.1<br \/>\nsubmitted that the examination of witness Ram Prasad Tiwari is<br \/>\ntotally irrelevant as he is not a material witness.     To this learned<br \/>\ncounsel for petitioners submitted that Ram Prasad Tiwari is the<br \/>\npurchaser of suit property from plaintiff, so his statement is<br \/>\nnecessary.\n<\/p>\n<p>      Order 16 Rule 1 C.P.C., provides that the Court may, for<br \/>\nreasons to be recorded, permit a party to call, whether by<br \/>\nsummoning through Court or otherwise, any witness, other than<br \/>\nthose whose names appear in the list referred to in sub-rule (1), if<br \/>\nsuch party shows sufficient cause for the omission to mention the<br \/>\n                          W.P.No.7512\/2010<\/p>\n<p>     Deepak Kumar &amp; another                 Abhaychand Jain &amp; others<\/p>\n<p>name of such witness in the list.\n<\/p>\n<p>        The aforesaid provision specifically provides wide powers to<br \/>\nthe Court to summon any witness whose name was not appearing in<br \/>\nthe witness list submitted by the party under Rule 1 of Order 16<br \/>\nC.P.C. Merely because no list was filed by the petitioners and if an<br \/>\napplication for issuance of summon was filed stating the reasons, the<br \/>\ntrial Court ought to have considered the aforesaid application on<br \/>\nmerits. Though the petitioners ought to have filed a list of witnesses<br \/>\nin the case, as required under Order 16 Rule 1 C.P.C., but when the<br \/>\nnames of these witnesses were disclosed in the application, the trial<br \/>\nCourt ought to have issued summons to these witnesses. Apart from<br \/>\nthis Jaikumar Jain is the predecessor in title and Ram Prasad Tiwari is<br \/>\nthe person who is purchaser of the disputed property from the<br \/>\nplaintiff, so their statements appear to be just for the decision of this<br \/>\ncase.\n<\/p>\n<p>        In view of aforesaid, this petition is allowed.
