(J)\n\nCITATION:\n JT 1995 (8)   108\t  1995 SCALE  (6)302\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This  appeal   by\tspecial\t leave\tarises\tagainst\t the<br \/>\njudgment and decree dated August 4, 1981 of the Gauhati High<br \/>\nCourt at  Guwahati made\t in S.A.  No. 17\/76. The appellants-<br \/>\nplaintiffs filed  the suit for declaration of title that the<br \/>\nlands in Chaibari Village which were part of Machpara Estate<br \/>\nwere given  to\tDayamoyee  Devi,  daughter  of\tRai  Bahadur<br \/>\nPrithiram Chowdhury,  the holder of the said estate as dowry<br \/>\nat the\ttime of her marriage and that she and thereafter her<br \/>\nsuccessors including  the plaintiffs  had been in possession<br \/>\nand enjoyment  of the  lands in\t their own  right. The lands<br \/>\ntherein did not stand vested in the State of Assam under the<br \/>\nAssam State  Acquisition of  the Zamindaries  Act, 1951. The<br \/>\ntrial court  decreed the  suit. But  on appeal, the District<br \/>\nJudge reversed\tthe decree  and held that the appellants had<br \/>\nfailed to  prove that  the appellants possessed the lands in<br \/>\ntheir own  right and  that it  was not\tvested in the State.<br \/>\nAccordingly, the suit was dismissed. In second appeal, while<br \/>\nupholding the  findings of  the appellate Court, the learned<br \/>\nSingle Judge of the High Court held that if the compensation<br \/>\nfor the lands comprised in Chaibari Village were not paid, a<br \/>\nconditional decree was passed directing the State to pay the<br \/>\ncompensation in respect thereof to the appellants. Thus this<br \/>\nappeal by special leave.\n<\/p>\n<p>     Shri S.K.\tNandy, learned\tcounsel for  the appellants,<br \/>\nhas contended  that since  the lands  had passed on from the<br \/>\nZamindar to  his daughter  as dowry, she became the absolute<br \/>\nowner of  the property.\t The State  had not proved that they<br \/>\nhad acquired  the land\tunder the  Act and that compensation<br \/>\nwas paid  to them.  Thereby the\t lands did  not vest  in the<br \/>\nState. The  High Court,\t therefore, was not right in holding<br \/>\nthat the title of the land in favour of the appellants stood<br \/>\nextinguished  under  the  Act.\tWe  find  no  force  in\t the<br \/>\ncontention.\n<\/p>\n<p>     The High  Court has  gone into  the question of adverse<br \/>\npossession pleaded  by the  appellants\tand  held  that\t the<br \/>\nadverse possession is an encumbrance under the State Revenue<br \/>\nAct and\t it does  not bind  the State. Therefore, as against<br \/>\nthe State,  the appellant  had not  perfected her  title  by<br \/>\nadverse\t possession.   It  was\talso  held  that  since\t the<br \/>\nappellants had\tasserted title to the property, burden is on<br \/>\nthe appellants\tto establish  that they\t had  title  to\t the<br \/>\nplaint schedule\t lands and  continued to have title thereto.<br \/>\nSince they  failed to  establish the  title, the  appellants<br \/>\ncannot be  held to  be the  owners of  the land.  High Court<br \/>\ncalled upon the Government to produce certain notifications.<br \/>\nSince they  were not  produced, the High Court had expressed<br \/>\nits  displeasure  for  the  lethargy  on  the  part  of\t the<br \/>\nofficials of the Government but that was not conclusive. The<br \/>\nultimate finding is that the appellants had not proved their<br \/>\ntitle to  the lands  and they  did  not\t form  part  of\t the<br \/>\nacquisition under  the Act. They did not remain as owners of<br \/>\nthe lands  and the  lands stood\t vested in  the State. These<br \/>\nconclusions reached  by the  High Court\t are not vitiated by<br \/>\nany manifest error of law warranting interference.\n<\/p>\n<p>     However, the High Court had granted conditional decree,<br \/>\nnamely, the  payment of\t the compensation,  if\tnot  already<br \/>\npaid. It  is, therefore,  for  the  appellants\tto  make  an<br \/>\napplication to the appropriate authority seeking payment, if<br \/>\nnot already  received, and  the\t competent  authority  would<br \/>\nconsider and  dispose of the matter within three months from<br \/>\nthe  date   of\tmaking\t the  application   for\t payment  of<br \/>\ncompensation, if not already paid.
