The proceedings<br \/>\n\twere initiated by the District Collector against the petitioners on<br \/>\n\tthe ground that they have committed breach of the conditions of the<br \/>\n\tallotment of not to use the residential premises for any other<br \/>\n\tpurpose, but in spite of the same, as the petitioners were allegedly<br \/>\n\tusing the premises for poultry farm together with the residence, the<br \/>\n\tpetitioners were called upon to show cause as to why the land should<br \/>\n\tnot be forfeited.  The petitioners submitted reply and contended,<br \/>\n\tinter alia, that the aforesaid activity is with a view to maintain<br \/>\n\tthe family and in one room the petitioners are already residing.  It<br \/>\n\thas also been stated that it is a house-hold activity and,<br \/>\n\ttherefore, the matter may be sympathetically considered and the land<br \/>\n\tmay not be forfeited and the action may be regularised, if<br \/>\n\tultimately it is found that there is a breach.\n<\/p>\n<p>The<br \/>\n\tDistrict Collector thereafter passed the order on 21.3.1995, whereby<br \/>\n\tthe fine of 40 times revenue was imposed for breach of the condition<br \/>\n\tand the petitioners were directed to stop the activity of poultry<br \/>\n\tfarm in the residential house and if there is failure on the part of<br \/>\n\tthe petitioners to close down such activity, the order was passed<br \/>\n\tfor forfeiting the land.  The petitioners carried the matter in<br \/>\n\trevision before the State Government and the State Government as per<br \/>\n\tthe order dated 28th September, 1995 observed that as the<br \/>\n\tuse of house for poultry farm was admitted, the breach was proved<br \/>\n\tand, therefore, the order of the Collector did not deserve to be<br \/>\n\tinterferred with and hence the revision was dismissed as per the<br \/>\n\torder dated 28th September, 1995.  It is under these<br \/>\n\tcircumstances, the present petition.\n<\/p>\n<p>Heard<br \/>\n\tMr.Sevak for Mr.Bhatt, leaned Counsel for the petitioners and<br \/>\n\tMr.Soni, learned AGP for the State authorities.\n<\/p>\n<p>Upon<br \/>\n\thearing the learned Counsel for both the sides, it appears that when<br \/>\n\tthe lands were allotted to the petitioners by the order dated<br \/>\n\t5.8.1988, the Condition No.3 did provide for using the land for<br \/>\n\tresidential purpose and no other use was permissible without prior<br \/>\n\tpermission.  However, there are Government Resolutions issued for<br \/>\n\ttreating the use of the land for permitting the use of the land for<br \/>\n\tpoultry farm and such breach is not to be treated as a serious<br \/>\n\tbreach warranting the forfeiture of the land.  Further, from the<br \/>\n\trecord, it appears that the petitioners were also simultaneously<br \/>\n\tusing the premises for their residential purpose and in the other<br \/>\n\tportion namely; in one room, the same was used for poultry farm.<br \/>\n\tWhether it is a commercial activity together or is for maintenance<br \/>\n\tof the family of the petitioners is an aspect not properly<br \/>\n\tconsidered by the District Collector.  It does appears from the<br \/>\n\trecord that it was also for maintenance of the family of the<br \/>\n\tpetitioners.  Hence, Collector could not have imposed fine of 40<br \/>\n\ttimes revenue.\n<\/p>\n<p>Mr.Soni,,<br \/>\n\tlearned AGP during the course of hearing relied upon the order<br \/>\n\tpassed by the Special Additional Magistrate, Morbi dated 23.1.1995<br \/>\n\tunder Section 133(1) of Cr. P.C. Prohibiting the use of the land for<br \/>\n\tpoultry farm on th alleged ground of nuisance and he submitted that<br \/>\n\tsuch activity was resulting into nuisance and, therefore, the<br \/>\n\tCollector had to exercise the power.\n<\/p>\n<p>Mr.Sevak,<br \/>\n\tlearned Counsel for the petitioners submitted that if the order of<br \/>\n\tthe State Government is considered, in the said order, there is no<br \/>\n\treference to the order passed by the Sub-Divisional Magistrate dated<br \/>\n\t23.01.1995 under CRPC prohibiting the nuisance.\n<\/p>\n<p>It<br \/>\n\tappears that, if there is a direction issued to discontinue the use<br \/>\n\tof the premises for poultry farm on the ground of nuisance, the same<br \/>\n\tis binding to the petitioners and Mr.Sevak, learned counsel<br \/>\n\tappearing for the petitioners is not in a position to state as to<br \/>\n\twhether the petitioners have successfully carried the matter before<br \/>\n\tthe higher forum against the order passed by the Sub-Divisional<br \/>\n\tMagistrate under CRPC or such order is stayed by higher forum.<br \/>\n\tTherefore, as such, the nuisance has got to be stopped by the<br \/>\n\tpetitioner, if the order of the Sub-Divisional Magistrate is to<br \/>\n\toperate.\n<\/p>\n<p>As<br \/>\n\tregards the order of the Collector and it s confirmation thereof by<br \/>\n\tthe State Government is concerned, it was required for the Collector<br \/>\n\tto examine the aspects of running poultry farm can be said as<br \/>\n\tpermissible activity in view of the Government policy or not in a<br \/>\n\tresidential house, where a part of it is used for residential<br \/>\n\tpurpose.  In any case under such circumstances, the Collector had to<br \/>\n\texercise proper discretion.  The perusal of the order passed by the<br \/>\n\tlower authority shows that since the activity was with simultaneous<br \/>\n\tresidential use and for maintenance of the family, on the aspects of<br \/>\n\tfine, the matter could be leniently viewed.  However, as the use in<br \/>\n\tany case is held as nuisance by the competent authority under<br \/>\n\tCr.P.C., such activity was required to be stopped and only upon<br \/>\n\tfailure to comply the order against nuisance, the forfeiture could<br \/>\n\tbe ordered.\n<\/p>\n<p>It<br \/>\n\tappears that, the petitioners have already given opportunity to stop<br \/>\n\tthe activity of poultry farm and the order of forfeiture is only a<br \/>\n\tconsequential upon the non-compliance of such directions of the<br \/>\n\tDistrict Collector.\n<\/p>\n<p>Under<br \/>\n\tthe above circumstances, the order passed by the Collector and its<br \/>\n\tconfirmation by the State Government deserves to be modified to some<br \/>\n\textent in view of the observations made hereinabove.\n<\/p>\n<p>Hence,<br \/>\n\tthe following directions:\n<\/p>\n<p>The<br \/>\n\torder of the Collector and its confirmation thereof by the State<br \/>\n\tGovernment so far as they relate to imposition of fine is quashed<br \/>\n\tand set aside but the closure of the activity of poultry farm is not<br \/>\n\tdisturbed and shall continue to remain in operation, but with<br \/>\n\tmodification that the order so far as it relates to forfeiture of<br \/>\n\tland is concerned, the same shall not operate in the event the<br \/>\n\tpetitioner, if not has discontinued the activity of poultry farm,<br \/>\n\tdiscontinues such activity within a period of three months from<br \/>\n\ttoday.  Upon the failure to comply with the earlier direction, the<br \/>\n\tDistrict Collector shall be at the liberty to take action in<br \/>\n\taccordance with law.\n<\/p>\n<p>Petitions<br \/>\n\tare partly allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
