While he was<br \/>\ndischarging his duty on 18th January, 1996, the appellant<br \/>\nmet with an accident and sustained severe injuries, where the phalanx<br \/>\nof his left hand was cut. The appellant, therefore, preferred an<br \/>\napplication before learned Ex-Officio Commissioner for Workmen&#8217;s<br \/>\nCompensation and Labour Judge,  Labour Court, Jamnagar in Workmen&#8217;s<br \/>\nCompensation (Non-Fatal) Case No. 28 of 1997,  for grant of<br \/>\ncompensation on the ground of permanent disability sustained by him<br \/>\nwhile discharging his duty.\n<\/p>\n<p>2.2.\t\tThe<br \/>\nlearned trial Judge, after hearing the parties and after considering<br \/>\nthe evidence on record, partly allowed the application and granted<br \/>\nRs.11,200\/- by way compensation with running interest @ 12% from the<br \/>\ndate of accident till realization.\n<\/p>\n<p>2.3.\t\tBeing<br \/>\naggrieved and dissatisfied with the impugned award, the appellant has<br \/>\napproached this Court by way of this appeal.\n<\/p>\n<p>3.0.\t\tHeard<br \/>\nlearned counsel for the respective parties. It is an admitted<br \/>\nposition that the workman was earning Rs.2,600\/- p.m. towards salary.<br \/>\n In absence of any evidence on record, the Court below has assessed<br \/>\nthe age of the workman at the relevant time at 20 years on the basis<br \/>\nof the medical certificate at Exh. 31. In my opinion, the said<br \/>\nassessment arrived at by the Court below is just and reasonable.\n<\/p>\n<p>3.1.\t\tIn<br \/>\nthe impugned award, the Court below has recorded finding that the<br \/>\nworkman had totally lost the phalanx of his left hand, but assessed<br \/>\nthe percentage of loss of earning capacity @ 5%, as no evidence was<br \/>\nled by the appellant towards the same. However, the said conclusion<br \/>\nreached by the Court below is erroneous. In view of that, the Act<br \/>\nprovides the percentage of loss of earning capacity @ 9% in such<br \/>\ncases.\n<\/p>\n<p>3.2.\t\tSince<br \/>\nworkman was aged 20 years at the relevant time, the factor of 224<br \/>\nwould be applicable as per the provisions of the Act. Therefore, the<br \/>\nworkman shall be entitled for compensation of Rs.1,000\/- towards loss<br \/>\nof earning capacity being 50% of Rs.2,000\/-. The relevant factor is<br \/>\n224 and, therefore, the amount comes to Rs.2,24,000 [224 x 1000].<br \/>\nTherefore, the total loss of earning capacity would come to<br \/>\nRs.20,160\/- [i.e. 9% of Rs.2,24,000\/-].\n<\/p>\n<p>4.0.\t\tIn<br \/>\nthe result, the appeal is partly allowed. The impugned award of the<br \/>\nCourt below is modified to the extent that the workman shall be<br \/>\nentitled for an additional amount of Rs. 8,960\/- with running<br \/>\ninterest @ 12% from the date of application till realization. The<br \/>\nInsurance Company shall pay additional amount of Rs.8,960\/- to the<br \/>\nworkman, within three months from the date of receipt of this order<br \/>\nand the interest amount shall be paid by the original owners, within<br \/>\nthree months thereafter.
