Justice V.GIRI\n\n Dated :08\/07\/2008\n\n O R D E R\n                       V.GIRI, J.\n        -------------------------\n           W.P.(C).No.16917 of 2008 L\n        -------------------------\n           Dated this the 8th day of July, 2008.\n\n\n                     JUDGMENT\n<\/pre>\n<p>       The petitioner is included in Ext.P1 rank<\/p>\n<p>list for the post of Anganvady Worker in the<\/p>\n<p>Neeleswaram ICDS Project.      She has approached this<\/p>\n<p>court seeking a direction to the respondents to<\/p>\n<p>fill up the 5 vacancies (as stated in Ext.P4) by<\/p>\n<p>appointing candidates from Ext.P1 rank list.<\/p>\n<p>       2.   By    Ext.P3      Government       Order,  the<\/p>\n<p>Government   had    sanctioned        the     opening   of<\/p>\n<p>additional  3614    Anganvady       Centres.     Going  by<\/p>\n<p>Ext.P4, which is seen to be an information given<\/p>\n<p>on the requirement of additional Anganvady Centres<\/p>\n<p>under the 3rd phase Expansion of ICDS Scheme,<\/p>\n<p>there is a request for sanctioning 5 Anganvady<\/p>\n<p>Centres at Padanna and one in Valiaparamba Grama<\/p>\n<p>Panchayat in Kasargode District.<\/p>\n<p>       3.  In   the    statement filed         by  the  4th<\/p>\n<p>respondent, it is admitted that the proposal for<\/p>\n<p>opening of 5 Anganvady Centres in phase III, based<\/p>\n<p>on population, had been submitted.            Paragraphs 7<\/p>\n<p>and 8 of the statement read as follows:<\/p>\n<p>        &#8220;7.  Proposal     for    sanctioning     of  5<\/p>\n<p>    additional Anganvadi Centres on Phase III<\/p>\n<p>W.P.(C).NO.16917\/08<\/p>\n<p>                        :: 2 ::\n<\/p>\n<p>\n    based  on population    (i.e. One Anganvadi<\/p>\n<p>    Centre  for   800  population)   have  been<\/p>\n<p>    submitted.   5 Anganwadi Centres based on<\/p>\n<p>    population has been requested and not as<\/p>\n<p>    vacancies.   The proposal for sanctioning<\/p>\n<p>    additional Anganwadi is under consideration<\/p>\n<p>    of the Government.\n<\/p>\n<p>        8. Hence, it is submitted that if more<\/p>\n<p>    Anganwadi   Centres    sanctioned  by   the<\/p>\n<p>    Government the petitioner will be benefited<\/p>\n<p>    if the Rank list is valid at that time.<\/p>\n<p>    Hence the Writ Petition is devoid of merit<\/p>\n<p>    and it may be dismissed.&#8221;\n<\/p>\n<p>       4. Going by the requirement made in<\/p>\n<p>Ext.P3, it is necessary that the Government<\/p>\n<p>takes  a   decision,     on     the  proposal  for<\/p>\n<p>sanctioning 5 additional Anganwadi Centres, as<\/p>\n<p>requested for in Ext.P4. A decision may be taken<\/p>\n<p>without further delay.\n<\/p>\n<p>       In the result, the writ petition is<\/p>\n<p>disposed of directing the 1st respondent to take<\/p>\n<p>a decision in the matter of opening 5 additional<\/p>\n<p>Anganvady Centres in the ICDS Project in Padanna<\/p>\n<p>Panchayat, coming under the Neeleswaram ICDS<\/p>\n<p>Project, within a period of three months from<\/p>\n<p>the date of receipt of a copy of this judgment.<\/p>\n<p>If  the   Government     accepts    the   proposal,<\/p>\n<p>obviously, it will be followed by sanctioning of<\/p>\n<p>W.P.(C).NO.16917\/08<\/p>\n<p>                      :: 3 ::\n<\/p>\n<p>\nadditional  posts   of   Anganvady Workers  and<\/p>\n<p>Helpers.
