Malik, Advocate, for respondent No.1.\n<\/p>\n<p>Rakesh Kumar Garg, J. (Oral):\n<\/p>\n<p>             This revision petition has been filed on behalf of the insurance<br \/>\ncompany challenging its liability to pay compensation on the ground that<br \/>\nthe driving licence of the driver-cum-owner of the offending vehicle was<br \/>\nnot valid on the date of accident.\n<\/p>\n<p>             However, from the perusal of the grounds of revision and the<br \/>\nimpugned award, I find that in the present case only a sum of Rs.5,050\/- has<br \/>\nbeen awarded to the respondent-claimant for the injuries caused to the<br \/>\n&#8216;khachar&#8217; and the damage caused to his rehri in the accident.\n<\/p>\n<p>             Keeping in view the meagre amount involved in the present<br \/>\npetition, learned counsel appearing on behalf of the petitioner-company was<br \/>\nasked to justify the filing of this petition. According to learned counsel<br \/>\nappearing on behalf of the petitioner, since the offending vehicle is common<br \/>\nin other case i.e., FAO No.2912 of 2007, it was imperative upon the<br \/>\npetitioner to challenge the aforesaid finding regarding accident in question<br \/>\nin this petition also.\n<\/p>\n<p>             Learned counsel appearing on behalf of the respondent-<br \/>\nclaimant, however, stated that he has no objection if the present revision<br \/>\npetition is dismissed without prejudice to the rights of the petitioner to<br \/>\nchallenge the aforesaid findings in FAO No.2912 of 2007.\n<\/p>\n<p>             After hearing learned counsel for the parties and keeping in<br \/>\nview the meagre amount of compensation awarded, this revision petition is<br \/>\ndismissed, however, without prejudice to the rights of the insurance<br \/>\ncompany to challenge the findings on the question of driving licence of the<br \/>\ndriver of the offending vehicle in FAO No.2912 of 2007 and other<br \/>\nconnected matters.\n<\/p>\n<p>            It is made clear that dismissal of this petition will not operate<br \/>\nagainst the petitioner to challenge the findings of the Tribunal in FAO<br \/>\nNo.2912 of 2007 and other connected matters, if any, which shall be<br \/>\ndecided on its own merit.<\/p>\n<pre>\n\n\n\nNovember 26, 2009.
