Justice R.BASANT\n\n Dated :19\/06\/2007\n\n O R D E R\n                                   R.BASANT, J\n\n                         ------------------------------------\n\n                             B.A.No.3692 of 2007\n\n                         -------------------------------------\n\n                     Dated this the 19th day of June, 2007\n\n\n                                      ORDER\n<\/pre>\n<p>       Application   for   anticipatory   bail.     Petitioner   faces   allegations<\/p>\n<p>under Section 308 I.P.C (and strangely not 307 I.P.C).  The crux of the<\/p>\n<p>allegations  is  that   with  the  intention  of   causing   death   of  the  defacto<\/p>\n<p>complainant, the petitioner fired a shot from his pistol at the defacto<\/p>\n<p>complainant.     The   defacto   complainant   suffered   gun   shot   injury.<\/p>\n<p>Investigation   is   in   progress.     The   petitioner   apprehends   imminent<\/p>\n<p>arrest.\n<\/p>\n<\/p>\n<p>       2.      The   learned   counsel   for   the   petitioner   submits   that   the<\/p>\n<p>allegations   are   totally   false.     There   is   bitter   animosity   between   the<\/p>\n<p>complainant   and   the   accused   and   the   complainant   has   invented<\/p>\n<p>fanciful   allegations   to   falsely   implicate   the   petitioner.     In   the   F.I<\/p>\n<p>statement, there is no specific allegation even of a pistol being used to<\/p>\n<p>commit the offence.  In these circumstances, directions under Section<\/p>\n<p>438   Cr.P.C   may   be   issued,   prays   the   learned   counsel   for   the<\/p>\n<p>petitioner.\n<\/p>\n<\/p>\n<p>       3.      The   learned   Public   Prosecutor     opposes   the   application.<\/p>\n<p>The   learned   Public   Prosecutor     submits   that   the   allegations   are<\/p>\n<p>serious.   The case diary  reveals satisfactory materials to support the<\/p>\n<p>allegations  raised.     Though   in   the  F.I   statement,   there  is   no  specific<\/p>\n<p><span class=\"hidden_text\">B.A.No.3692 of 2007                          2<\/span><\/p>\n<p>reference   to   a   fire   arm,   a   total   reading   of   the   F.I   statement   must<\/p>\n<p>convey   that   a   fire   arm   was   used   for   the   commission   of   the   offence.<\/p>\n<p>Custodial   interrogation   is   essential.     Recovery   of   the   weapon   is<\/p>\n<p>absolutely   necessary.     In   these   circumstances,   the   petitioner   is   not<\/p>\n<p>entitled   to   any   direction   under   Section   438   Cr.P.C,   submits   the<\/p>\n<p>learned Public Prosecutor .\n<\/p>\n<\/p>\n<p>         4.    I   find   merit   in   the   opposition   by   the   learned   Public<\/p>\n<p>Prosecutor.     I   shall   scrupulously   avoid   any   detailed   discussion   or<\/p>\n<p>expression   of   opinion   on   the   acceptability   of   the   allegations   and   the<\/p>\n<p>credibility   of   the   data   collected.     Suffice   it   to   say   that   I   am   not<\/p>\n<p>persuaded at all to hold that this is a fit case where directions under<\/p>\n<p>Section   438   Cr.P.C   can   or   ought   to   be   issued.     The   petitioner   must<\/p>\n<p>follow  the  ordinary   and  normal  procedure  of  appearing\/surrendering<\/p>\n<p>before the Investigating  Officer or the learned Magistrate.    He  must<\/p>\n<p>then seek bail in the ordinary course.\n<\/p>\n<\/p>\n<p>         5.
