DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 04\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 438 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-24 of 2011 with Adalaj Police Station, Gandhinagar, for the<br \/>\noffences punishable under Sections 465, 467, 468, 471, 120B and 114<br \/>\nof the Indian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\nsenior counsel appearing for the applicant submits that the complaint<br \/>\nis filed by Shri Umesh Hargovandas Patel, who is in no manner<br \/>\nconnected with subject matter of the complaint but happens to be<br \/>\nEx-President of Taluka Panchayat and with a view to take undue<br \/>\nadvantage the applicant is falsely implicated. It is submitted that<br \/>\nthe applicant by virtue of a &#8216;will&#8217; executed by one Karsandas Jetidas<br \/>\nPatel became owner and occupier of bearing Block Nos. 20, 37, 140 and<br \/>\n205 of Mouje Raisan, Taluka &amp; District Gandhingar.  The above<br \/>\n&#8216;will&#8217; came to executed on 3.9.1985 before the Executive Magistrate<br \/>\nin presence of two witnesses. The above Karsandas Jetidas Patel<br \/>\nexpired on 19.12.1993 and his death was registered at Raisan village<br \/>\nwith the office of Talati cum Mantri and accordingly his name is<br \/>\nentered into revenue record and reflected so in the abstract of form<br \/>\nNo.7\/12 since 1994 onwards.  That a person having similar name like<br \/>\nKarsandas who expired on 10.12.1967 according to complainant with<br \/>\nwhich the applicant has no connection and that Karsandas had only one<br \/>\nland bearing Block No.8 and revenue records reveal the above aspect,<br \/>\nwhile the applicant is concerned with Block No.20, 37, 140 and 205.<br \/>\nIt is submitted that the complaint is filed after a lapse of about 16<br \/>\nto 17 years and a systematic effort is made by said Shri Umesh<br \/>\nHargovandas Patel at the instance of investigating officer to see<br \/>\nthat somehow the applicant is arrested.  It is submitted that none of<br \/>\nthe relatives whose statement is recorded by the investigating agency<br \/>\nhas taken any action of civil nature to challenge the &#8216;will&#8221; alleged<br \/>\nto have been executed on the basis of death certificate of Karsandas<br \/>\nJetidas Patel.  Therefore, according to learned counsel for the<br \/>\napplicant for alleged incident and allegations pertaining to<br \/>\ntransactions  of sale of the land based on documents the applicant is<br \/>\nsought to be arrested, where no custodial interrogation is necessary.\n<\/p>\n<p>3.\tHeard<br \/>\nLearned APP for the respondent &#8211; State who opposes grant of<br \/>\nbail on the ground that prima facie investigation has revealed that<br \/>\nthe applicant has got entered his name in the revenue record on the<br \/>\nbasis of a &#8216;will&#8217; which had root in forged death certificate of<br \/>\nKarsandas.  Therefore, according to learned APP custodial<br \/>\ninterrogation of the applicant is necessary and therefor powers may<br \/>\nnot be exercised in favour of the applicant.\n<\/p>\n<p>4.\tConsidering<br \/>\nall relevant material at this stage including affidavit filed by the<br \/>\nI.O., it is not in dispute that the alleged incident for which<br \/>\ncomplaint is filed is of year 1994 about recording entry into revenue<br \/>\nrecord on the basis of &#8216;will&#8217; which was registered as early as on<br \/>\n3.9.1985 almost about 25 years ago.  There are proceedings undertaken<br \/>\nbefore revenue authorities and admittedly there was no legal heirs of<br \/>\ndeceased Karsandas Jetidas Patel and none of the relatives of the<br \/>\ndeceased has taken any action and even alleged &#8216;will&#8217; is also not<br \/>\nchallenged.  Besides, name of the applicant appearing in the revenue<br \/>\nrecord for block Nos. other than Block No. 8 and the applicant is<br \/>\nhaving permanent residence in the City of Ahmedabad and will be<br \/>\navailable for investigation if necessary and by imposing suitable<br \/>\nconditions, I am inclined to grant anticipatory bail.   This Court<br \/>\nhas also taken into consideration the law laid down by the Apex Court<br \/>\nin the case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors. Reported<\/a> in [2011]1 SCC 694, wherein<br \/>\nthe Apex Court reiterated the law laid down by the Constitutional<br \/>\nBench in the case of Shri Gurubaksh Singh Sibbia &amp; Ors.<br \/>\nReported in [1980]2 SCC 565.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this application is allowed by directing that in the<br \/>\nevent of the applicant herein being arrested pursuant to FIR being CR<br \/>\nNo.I-24 of 2011 with Adalaj Police Station, Gandhinagar,  the<br \/>\napplicant shall be released on bail on furnishing a bond of<br \/>\nRs.10,000\/- (Rupees Ten Thousand only) with one surety of like amount<br \/>\non following conditions :-\n<\/p>\n<p>[a]\tshall<br \/>\ncooperate with the investigation and make himself available for<br \/>\ninterrogation whenever required.\n<\/p>\n<p>[b]\tshall<br \/>\nremain present at concerned Police Station on  8.4.2011 between 11:00<br \/>\nam to 2:00 pm:\n<\/p>\n<p>[c]\tshall<br \/>\nnot hamper the investigation in any manner nor shall directly or<br \/>\nindirectly make any inducement, threat or promise to any witness so<br \/>\nas to dissuade them from disclosing such facts to the Court or to any<br \/>\nPolice Officer;\n<\/p>\n<p>[d]\tshall<br \/>\nat the time of execution of bond, furnish the address to the<br \/>\nInvestigating Officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]<br \/>\n\twill not leave India without the permission of the Court and, if is<br \/>\nholding a Passport, shall surrender the same before the trial Court<br \/>\nimmediately<\/p>\n<p>[f]\tIt<br \/>\nwould be open to the Investigating Officer to file an application for<br \/>\nremand, if he considers it just and proper and the concerned<br \/>\nMagistrate would decide it on merits.\n<\/p>\n<p>[g]\tdespite<br \/>\nthis order, it would be open for the Investigating Agency to apply to<br \/>\nthe competent Magistrate, for police remand of the applicant. The<br \/>\napplicant shall remain present before the learned Magistrate on the<br \/>\nfirst date of hearing of such application and on all subsequent<br \/>\noccasions, as may be directed by the learned Magistrate. This would<br \/>\nbe sufficient to treat the accused in the judicial custody for the<br \/>\npurpose of entertaining application of the prosecution for police<br \/>\nremand. This is, however, without prejudice to the right of the<br \/>\naccused to seek stay against an order of remand, if ultimately<br \/>\ngranted, and the power of the learned Magistrate to consider such a<br \/>\nrequest in accordance with law. It is clarified that the applicant,<br \/>\neven if, remanded to the police custody, upon completion of such<br \/>\nperiod of police remand, shall be set free immediately, subject to<br \/>\nother conditions of this anticipatory bail order.\n<\/p>\n<p>7.\tRule<br \/>\nmade absolute.
