Justice R.BASANT\n\n Dated :25\/06\/2008\n\n O R D E R\n                          R.BASANT, J.\n                       ----------------------\n                    W.P.C.No.19020 of 2008\n                   ----------------------------------------\n              Dated this the 25th day of June 2008\n\n                         J U D G M E N T\n<\/pre>\n<p>     The grievance of the petitioners is about non-registration of<\/p>\n<p>a proper F.I.R and not conducting a proper investigation into an<\/p>\n<p>F.I.R which is already registered. The number, details etc. are<\/p>\n<p>not furnished. However, it is submitted that Ext.P1 application<\/p>\n<p>submitted before the Superintendent of Police has not evoked<\/p>\n<p>any proper action.\n<\/p>\n<p>     2.   In short, the grievance is about non-registration of<\/p>\n<p>crime and the failure to conduct a proper investigation. The<\/p>\n<p>decision in <a href=\"\/doc\/1836621\/\">Sakiri Vasu v. State of U.P &amp; Others<\/a> [2008 AIR SCW<\/p>\n<p>309] which has been followed by this court in <a href=\"\/doc\/1347108\/\">Vasanthi Devi v.<\/p>\n<p>Sub Inspector of Police<\/a> [2008(1) KLT 945] has changed the law<\/p>\n<p>on the point and they are authority for the proposition that a<\/p>\n<p>person aggrieved by such non-registration of the F.I.R or the<\/p>\n<p>omission to conduct a proper investigation cannot rush to this<\/p>\n<p>court with applications under Article 226 of the Constitution of<\/p>\n<p>India or under Section 482 Cr.P.C. They must first take resort to<\/p>\n<p>the equally efficacious alternative remedy available to them<\/p>\n<p>under Section 156(3) Cr.P.C before the learned Magistrate.<\/p>\n<p><span class=\"hidden_text\">W.P.C.No.19020\/08                 2<\/span><\/p>\n<p>      3.    Inasmuch as the petitioners have not exhausted the<\/p>\n<p>said equally efficacious alternative remedy, I am satisfied that<\/p>\n<p>this writ petition cannot be considered favourably.<\/p>\n<p>      4.    This writ petition is accordingly dismissed.
