No.45169 of 2010\n                             RAM BARAN DAS .\n                                    Versus\n                             STATE OF BIHAR .\n                                   -----------\n<\/pre>\n<p>03\/-   08-03-2011                Heard learned counsels for the petitioners and<\/p>\n<p>                     learned Additional Public Prosecutor for the State.<\/p>\n<p>                                 All these four bail applications arising out of same<\/p>\n<p>                     police station case i.e. Benipatti P.S. Case No. 79 of 2010 are<\/p>\n<p>                     heard together and being disposed of by this common order.<\/p>\n<p>                                 In this case instituted against unknown relating to<\/p>\n<p>                     taking of one tractor with trailer from the informant and son of<\/p>\n<p>                     the owner (the deceased) by consuming some eatable during<\/p>\n<p>                     transit causing them senseless by three non petitioners<\/p>\n<p>                     intercepting them and have also been identified during T.I.P.<\/p>\n<p>                     Petitioners name emerged during investigation and except<\/p>\n<p>                     petitioner Md. Gulam Rasool other three petitioners have<\/p>\n<p>                     confessed their involvement before the police. The role of the<\/p>\n<p>                     petitioners in the entire episode as appears from their said<br \/>\n<span class=\"hidden_text\">                                  2<\/span><\/p>\n<p>            confessional statement and other material submitted by learned<\/p>\n<p>            Additional Public Prosecutor are to manage entire affairs<\/p>\n<p>            behind the screen and disposing of the stolen tractor and<\/p>\n<p>            trailer. Petitioner, namely, Naiyar Imam @ Mumtaz @ Neta is<\/p>\n<p>            said to have approached another petitioner, namely, Sanjay<\/p>\n<p>            Thakur @ Davi Lal in disposing of the property whereas<\/p>\n<p>            petitioner, namely, Ram Baran Das remained only in<\/p>\n<p>            association of others. There appears nothing more specific.<\/p>\n<p>                        Considering the facts and circumstances of the<\/p>\n<p>            case, let all the four petitioners, namely, Naiyar Imam @<\/p>\n<p>            Mumtaz @ Neta, Sanjay Thakur @ Davi Lal, Md. Gulam<\/p>\n<p>            Rasool and Ram Baran Das are directed to be released on bail<\/p>\n<p>            on furnishing bail bond of sum of Rs. 10,000\/- (ten thousand<\/p>\n<p>            only) each with two sureties of the like amount each to the<\/p>\n<p>            satisfaction of learned Chief Judicial Magistrate, Madhubani in<\/p>\n<p>            connection with Benipatti P.S. Case No. 79 of 2010. One of<\/p>\n<p>            the bailor must be a government servant.
