monetary benefit flowing from the quashing of the above
\norders including the award of costs. <\/p>\n
T his Writ Petition coming on for final <\/p>\n
day, Chief Justice passed the following order;:._    <\/p>\n

The petitioner is Va._V_\u00b0’Stenographer,_  ‘was-V<\/p>\n
employed in the Sessions Qiv-isi’on,’-~.Hassan.,.During the
\ncourse of her  dated
\n25.11.1996  statement of
\nimputatiorils   charge–sheet is
\nbeing   it  6<\/p>\n
1 .9 9 1 +\u20acrhei._. A-:1ci.1.Munsiff and J.M.F.C (11
\n Court}.’\u00b0I-‘lastsan, in his [).O.Letter No.2\/96
\n“Dated 16\/ 11\/1996 has reported that at
\nab’ou_t 10.50 A.M. you entered into chamber
\n\u00aband asked the Presiding Officer why you
\n have ordered for issue of memo in respect of<\/p>\n
–  ” attending in framing of charges and
\n1′ .”\u00a7–p1’eas in C.C. 1586\/93, 1154\/95 and 4541\/94
\n~ on 14\/ 11\/1996 and you further spoken that
\n‘”the Add1.Munisff. Hassan, acting at the
\ninstigation of District Judge” and that you
\nknow what to do and how to give reply to the
\nmemo. This amounts to serious misconduct<\/p>\n
on the part of Srnt.K.Gayathri Devi,<\/p>\n
Stenographer.\n<\/p>\n
You are in the habitual in insuiting the
\nPresiding Officer whenever Work entrusted to<\/p>\n
you and when the same is not attending in
\nthe stipulated period, for instance your four
\nincrements have been with–ho1d with
\ncumulative effect in DE. 1\/96.”\n<\/p>\n
2. T he petitioner submitted a reply to the <\/p>\n
charge–sheet on 21.12.1996. After the   <\/p>\n
the departmental enquiry, the”ddidscipiinaryhi”authority<\/p>\n
in\ufb02icted the punishment of stoppage of <\/p>\n
with cumulative effect on thejpetitioner;”yide’\u00b0\u00bban” order
\ndated It1e.i998.’rhe\u00ab;xaru\u00a7\ufb01\u00a2r \ufb01re\ufb01ured an: appeal
\nagainst the order passed  authority<\/p>\n
which was  1\u20aciy’th’e.:’a–ppe.1.}:ate authority on<\/p>\n

\n  the orders dated 19.6.1998<\/p>\n
and 28.112-Q04, VVth_’edpeti:t=ioner approached this Court by<\/p>\n
 =   presentwrit’ petition.\n<\/p>\n
 _V  ~TIp’he”-..fi_rst contention advanced by the iearned<\/p>\n
uddcountsei’   petitioner was, that the entire enquiry\n<\/p>\n
–V proe’eeding”sv stand vitiated on account of the fact, that
\n dd\ufb01dufring  the course of the Departmentai Enquiry<\/p>\n
‘  conducted against the petitioner. the petitioner was not<\/p>\n
permitted to lead any evidence in her defence. Referring
\nto the rules of natural justice as also the mandate of<\/p>\n
provisions of Article 311(2) of the Constitution India,<\/p>\n
it is submitted by the learned counsel for
\nthat the enquiry conducted “against_7’th’e:’.’;petiti’onerll”
\ncannot be said to be reasonabie1’_’_’as’l shed”<\/p>\n

5. We;  iirst contention
\nadvanced  the petitioner on
\nthe issltiel  l  an opportunity of<\/p>\n
leading’-ei\/idence”‘iii._llher”defence. In the statement of<\/p>\n
irnputations, thepcategoric stance of the respondents as<\/p>\n
:.”=__!Vi’depic’te:dl..in:’paragraph–8 is that the petitioner having
\n sufficient opportunity, did not adduce any
\n evidence’; .V’l;hat apart, we have perused the appeal
\n by the petitioner against the punishment
\n    dated 19.6.1998. Although, the aforesaid appeal<\/p>\n
 was exhaustive wherein the petitioner had raised all<\/p>\n
legal objections which were open to her, it was no where<\/p>\n
her contention that the enquiry officer had not
\npermitted her to lead evidence in her defence. it is<\/p>\n
therefore, not possible for us to accept the*~._i’irst<\/p>\n
contention advanced by the learned coun\u00e9\u00e9el  .<\/p>\n
petitioner.\n<\/p>\n
6. The second contention advanced <\/p>\n
counsel for the petitionerll.v\\’fa.s, that <\/p>\n
inflicted upon the petitionerhighly.disproplbrtionate
\nto the charges levelled  her. it was
\nsought to   presumed for
\nthe sake  ltlheipipetitioner was guilty of
\nthe   was extremely harsh<\/p>\n
for  to inflict the major penalty<\/p>\n
of stoppage of increments with cumulative effect on<\/p>\n
. her,<\/p>\n
   apparent from the statement of<\/p>\n
impiltaitiolis which have been extracted hereinabove,<\/p>\n
it that the charge levelled against the petitioner is of
\n internperate behaviour. The statement of imputation<\/p>\n
