PIO was directed to give the complete\nreply to the Appellant within 15 days.\n Grounds for Second Appeal:\nIncomplete &amp; misleading, Information on point no. 4 to 9 (out of 9) was not provided.\n\nRelevant Facts<\/pre>\n<p> emerging during Hearing:\n<\/p>\n<p>The following were present:\n<\/p>\n<p>Appellant: Absent;\n<\/p>\n<p>Respondent: Mr. Kifayat Khan, APIO &amp; Education Officer;\n<\/p>\n<p>       The PIO has provided information to the Appellant on 29\/01\/2010 but has not provided<br \/>\ninformation on queries 7 &amp; 9 which should have been provided. Since the RTI application was<br \/>\nreceived on 07\/11\/2009 the information should have been provided by 07\/12\/2009 instead of<br \/>\nwhich it was provided on 29\/01\/2010 i.e. after a delay of 52 days.\n<\/p>\n<p>The Deemed PIO Mr. Kifayat Khan claims that he has sought the assistance of the Principal of<br \/>\nthe School Ms. Kiran Arya but is able to show no documents to prove this.\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>       Mr. Kifayat Khan, APIO is directed to provide the information on queries 7 and 9 to the<br \/>\nAppellant before 10 May 2010.\n<\/p>\n<p>The issue before the Commission is of not supplying the complete, required information by<br \/>\nthe Deemed PIO Mr. Kifayat Khan within 30 days as required by the law.<br \/>\nFrom the facts before the Commission it is apparent that the Deemed PIO is guilty of not<br \/>\nfurnishing information within the time specified under sub-section (1) of Section 7 by not<br \/>\nreplying within 30 days, as per the requirement of the RTI Act.\n<\/p>\n<p>It appears that the deemed PIO&#8217;s actions attract the penal provisions of Section 20 (1). A<br \/>\nshowcause notice is being issued to him, and he is directed give his reasons to the Commission to<br \/>\nshow cause why penalty should not be levied on him.\n<\/p>\n<p>Mr. Kifayat Khan,will present himself before the Commission at the above address on 24 May<br \/>\n2010 at 11.30am alongwith his written submissions showing cause why penalty should not be<br \/>\nimposed on him as mandated under Section 20 (1).
