PUBLIC PROSECUTOR for Opponent(s) :\n3, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 21\/01\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent appeal, under Section 387(4) of the Code of Criminal<br \/>\nProcedure, 1973, is directed against the judgment and order<br \/>\nof acquittal dated 31.12.2008 passed by the learned JMFC (Municipal),<br \/>\nSurat, in  Municipal case No. 1081 of 1992.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the case is that on 14.11.1991 the Octoroi Officer of<br \/>\nSurat  Municipal Corporation had visited the business place of the<br \/>\naccused to inquire about the fact as to whether Octroi of the<br \/>\nelectric goods lying the business premises is paid by the accused or<br \/>\nnot.  The concerned Officer had also asked for the records for the<br \/>\nsame from the accused. It is alleged that the statement of the<br \/>\naccused was also recorded. It is also alleged that in December, 1991<br \/>\nthe accused had produced the record of the year  1988-89, 1989-90 and<br \/>\n1990-91 and after verifying the said record it was found that the<br \/>\naccused has not paid the Octroi as per bill.  The accused could not<br \/>\ngive any explanation though repeatedly reminded by the complainant,<br \/>\nand thereby the accused has committed the theft of Octroi worth Rs.<br \/>\n1,59,85=71 Paise. Thereby the respondent-accused has committed the<br \/>\nbreach of Rule 13(1)(E), 13(2) 28(1), 28(2)(A), 28(2)(B) of the<br \/>\nOctroi Rules and Standing Order (1) and, therefore, the complaint has<br \/>\nbeen filed against the accused for the offence under Section 358 of<br \/>\nthe BPMC Act, in the Court of learned J.M.F.C.(Municipal), Surat.\n<\/p>\n<p>3.\tThe<br \/>\nlearned Magistrate has recorded the plea of the accused. The accused<br \/>\nhas not pleaded guilty to the charge. Thereafter, the trial was<br \/>\nconducted by the learned Magistrate. The prosecution has examined the<br \/>\nwitnesses and also produced the documentary evidence.\n<\/p>\n<p>4.\tThereafter,<br \/>\nafter considering the oral as well as documentary evidence the<br \/>\nlearned Magistrate, by judgment and order dated 31.12.2008, has<br \/>\nacquitted the respondent-accused from the charges leveled against<br \/>\nhim. Against the said judgment and order of learned Magistrate,<br \/>\noriginal complainant has filed this appeal.\n<\/p>\n<p>5.\tI<br \/>\nhave heard learned Counsel Mr. Kaushal Pandya, appearing on behalf of<br \/>\nappellant   Surat Municipal Corporation, at length. I have also<br \/>\ngone through the judgment and record of the Trial Court, produced<br \/>\nbefore me. Mr. Pandya has also taken this court through the Octroi<br \/>\nRules and contended that the Surat Municipal Corporation is a Public<br \/>\nBody and it is the obligatory duty on the part of the respondent<br \/>\naccused to pay the octroi as per Rules. Mr. Pandya has contended that<br \/>\ndespite the demand for octroi, the respondent   accused had refused<br \/>\nto pay the amount of octroi and, therefore, the accused has committed<br \/>\nan offence under the Provisions of BPMC Act and the Rules framed<br \/>\nthereunder.\n<\/p>\n<p>6.<br \/>\n\tI have perused the judgment and order of learned Magistrate and also<br \/>\ngone through the records produced before me.  From the record<br \/>\nproduced before me, I am of the opinion that there is no need to call<br \/>\nfor Record &amp; proceedings from the trial Court and,therefore, I<br \/>\ndecide all the Appeal finally at the admission stage.\n<\/p>\n<p>7.\tFrom<br \/>\nthe perusal of Rule 19, 19(2) and 20 of the Octroi Rule, it is the<br \/>\nduty of the corporation to serve the notice of claim to the opposite<br \/>\nparty, but, Mr. Pandya is unable to produce any evidence to that<br \/>\neffect. From the record it is clearly established that notice of<br \/>\nclaim, which is mandatory, is not issued to the respondent<br \/>\naccused. From the record it is not proved that under Rule- 9, the<br \/>\ndemand was made by the complainant to pay the Octroi and the accused<br \/>\nhas not paid the same.  The trial Court has also clearly observed<br \/>\nthat as per the evidence of the complainant, both the parties, the<br \/>\nseller and the purchaser, are of the same plea and when the goods<br \/>\nwere sold and purchased in Surat, there is no question of octroi to<br \/>\nbe paid by the respondent   accused.\n<\/p>\n<p>8.\tThe<br \/>\nLearned advocate appearing on behalf of corporation is not in a<br \/>\nposition to show any evidence to take a contrary view of the matter<br \/>\nor that the approach of the trial court is vitiated by some manifest<br \/>\nillegality or that the decision is perverse or that the trial court<br \/>\nhas ignored the material evidence on record.\n<\/p>\n<p>9.\tIn<br \/>\nthe above view of the matter, I am of the considered opinion that the<br \/>\ntrial court was  completely justified in acquitting the respondent of<br \/>\nthe charges leveled against him.\n<\/p>\n<p>10.<br \/>\nI find that the findings recorded by the trial court are absolutely<br \/>\njust and proper and in recording the said findings, no illegality or<br \/>\ninfirmity has been committed by it.\n<\/p>\n<p>11.\tI<br \/>\nam, therefore, in complete agreement with the findings, ultimate<br \/>\nconclusion and the resultant order of acquittal recorded by the court<br \/>\nbelow and hence find no reasons to interfere with the same. Hence the<br \/>\nappeal is hereby dismissed. Impugned judgment and order of acquittal<br \/>\ndated 31.12.2008 passed by the<br \/>\nlearned JMFC (Municipal), Surat, in  Municipal case No. 1081 of 1992,<br \/>\nis hereby confirmed.
