Justice R.BASANT\n\n Dated :02\/01\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                       ------------------------------------\n\n                         Crl.M.C.No.170 of 2006\n\n                      -------------------------------------\n\n                 Dated this the  2nd day of January, 2007\n\n\n                                     ORDER\n<\/pre>\n<p>      The   petitioner   faces   indictment   in   a   prosecution   under<\/p>\n<p>Section 138 of the N.I Act.   The trial has started and the matter<\/p>\n<p>is at the defence stage now.  At the defence stage, the petitioner<\/p>\n<p>wanted   the   cheque   to   be   sent   to   the   expert   for   comparison   of<\/p>\n<p>signature.     The   learned   Magistrate   by   the   impugned   order   has<\/p>\n<p>rejected the prayer.  The petitioner has hence come to this Court<\/p>\n<p>with this Crl.M.C.\n<\/p>\n<\/p>\n<p>      2.     A   revision   petition   is   not   maintainable,   the   order<\/p>\n<p>impugned being an interlocutory order.  Normally the  petitioner<\/p>\n<p>must  therefore   wait  to challenge   the  order   along  with   the  final<\/p>\n<p>order\/judgment, which is to be passed in the prosecution under<\/p>\n<p>Section   138   of   the   N.I   Act.     The   petitioner   has   rushed   to   this<\/p>\n<p>Court   with   this   petition   under   Section   482   Cr.P.C   to   assail   the<\/p>\n<p>order passed by the learned Magistrate.\n<\/p>\n<\/p>\n<p>      3.     I   shall   scrupulously   avoid   any   expression   of   opinion<\/p>\n<p>which would prejudice the interests of the petitioner and disable<\/p>\n<p>him   to     challenge   the   impugned   order,   if   necessary   along   with<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.170 of 2006                          2<\/span><\/p>\n<p>the   judgment   to   be   passed   in   the   prosecution   by   the   learned<\/p>\n<p>Magistrate.   I shall confine myself to the consideration whether<\/p>\n<p>powers   under   Section   482   Cr.P.C   can,   need   or   ought   to   be<\/p>\n<p>invoked in favour of the petitioner at this stage to interfere with<\/p>\n<p>the impugned order.\n<\/p>\n<\/p>\n<p>      4.     The   impugned   order   reveals   that   the   petitioner<\/p>\n<p>accepts that the cheque  was handed over  by him as security to<\/p>\n<p>another   person.     The   learned   Magistrate   took   note   of   the   fact<\/p>\n<p>that   inherently   the   plea   that   a   blank   unsigned   cheque   was<\/p>\n<p>handed over as security does not stand to reason and logic.  The<\/p>\n<p>learned   Magistrate   further   observed   that   in   the   cross<\/p>\n<p>examination   of   the   complainant,   no   specific   dispute   about   the<\/p>\n<p>signature was raised.  The learned Magistrate further noted that<\/p>\n<p>in   the   313   statement   also,   no   specific   denial   of   signature   had<\/p>\n<p>been   raised.     The   learned   Magistrate   did   also   observe   that   the<\/p>\n<p>notice   of   demand   under   Section   138   of   the   N.I   Act   was   not<\/p>\n<p>replied to at all.\n<\/p>\n<\/p>\n<p>      5.     The   above   circumstances   do   compellingly   suggest   to<\/p>\n<p>me   that   this   is   not   a   fit   case   where   the   extraordinary   inherent<\/p>\n<p>jurisdiction available to this Court under Section 482 Cr.P.C can<\/p>\n<p>or need be invoked.\n<\/p>\n<p>\n<span class=\"hidden_text\">Crl.M.C.No.170 of 2006                     3<\/span><\/p>\n<p>         6.    This Crl.M.C is, in these circumstances, dismissed.   I<\/p>\n<p>may however hasten to observe that the dismissal of this Crl.M.C<\/p>\n<p>will not in any way fetter the rights of the petitioner to raise all<\/p>\n<p>appropriate   and   relevant   contentions   before   the   learned<\/p>\n<p>Magistrate in the course of the trial.   Any observation  made by<\/p>\n<p>the   learned   Magistrate   in   the   impugned   order   or   observations<\/p>\n<p>made by this Court in this order shall not fetter the rights of the<\/p>\n<p>petitioner   to   raise   such   contentions.     The   learned   Magistrate<\/p>\n<p>must   consider   all   such   contentions   on   merits   uninfluenced   by<\/p>\n<p>such observations in this order and the impugned order.<\/p>\n<p>         7.
