JUSTICE ABHILASHA KUMARI\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 03\/10\/2011  \nORAL ORDER<\/pre>\n<p>1.\tThis<br \/>\npetition under Article 226 of the Constitution of India has been<br \/>\nfiled, with the following prayers :\n<\/p>\n<p>&#8220;This<br \/>\n Honourable Court be pleased to issue a writ of mandamus under<br \/>\narticle 226 &amp; 227 of the Constitution of India, writ of mandamus<br \/>\nor any other appropriate writ, directions or order in the nature of<br \/>\nmandamus and be pleased to further:\n<\/p>\n<p>\t(a)\tAdmit<br \/>\nthe petition;\n<\/p>\n<p>(b)\tBe<br \/>\npleased to direct the respondent Nos.1 to 3 to take immediate action<br \/>\nagainst the respondent No.4 in accordance with law;\n<\/p>\n<p>(c)\tBe<br \/>\npleased to direct the respondents to take immediate action against<br \/>\nthe respondent No.4 in accordance with law; by way of an interim<br \/>\nrelief;\n<\/p>\n<p>(d)\tGrant<br \/>\nsuch other and further relief\/s as may be deemed fit and proper in<br \/>\nthe interest of justice.&#8221;\n<\/p>\n<p>2.\tThe<br \/>\npetitioner is purported to be a resident of Village Sargasan where,<br \/>\nas stated in the petition, he is doing his &#8220;business&#8221;.\n<\/p>\n<p>3.\tThe<br \/>\npetition pertains to several alleged irregularities in the School run<br \/>\nby respondent No.4- Trust, that have been detailed in the<br \/>\nmemorandum of the petition. The allegations levelled by the<br \/>\npetitioner are that the School run by respondent No.4-Trust is<br \/>\nbeing run illegally and in contravention  of the provisions of law<br \/>\nand rules. It is stated that the petitioner has acquired certain<br \/>\ninformation under the Right to Information Act, 2005 and has made<br \/>\nseveral complaints to the concerned authorities regarding the<br \/>\nirregularities in the School. However, in spite of the same, the<br \/>\nauthorities are not taking any action.\n<\/p>\n<p>4.\tMr.K.H.Baxi,<br \/>\nlearned advocate for the petitioner  has reiterated that several<br \/>\ncomplaints have been made to respondents Nos.1 to 3 by the petitioner<br \/>\nregarding the irregularities committed by respondent No.4 in the<br \/>\nrunning of the School. It is further submitted that certain false<br \/>\nsubmissions have been made on affidavit and offence committed by<br \/>\nrespondent No.4 &#8211; Trust, which have been brought to the notice<br \/>\nof respondent Nos.1 to 3, who have not taken any action thereupon,<br \/>\ntherefore, directions may be issued to them to take action against<br \/>\nrespondent No.4.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocate for the petitioner at length and having<br \/>\nperused the contents of the petition, it is clear therefrom that the<br \/>\npetition has not been filed in the public interest, and neither is<br \/>\nthe petitioner a &#8220;person aggrieved&#8221;, so as to maintain a<br \/>\npetition under Article 226 of the Constitution of India. The<br \/>\npetitioner can be termed to be a complainant, at the most, but is not<br \/>\npersonally concerned with the School in question, or with respondent<br \/>\nNo.4.\n<\/p>\n<p>6.\tNo<br \/>\nlegal, fundamental or indefeasible right of the petitioner appears to<br \/>\nhave been violated and it is not so stated in the petition, as well.<br \/>\nIn this view of the matter, as the petitioner is not a &#8220;person<br \/>\naggrieved&#8221;
