He is facing charge under<br \/>\n\tSections 420, 467, 468, 471 read with Section 120-B of the IPC and<br \/>\n\tSections 13(2) and 13(1)(d) of the Prevention of Corruption Act. CBI<br \/>\n\thas investigated into said charges. Charge-sheet is already filed.<br \/>\n\tCharge is however, yet to be framed. Bank locker running in name of<br \/>\n\tthe petitioner was sealed by CBI.\u00a0She therefore, applied for<br \/>\n\tde-freezing of locker No.  72  of Punjab National Bank, Peddar Road,<br \/>\n\tMumbai. Below such application being Criminal Misc. Application No.<br \/>\n\t32\/2010 dated 17.2.2010 CBI court passed impugned order on 4.8.2010<br \/>\n\trejecting the request. Thereupon the  petitioner has approached the<br \/>\n\tHigh Court.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the document on record and hearing counsel for the<br \/>\n\tparties, I find that before the CBI Court, CBI had filed reply dated<br \/>\n\t4.3.2010 in the said application in which it is clearly stated that<br \/>\n\tobservation memo dated 19.2.2010 does speak about few gold items<br \/>\n\tfound in locker and passports of the accused and the petitioner. It<br \/>\n\tis clearly stated that none of the articles were seized and that key<br \/>\n\tof the locker was returned back. A letter was addressed to the bank<br \/>\n\tfor stopping operation of the locker in view of investigation of the<br \/>\n\tcase. However, it is not the case of the prosecution that same  was<br \/>\n\tobtained by the accused out of defrauded amount. It was  further<br \/>\n\tstated that :\n<\/p>\n<p> It<br \/>\n\tis submitted that though the locker in question is not a relied upon<br \/>\n\tarticle of this case and the link between the contents of the locker<br \/>\n\tand proceeds of the crime could not be established during<br \/>\n\tinvestigation, it will  not be out of place to mention that the bank<br \/>\n\twho has been put to loss for more than Rs. 100 crores has not been<br \/>\n\table to recover the amount lost. In case the locker is allowed to be<br \/>\n\toperated by the applicant, nothing will be left to the Court to<br \/>\n\trecover the dues by imposing fine in case the accused is convicted<br \/>\n\tafter completion of trial.\n<\/p>\n<p>PRAYER<\/p>\n<p>In<br \/>\n\tthe light of the above submission it is humbly prayed to this<br \/>\n\tHon&#8217;ble Court that till the time the rightful owner of the articles<br \/>\n\tmentioned in the observation memo and those seized during searches<br \/>\n\tconducted at the residence of the accused is established before the<br \/>\n\tHon&#8217;ble Court, request of the applicant Smt. Saroj R. Sawarkar may<br \/>\n\tplease be rejected in the interest of justice <\/p>\n<p>When<br \/>\n\tthe CBI is clearly stating before the Court that items lying in the<br \/>\n\tlocker were not acquired from the defrauded amount by the accused,<br \/>\n\tthere is thereafter no further question of seizing article or<br \/>\n\tputting any restriction on such articles for use and enjoyment of<br \/>\n\tthe owner thereof.\n<\/p>\n<p>In<br \/>\n\tthe result, impugned order dated 4.8.2010 is quashed. Application of<br \/>\n\tthe petitioner being Criminal Misc. Application No. 32\/2010 dated<br \/>\n\t17.2.2010 is allowed. CBI order restricting the operation of the<br \/>\n\tbank locker No.  72  of Punjab National Bank, Peddar Road, Mumbai,<br \/>\n\tstands lifted.
