J.\n<\/p>\n<p>     The appellant-trust  had given shop premises No. 1930\/1<br \/>\nsituated in  Mohalla Ghatia Azam Khan, Agra belonging to the<br \/>\nappellant to  the original  respondent on lease at a monthly<br \/>\nrent of Rs. 75\/- sometime in 1954. The terms relating to the<br \/>\ntenancy which  were agreed  upon between  the  parties\twere<br \/>\nreduced to  writing. This document is Ex.12. It is, however,<br \/>\nnot registered.\t As the\t respondent did\t not pay any rent to<br \/>\nthe appellant  since 1.1.1960  the appellant served a notice<br \/>\nto quit\t dated 27.3.1961  on the respondent and filed a suit<br \/>\nfor ejectment  and recovery of arrears of rent. The suit was<br \/>\ndecreed\t by  the  Trial\t Court\tbut  was  dismissed  by\t the<br \/>\nappellate court\t on the\t ground that the appellant was not a<br \/>\nregistered body\t and all  the trustees\tof the trust had not<br \/>\njoined in  the\tsuit.  The  appellant-trust  thereafter\t got<br \/>\nitself registered on 8.5.1963. The appellant served a notice<br \/>\nto quit\t on the respondent which is dated 30th of May, 1963.<br \/>\nThe notice  period is  30 days. As the respondent failed and<br \/>\nneglected to  comply with  the notice  the appellant filed a<br \/>\nsuit against  respondent for ejectment &amp; recovery of arrears<br \/>\nof rent\t and other consequential reliefs. The suit was filed<br \/>\nbefore the  Munsif&#8217;s Court  at Agra. The suit was decreed by<br \/>\nthe trial  court. The  respondent filed an appeal before the<br \/>\nAdditional Civil Judge, Agra.\n<\/p>\n<p>     The only  point which  was raised\tby the respondent in<br \/>\nappeal was  that the  notice dated 30.5.1963 terminating the<br \/>\ntenancy of  the respondent  was invalid because the lease in<br \/>\nfavour of  the respondent was a manufacturing lease; and six<br \/>\nmonths&#8217; notice under Section 106 of the Transfer of Property<br \/>\nAct was\t necessary in  order to\t terminat the tenancy of the<br \/>\nrespondent. The appellate court rejected this contention and<br \/>\nheld that  in view  of the  agreement which was entered into<br \/>\nbetween the parties (Ex.12) there was an express term of the<br \/>\ncontract that  a notice\t in writing of fifteen days only was<br \/>\nnecessary for the termination of tenancy.\n<\/p>\n<p>     In second\tappeal, however,  before the  High Court  at<br \/>\nAllahabad, a learned Single Judge has come to the conclusion<br \/>\nthat the  terms of  the lease  which are  recorded in  Ex.12<br \/>\ncannot be  relied upon\tin view of the provisions of section<br \/>\n107 of\tthe Transfer  of Property Act. Hence the term in the<br \/>\nagreement  relating   to  giving  fifteen  days&#8217;  notice  of<br \/>\ntermination cannot  be looked  at. He held that as the lease<br \/>\nwas a  manufacturing lease,  six months&#8217; notice was required<br \/>\nunder the  deeming provision  of Section 106 of the Transfer<br \/>\nof Property  Act. In  its absence,  the suit  must fail. He,<br \/>\ntherefore, allowed  the appeal and dismissed the appellant&#8217;s<br \/>\nsuit for  ejectment. Learned  Single Judge, however, decreed<br \/>\nthe claim  of the appellant for arrears of rent. The present<br \/>\nappeal is from this judgment of the High Court.\n<\/p>\n<p>     Under Section  107 of  the Transfer  of Property  Act a<br \/>\nlease of  immoveable property  from year  to year of for any<br \/>\nterm exceeding\tone year  can be  made only  by a registered<br \/>\ninstrument. Any\t lease of  this kind would be void unless it<br \/>\nis created  by a  registered instrument. All other leases of<br \/>\nimmoveable property  may be  made  either  by  a  registered<br \/>\ninstrument or  by an  oral agreement accompanied by delivery<br \/>\nof possession. All the courts below have held that there was<br \/>\na valid\t lease. The high Court has also recorded that it was<br \/>\nnot the contention of the respondent that his lease was from<br \/>\nyear to\t year. The  contention was  that the lease was for a<br \/>\nterm exceeding\tone year  and was,  therefore,\tcompulsorily<br \/>\nregisterably under  the first  part of\tsection 107  of\t the<br \/>\nTransfer of property Act. This contention has been negatived<br \/>\nby the High Court as also by both the courts below. The High<br \/>\nCourt has  held that  the lease was not for a term exceeding<br \/>\none year, and so was not compulsorily registerable under the<br \/>\nfirst part  of Section 107. It, however, held that since the<br \/>\nlease was for a manufacturing purpose, six months&#8217; notice to<br \/>\nquit  was  required  under  section  106.  In  its  absence,<br \/>\ntermination was not valid.\n<\/p>\n<p>     This reasoning  is fallacious.  It is  true that  Ex.12<br \/>\nwhich is  not registered,  cannot be looked at because it is<br \/>\nnot registered.\t But the  factum of lease is not in dispute.<br \/>\nAll the\t courts have  held that it was a lease from month to<br \/>\nmonth and  was not for a term exceeding one year. In view of<br \/>\nthis finding,  the deeming  provisions of  the first part of<br \/>\nsection 106  of the  Transfer  of  property  Act  cannot  be<br \/>\nattracted in the present case.\n<\/p>\n<p>     Section 106  provides, inter  alia, that in the absence<br \/>\nof a  contract between\tthe parties,  a lease  of immoveable<br \/>\nproperty for  manufacturing purposes shall be deemed to be a<br \/>\nlease from year to year terminable by six months&#8217; notice. In<br \/>\nthe present case there is a clear finding to the effect that<br \/>\nthe lease  in question\twas not\t from year  to year or for a<br \/>\nperiod exceeding  one year. Therefore, even though the lease<br \/>\nmay be\tfor a manufacturing purpose, since the lease was not<br \/>\nfrom year  to year,  six months&#8217;  notice was not required. A<br \/>\nmanufacturing lease  which is  not from\t year to  year\t,six<br \/>\nmonths&#8217;\t notice\t  was  not  required  six  months&#8217;notice  of<br \/>\ntermination. It will fall in the second half of section 106,<br \/>\nrequiring fifteen  days&#8217; notice of termination. A lease from<br \/>\nmonth to  month or  a lease  other than a lease from year to<br \/>\nyear is terminable by fifteen days&#8217; notice. Hence the notice<br \/>\nin the\tpresent case  is a  valid notice  to quit.  The High<br \/>\nCourt, having  come to the conclusion that the lease was not<br \/>\nfor a  period exceeding\t one year,  and was not a lease from<br \/>\nyear to\t year erred  in holding\t that six  months&#8217; notice to<br \/>\nquit was required. Such a notice is required, provided there<br \/>\nis no  contract to  the contrary,  only when a manufacturing<br \/>\nlease is,  or is  deemed to  be, from year to year. This not<br \/>\nbeing the  case, the  lease is\tterminable by  fifteen days&#8217;<br \/>\nnotice even if the lease is a manufacturing lease.\n<\/p>\n<p>     The appeal is, therefore, allowed with costs.
