      Petitioner is the plaintiff in O.S.No.347 of 2005 on the<\/p>\n
file of the Sub Court, Kozhikode. The above suit was one for<\/p>\n
money, and the respondents are the defendants. Suit claim<\/p>\n
was raised by the petitioner alleging that he was an erstwhile<\/p>\n
partner in two firms along with the defendants, and later, he<\/p>\n
retired from both the firms on the terms and conditions<\/p>\n
stipulated in an agreement entered by all the partners. Some<\/p>\n
claims were outstanding to be settled by the defendants as<\/p>\n
agreed to in the agreement is the basis for the suit claim. He<\/p>\n
also produced a photocopy of the agreement entered by him<\/p>\n
with the defendants. The defendants on entering appearance<\/p>\n
moved an application under Section 8 of the Arbitration and<\/p>\n
Conciliation Act, 1996, hereinafter referred to as the<\/p>\n
‘Arbitration Act’, contending that there is an arbitration clause<\/p>\n
in the partnership deeds for resolving the disputes between<\/p>\n

the   partners   including   the    plaintiff. The     defendants<\/p>\n
contending as above sought for rejection of the plaint. The<\/p>\n
learned Sub Judge, after hearing the counsel on both sides<\/p>\n
and perusing the copies of the partnership deeds Exts.B1 and<\/p>\n
B2 produced by the defendants and also copy of the<\/p>\n
agreement A1 produced by the plaintiff, concluded that<\/p>\n
arbitration clause contained in the partnership deeds will<\/p>\n
prevail and the suit by the plaintiff before the civil court is not<\/p>\n
entertainable. Observing that the parties have to pursue their<\/p>\n
remedy as per the arbitration agreement, the application<\/p>\n
moved by the defendants was allowed.\n<\/p>\n<\/p>\n
     2.   I heard the counsel on both sides.           The relief<\/p>\n
canvassed by the defendants was for rejection of the plaint<\/p>\n
contending that there is an arbitration clause in the<\/p>\n
partnership deeds entered by the parties. It is seen the court<\/p>\n
below without looking into Section 8 of the Arbitration Act has<\/p>\n
allowed that application, which in effect, constitute the<\/p>\n
rejection of the plaint. Existence of an arbitration agreement<\/p>\n
in respect of a dispute canvassed before the court, subject to<\/p>\n
CRP.51\/07                       3<\/span><\/p>\n
the conditions stipulated under Section 8 of the Arbitration<\/p>\n
Act, would result in passing of an order directing the parties<\/p>\n
to arbitration. But, such an order is not one of rejection of the<\/p>\n
plaint, but, only cessation or closing of the proceedings before<\/p>\n
the court.    True, in the present Arbitration Act, there is no<\/p>\n
provision enabling the court to refer the parties to the<\/p>\n
arbitration.   But even then the order passed by the court<\/p>\n
holding that the parties have to resolve their disputes by<\/p>\n
arbitration, in the event of an arbitration agreement between<\/p>\n
them, does not lead to rejection of the plaint, but only closing<\/p>\n
of the suit. Perusing the impugned order, it is seen, the court<\/p>\n
below    has   made    some    observations    as   regards   the<\/p>\n
insufficiency of stamp in Ext.A1 agreement on which the suit<\/p>\n
claim has been raised by the plaintiff.         What has been<\/p>\n
produced before the court, it is stated, is only a photocopy and<\/p>\n
not the original.      Even assuming that the original is<\/p>\n
insufficiently stamped, then also, if it is tendered in evidence,<\/p>\n
proper orders as contemplated under the Stamp Act have to<\/p>\n
be passed by the court. The defendants have advanced a case<\/p>\n
disputing the genuineness of Ext.A1 agreement produced by<\/p>\n
CRP.51\/07                       4<\/span><\/p>\n
the plaintiff with a further case that there is an arbitration<\/p>\n
clause as covered by the partnership deeds. Exts.B1 and B2<\/p>\n
would govern the parties in the event of disputes and<\/p>\n
differences between them. They have not disputed that the<\/p>\n
plaintiff has ceased to be a partner of the firm, which is the<\/p>\n
foundation of the case set up by the plaintiff to sustain his suit<\/p>\n
claim. Even assuming that the partnership deeds constituting<\/p>\n
the firm in which the plaintiff was a partner contained an<\/p>\n
arbitration clause, its effect and validity has to be examined<\/p>\n
with reference to a specific agreement purported to have been<\/p>\n
executed by the partners by which the plaintiff ceased to be a<\/p>\n
partner of the firm. So much so, in the present case, the<\/p>\n
genuineness of Ext.A1 agreement after the production of its<\/p>\n
original by the plaintiff is vital in determining the question<\/p>\n
whether the plaintiff is entitled to the reliefs canvassed in the<\/p>\n
suit. What is noticed is that blindly accepting the contentions<\/p>\n
of the defendants, the court below has rejected the plaint<\/p>\n
presented by the plaintiff without giving him an opportunity to<\/p>\n
present his case. The order impugned is clearly unsustainable<\/p>\n
under law. Setting aside the impugned order, the court below<\/p>\n

is directed to re-examine the matter afresh taking note of the<\/p>\n
observations made above and in accordance with law.<\/p>\n
